ORDINANCE NO. 96 -2
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GILROY AMENDING FOR CLARIFICATION GILROY
CITY CODE SECTION 15.67 TO FACILITATE THE
ABATEMENT OF ABANDONED VEHICLES
WHEREAS, the Gilroy Police Department has been involved
in a county -wide effort to establish a service authority for the
removal and abatement of abandoned vehicles; and
WHEREAS, state law authorizes that funding for a service
authority for the removal and abatement of abandoned vehicles may
be provided by a fee imposed in addition to vehicle registrations;
and
WHEREAS, Gilroy City Code section 15.72 prohibits the
parking of any vehicle upon a street or alley for more than
seventy -two (72) hours and directs that the Gilroy Police Depart-
ment may have such vehicle removed; and
WHEREAS, the City finds that vehicles which are parked
or left standing upon a street or alley in excess of seventy -two
(72) hours may be considered "abandoned" and thereafter removed
under its City Code with the benefit of service authority monies
without conferring any additional powers to the Gilroy Police
Department or otherwise changing the manner in which the Police
Department operates;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION I
The first sentence of the second paragraph of Gilroy City
Code Section 15.67 is amended to read as follows:
"In the event a vehicle is parked or left standing upon a
street in excess of seventy -two (72) consecutive hours, it may
be considered abandoned and any member of the police depart-
ment authorized by the chief of police may remove such vehicle
from the street in the manner and subject to the requirements

of the California Vehicle Code."
This ordinance shall take effect and be in full force
thirty days from and after its adoption and approval.

following vote:
