Ordinance 1985-16 ORDINANCE NO. 85-16
AN ORDINANCE OF THE CITY OF GILROY AMENDING
SECTION 22.30 OF THE ZONING ORDINANCE TO ALLOW
ADDITIONAL CONDITIONAL USES IN THE M2 (GENERAL
INDUSTRIAL) ZONING DISTRICTS THAT HAVE ADOPTED
SPECIFIC PLANS.
WHEREAS, the Planning Commission of the City of
Gilroy has given due notice of a public hearing upon the
proposed Amendment in accordance with the Zoning Ordinance
of the City of Gilroy, has held the hearing, has approved
a prior Environmental Imp ~t Report under California
Environmental Quality Act, and has made its report to the
Council of the City of Gilroy, in which it recommends that
Section 22.30 of the Zoning Ordinance be amended as specified
herein, and
WHEREAS, the Council of the City of Gilroy fixed the
15th day of July 1985, at the hour of 8:00 p.m. in the
Council Chambers in the City Hall at 7351 Rosanna Street,
Gilroy, California, as the time and place for hearing the said
report and recommendation on the proposed amendment, and due
notice of the said hearing has been given in accordance with
the said Zoning Ordinance, and the public hearing has been
continued to the 16th day of September and has been held upon
the said application before the Council, and the Council having
duly considered the proposed amendment and the evidence presented
has approved the prior Environmental Impact Report under the
"California Environmental Quality Act and has determined that
the following section of the Zoning Ordinance should be amended
in accordance with the report of the said Planning Commission.

NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY
DOES ORDAIN AS FOLLOWS:
Section 1: Section 22.30 of the Zoning Ordinance is
hereby amended by adding the following:

2- In addition to the uses listed as permitted or conditionally
permitted in the M2 district, the following uses may be
conditionally permitted only where the Planning Commission
finds that a) these uses will not generate vehicular trips
across U.S. 101 (South Valley Freeway) above that for
general industrial uses, and b) that the proposed commercial
uses will provide service only to people employed within
the adjacent industrial areas: professional office, financial
institutions, insurance companies, real estate brokers,
social service agencies, cocktail lounges, private educational
and recreational institutions, entertainment facilities and
day care facilities.
Section 2: Ail ordinances and parts of ordinances in
conflict herewith are hereby repealed.
Section 3: This ordinance shall take effect and be in
full force thirty (30) days from and after its passage and
approval.
PASSED AND ADOPTED this 30th day of September 1985, by
the following vote:
