AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GILROY AMENDING THE TEXT OF ZONING
ORDINANCE RESIDENTIAL DEVELOPMENT SECTION
50.62 (B) (3) AND (4), Z 96-11
WHEREAS, there is growing community concern that
affordable housing is being developed with undue concentrations in
the east and north central portions of the City; and
WHEREAS, City residents have expressed concern that
requests for Residential Development Ordinance (RDO) exemptions
have not been subject to public notice and public hearings; and
WHEREAS, the Planning Commission at their December 5,
1996 meeting recommended amending the RDO Section 50.62 (b) (3) and
(4); and
WHEREAS, the proposed amendments are in conformance with
the General Plan Housing Element Policy A and are consistent with
the intent of the text of the General Plan Document; and
WHEREAS, the proposed amendments will not be detrimental
to the public welfare or injurious to persons or property in the
City; and
WHEREAS, there will be no significant environmental
impacts as a result of the proposed amendments; and
WHEREAS, the California Environmental Quality Act (CEQA)
provides a categorical exemption which applies to this amendment:
CEQA Guideline Section 15305 - Class 5, entitled "Minor Alterations
in Land Use Limitations."
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION I
Zoning Ordinance Residential Development Section
50.62(b) (3) shall be amended by adding a new last paragraph which
shall read in its entirety as follows:

Ail requests for an exemption under this
subsection shall be processed through an RDO
Affordable Housing Exemption Application.
Public hearings before the Planning
Commission and City Council shall be held to
consider this application.
SECTION II
Zoning Ordinance Residential Development Section
50.62(b) (4) shall be amended by adding a new last paragraph which
shall read in its entirety as follows:
Ail requests for an exemption under this
subsection shall be processed through an RDO
Affordable Housing Exemption Application.
Public hearings before the Planning
Commission and City Council shall be held to
consider this application.
This ordinance shall take effect and be in full force
thirty days from and after its adoption and approval.
