Ordinance 1993-18ORDINANCE NO. 93- 18 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING REZONING APPLICATION Z 93-05, REZONING FROM A1 (AGRICULTURAL) AND R1 (SINGLE FAMILY RESIDENTIAL) TO R3 (MEDIUM DENSITY RESIDENTIAL), ON APPROXIMATELY 3.74 ACRES OF LAND LOCATED AT THE NORTHWEST CORNER OF CHURCH STREET AND LIMAN AVENUE, APN 790-16-014 AND A PORTION OF -049. WHEREAS, Edith Huang has submitted application Z 93-05, to amend the zoning map of the City of Gilroy to rezone from A1 (Agricultural) and RI (Single Family Residential) to R3 (Medium Density Residential), on approximately 3.74 acres of land located at the Northwest corner of Church Street and Liman Avenue, APN 790- 16-014 and a portion of -049, as such land is shown on the map attached hereto as Exhibit A and incorporated herein by this reference; and, WHEREAS, the City prepared, circulated and certified a negative declaration for a project which encompassed this application, which set forth mitigation measures, and adopted a mitigation monitoring program in accordance with the California Environmental Quality Act ("CEQA"); and WHEREAS, the Planning Commission held a duly noticed public hearing on Z 93-05 on August 5, 1993, at which hearing it adopted Resolution No. 93-25, recommending that the City Council approve Z 93-05; and, WHEREAS, the City Council held a duly noticed public hearing on Z 93-05 on August 16, 1993. THE CITY COUNCIL OF THE CITY OF GILROY HEREBY ORDAINS AS FOLLOWS: SECTION I The City has properly taken all actions required by CEQA. ORDINANCE NO. 93 - 18 -1- SECTION II This rezoning proposal is consistent with the land use designations of the General Plan Map and with the intent of the goals and policies of the General Plan text. SECTION III The zoning map of the City of Gilroy should be and hereby is amended to rezone from A1 (Agricultural) and Ri (Single Family Residential) to R3 (Medium Density Residential), on approximately 3.74 acres of land located at the Northwest corner of Church Street and Liman Avenue, APN 790-16-014 and a portion of -049, as such land is shown on Exhibit A. SECTION IV This ordinance shall take effect and be in full force thirty (30) days from and after its adoption and approval. PASSED AND ADOPTED this 7th day of Sept. 1993 by the following vote: AYES: COUNCILMEMBERS: GILROY, HALE, KLOECKER, NELSON, RO~ISON, VALDEZ and GAGE.
