AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GILROY APPROVING REZONING APPLICATION
Z 93-04, REZONING FROM HC (HIGHWAY COMMERCIAL)
AND M2 (GENERAL INDUSTRIAL) TO C3-PUD
(PLANNED UNIT DEVELOPMENT-SHOPPING CENTER
COMMERCIAL), ON APPROXIMATELY 30.83 ACRES OF
LAND LOCATED AT THE SOUTHEAST CORNER OF
HIGHWAY 101AND PACHECO PASS HIGHWAY, APN 847-
67-020.
WHEREAS, South County Development has submitted applica-
tion Z 93-04, to amend the zoning map of the City of Gilroy to
rezone from HC (Highway ~ommercial) and M2 (General Industrial)
to C3-PUD (Planned Unit Development-Shopping Center Commercial) on
approximately 30.83 acres located at the southeast corner of
Highway 101 and Pacheco Pass Highway, APN 847-67-020, as such land
is shown on the map attached hereto as Exhibit A and incorporated
herein by this reference; and,
WHEREAS, the City prepared and circulated and subse-
quently duly certified an environmental impact report ("EIR") on
June 1, 1992, all in accordance with the California Environmental
Quality Act ("CEQA"), for a project which encompassed this applica-
tion; and
WHEREAS, on June 1, 1992, the City Council also made
findings required by CEQA and duly adopted a mitigation monitoring
program for the project; and,
WHEREAS, the Planning Commission held a duly noticed
public hearing on Z 93-04 on July 1, 1993, and the adopted Resolu-
tion No. 93-23, recommending that the City Council approve Z 93-04;
and,
WHEREAS, the City Council held a duly noticed public
hearing on Z 93-04 on July 19, 1993;
THE CITY COUNCIL OF THE CITY OF GILROY HEREBY ORDAINS AS
FOLLOWS:
SECTION I
The City Council hereby finds as follows:

A. That the City has properly taken all actions
required by CEQA.
B. That this rezoning proposal is consistent with the
land use designations of the General Plan Map and with the intent
of the goals and policies of the General Plan text.
SECTION II
The zoning map of the City of Gilroy should be and hereby
is amended to rezone from HC (Highway Commercial) and M2 (General
Commercial) to C3-PUD (Planned Unit Development-Shopping Center
Commercial) approximately 30.83 acres located at the southeast
corner of Highway 101 and Pacheco Pass Highway, APN 847-67-020, as
such land is shown in Exhibit A, and rezoning application Z 93-04
is approved, subject to the mitigation measures set forth in the
EIR and the mitigation monitoring program adopted for the project
on June 1, 1992.
SECTION III
This ordinance shall take effect and be in full force
thirty (30) days from and after its adoption and approval.

1993 by the following vote:
AYES: COUNCILMEMBERS: GILROY, HALE, KLOECKER, NELSON,
ROWLISON, VALDEZ and GAGE.
