Ordinance 1983-22 ORDINANCE NO. 83-22 ORDINANCE OF THE CITY OF GILROY AMENDING 'THE ZONING ORDINANCE OF SAID CITY BY PREZONING APPROXIMATELY 130 ACRES ADJOINING THE CITY OF GILROY EAST 'OF THE SOUTHERN PACIFIC RAILROAD TRACKS, SOUTH OF SOUTHSIDE DRIVE AND WEST OF THE GILROY SEWER TREATMENT PLANT AS PF (PARK/PUBLIC FACILITY) ZONE ~q{EREAS, THE CITY OF GILROY has heretofore filed with the Plamming Commission of the City of Gilroy a petition in due form requesting the prezoning of approximately 130 acres as PF (Park/Public Facility) District; and WHEREAS, the Planning Commission of the City of Gilroy has given due notice of a public hearing upon the said application, in accordance with the Zoning Ordinance of the City of Gilroy, has held the hearing, has approved a Negative Declaration under the California Environmental Quality Act, and has made its report to the Council of the City' of Gilroy, in which it reco~nends that the 130 acres hereinafter described be prezoned as set forth above; and WHEREAS, the Council of the City of Gilroy has fixed the 5th day of December, 1983, at the hour of 8:00 o'clock p.m. in the Council Chambers in the City Hall at 7351 Rosanna Street, Gilroy, California, as the time and place for hearing the said report and recommendation upon the said application, and notice of the said hearing has been given in accordance with the said ~Zoning Ordinance, and a public hearing has now been held upon the said application before the Council, and the Council having duly considered the~'said application and the evidence presented, has approved the ORDINANCE NO. 83-22 Negative Declaration under the California Environmental Quality Act, and has determined that the said Zoning Ordinance should be amended in accordance with the report of the said Planning Commission. NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES ORDAIN AS FOLLOWS: Section l: The Zoning Ordinance of the City of Gilroy is hereby amended by prezoning to become effective upon annexation and placing approximately 130 acres in PF District, as the same is described and defined in the Zoning Ordinance of the City of Gilroy, the following described premises: All that property located in the County of Santa Clara, State of California, described as follows:' That 130 acres,more or less, adjoining the City of Gilroy east of the Southern Pacific Railroad tracks, south of Southside Drive and west of the Gilroy Sewer Treatment Plant, and shown as parcel no. 841-30-10 in the Sant~ Clara County Tax Assessor's Map Book. Section 2: The official map constituting a part of the Zoning Ordinance of the City of Gilroy shall be amended to reflect the foregoing changes of classification of the said property. Section 3: All ordinances and parts of ordinances in conflict herewith are hereby repealed. ORDINANCE NO. 83 '22 -2- SectiOn 4; This ordinance shall take effect and be in full force thirty (30) days from and after its passage and approval, and upon annexation of said property to the City of Gilroy.
