Ordinance 1994-04ORDINANCE NO. 94 -4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING CITY - INITIATED REZONING Z 94 -02, REZONING FROM C1 -HS (NEIGHBORHOOD COMMERCIAL - HISTORIC SITE) AND R2 -HS (TWO FAMILY RESIDENTIAL - HISTORIC SITE) TO PF -HS (PARK/ PUBLIC FACILITIES - HISTORIC SITE), ON APPROXIMATELY 1.35 ACRES OF LAND ON FIVE PARCELS LOCATED NEAR THE INTERSECTION OF CHURCH AND FIFTH STREETS, APN'S 799- 07 -23, 799- 06 -31, 799- 07 -82, 799 -07 -01 AND 799 -07- 02. WHEREAS, the City of Gilroy has initiated rezoning Z 94 -02 to amend the zoning map of the City of Gilroy to rezone from C1 -HS (Neighborhood Commercial - Historic Site) and R2 -HS (Two Family Residential - Historic Site) to PF -HS (Park / Public Facilities - Historic Site) approximately 1.35 acres of land on five parcels located near the intersection of Church and Fifth streets, APN'S 799- 07 -23, 799- 06 -31, 799- 07 -82, 799 -07 -01 AND 799- 07 -02, as such land is shown on the map attached hereto as Exhibit A and incorporated herein by this reference; and, WHEREAS, approval of this project is categorically exempt from the environmental review requirements of the California Environmental Quality Act ( "CEQA "), Public Resources Code Section 21000 et seq., as a Minor Alteration in Land Use Limitations within the meaning of CEQA Guidelines Section 15305; and, WHEREAS, in conjunction with this rezoning this City Council approved on March 21, 1994 GPA 94 -01, which amended the General Plan Map designation for the properties affected from Local Commercial and Low Density Residential to the Park / Public Facility designation; and, WHEREAS, the Planning Commission held a duly noticed public hearing on Z 94 -02 on March 21, 1994 and subsequently voted to recommend that the City Council approve Z 94 -02; and, WHEREAS, the City Council held a duly noticed public hearing on Z 94 -02 on March 21, 1994. ORDINANCE NO. 94 - 4 -1- FOLLOWS: • • THE CITY COUNCIL OF THE CITY OF GILROY HEREBY ORDAINS AS SECTION I The City Council hereby finds as follows: A. That this project is categorically exempt from CEQA. B. That this rezoning proposal is consistent with the land use designations of the General Plan Map and with the intent of the goals and policies of the General Plan text. SECTION II The zoning map of the City of Gilroy should be and hereby is amended to rezone from Cl- HS (Neighborhood Commercial - Historic Site) and R2 -HS (Two Family Residential - Historic Site) to PF -HS (Park/ Public Facilities - Historic Site) approximately 1.35 acres of land on five parcels located near the intersection of Church and Fifth streets, APN'S 799- 07 -23, 799- 06 -31, 799 -07- 82, 799 -07 -01 AND 799- 07 -02, as such land is shown in Exhibit A. SECTION III This ordinance shall take effect and be in full force thirty (30) days from and after its adoption and approval.
