AN ORDINANCE OF THE CITY OF GILROY APPROVING
Z 92-05 TO AMEND SECTION 11.30 OF THE CITY
ZONING ORDINANCE REGARDING HEIGHT LIMITATIONS
IN THE R-2 DISTRICT
WHEREAS, the Planning Commission of the City of Gilroy,
on December 3, 1992, and the City Council of Gilroy, on
December 21, 1992, held duly noticed public hearings to consider
Z 92-05, a City-initiated proposal to amend the text of Section
11.30 of the Zoning Ordinance of the City of Gilroy regarding
height limitations in the R-2 District; and
WHEREAS, the Planning Commission, based upon testimony
and other evidence in the record, recommended that a proposed
revision to Section 11.30, increasing the maximum height allowable
in the R-2 District to 35 feet, be adopted by the City Council;
and
WHEREAS, approval of this project would be categorically
exempt from the requirements of the California Environmental
Quality Act ("CEQA") as a minor alteration in land use limitations.
Now, therefore,
THE CITY COUNCIL OF THE CITY OF GILROY DOES HEREBY ORDAIN
AS FOLLOWS:
SECTION I
The City Council finds that Z 92-05 is exempt from CEQA,
and the City has properly taken all actions required by CEQA; and
SECTION II
Section 11.30 of the Zoning Ordinance of the city of
Gilroy is hereby amended to increase the maximum height allowable
in the R-2 District to 35 feet. Maximum height requirements in
residential districts are set forth in the Table found in
Section 11.30, and such amendment to the Table is as reflected in
Exhibit A, attached hereto and made a part hereof. Aside from this
amendment, Section 11.30 shall remain unchanged.

SECTION III
This ordinance shall be in full force and effect thirty
(30) days from and after the date of its final adoption and
approval.
