ORDINANCE OF THE CITY OF GILROYAMENDING THE ZONING
ORDINANCE OF SAID CITY BY PREZONING APPROXIMATELY 25.48
ACRES ADJOINING THE CITY OF GILROY, ALONG THE EAST SIDE
OF MILLER SLOUGH SOUTH OF PACHECO PASS HIGHWAY AS M2
(GENERAL INDUSTRIAL) DISTRICT
WHEREAS, GILROY FOODS, INC. has heretofore filed with the
Planning Cormnission of the City of Gilroy a petition in due form
requesting the prezoning of approximately 25.48 acres as M2
(General Industrial) District; and
WHEREAS, the Planning Commission of the City of G±lroy has
given due notice of a public hearing upon the said application,
in accordance with the Zoning Ordinance of the City of Gilroy,
has held the hearing, has approved a prior Environmental Impact
Report and a statement of overriding considerations under the
California Environmental Quality Act, and has made its report to
the Council of the City of Gilroy, in which it recommends that
the 25.48 acres hereinafter described be prezoned as set forth
above; and
WHEREAS, the Council of the City of Gilroy has fixed the
18th day of July 1988, at the hour of 8 p,m. in the Council
Chambers in the City Hall at 7351 Rosanna Street, Gilroy, California,
as the time and place for hearing the said report and recommendation
upon the said application, and notice of the said hearing has been
given in accordance with the said Zoning Ordinance, and a public
hearing has now been held upon the said application before the
Council, and the Council having duly considered the said application
and the evidence presented, has approved the Environmental Impact
Report and the statement overriding considerations under the
California Environmental Quality Act, and has determined that the
said Zoning Ordinance should be amended in accordance with the report
of the said Planning Commission.
ORDINANCE NO. 88-9
NOW, THEREFORE, THE COUNCIL OF THE CITY OF GILROY DOES
ORDAIN AS FOLLOWS:
Section 1: The Zoning Ordinance of the City of Gilroy is
hereby amended by prezoning to become effective upon annexation
and placing approximately 25.48 acres in M2 District, as the
same is described and defined in the Zoning Ordinance of the
City of Gilroy, the following described premises:
Ail that property located in the County of
Santa Clara, State of California, described
as follows:
That 25.48 acres, more or less, adjoining the
City of Gilroy along the east side of Miller
Slough south of Pacheco PaSs Highway shown as
parcel No. 841-17-13 in the Santa Clara County
Tax Assessor's Map Book to be prezoned M2.
Section 2: The official map constituting a part of the
Zoning Ordinance of the City of Gilroy shall be amended to re-
flect the foregoing changes of classification of the said prop-
erty.
Section 3: Ail ordinances and parts of ordinances in con-
flict herewith are hereby repealed.
Sect~ion 4: This ordinance shall take effect and be in full
force thirty (30) days from and after its passage and approval.
