ORDINANCE OF THE CITY OF GILROY AMENDING THE ZONING
ORDINANCE OF SAID CITY BY PREZONINGAPPROXIMATELY 205
ACRES ADJOINING THE CITY OF GILROY ON BOTH SIDES OF
MOREY AVENUE AND BOTH SIDES OF KERN AVE~, NORTH OF
FIRST STREET AND SOUTH OF DAY ROAD AS R-1 (SINGLE
FAMILY RESIDENCE).
WHEREAS, JOHN FILICE, ET AL, have heretofore filed
with the Planning Commission of the City of Gilroy a petition
in due form requesting the prezoning of approximately 205
acres as R-1 (Single Family Residence); and
WHEREAS, the Planning Commission of the City of Gilroy has
given due notice of a public hearing upon the said application,
in accordance with the Zoning Ordinance of the City of Gtlroy,
has held the hearing, has approved a Negative Declaration under
the California Environmental Quality Act, and has made its
report to the Council of the City of Gilroy, in which it
recommends that the 205 acres hereinafter described be prezoned
as set forth above; and
WHEREAS, the Council of the City of Gilroy has fixed the
20th day of June, 1983, at the hour of 8:00 o'clock p.m. in the
Council Chambers in the City Hall at 7351 Rosanna Street, Gilroy,
California , as the time and place for hearing the said report
and recommendation upon the said application, and notice of the
said hearing has been given in accordance with the said Zoning
Ordinance, and a public hearing has now been held upon the said
application before the Council, and the Council having duly
considered the said application and the evidence presented, has
approved the Negative Declaration under the California Environmental
Quality Act, and has determined that the said Zoning Ordinance
should be amended in accordance with the report of the said
Planning Commission.

NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY
DOES ORDAIN AS FOLLOWS:
Section 1: The Zoning Ordinance of the City of Gilroy
is hereby amended by prezoning to become effective upon
annexation and placing approximately 205 acres in R-1 District,
as the same is described and defined in the Zoning Ordinance
of the City of Gilroy, the following described premises:
Ail that property located in the County of Santa
Clara, State of California, described as follows:
That 205 acres, more or less, on both sides of Morey
Avenue and both sides of Kern Avenue, north of First
Street and south of Day Road, and shown as parcels
#783-21-001 thru 008, 790-04-008 thru 013, 790-04-023,
039, 043, 044, 045, 046, 048, 049, and 052, 790-19-085
thru 091,790-20-065 thru 075 in the Santa Clara County
!
Tax Assessor s Map Book.
Section 2: The official map constituting a part of the
Zoning Ordinance of the City of Gilroy shall be amended to
reflect the foregoing changes of classification of the said
property.
Section 3: Ail ordinances and parts of ordinances in
conflict herewith are hereby repealed.
Section 4: This ordinance shall take effect and be in full
force thirty (30) days from and after its passage and approval,
and upon annexation of said property to the City of Gilroy.
