AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GILROY AMENDING THE ANIMAL CONTROL
ORDINANCE
WHEREAS, the City Code establishes that breach of
quarantine conditions is an infraction (Section 4.14(d)), but
California Health and Safety Code Section 1924 specifies the
breach of quarantine conditions shall be a misdemeanor; and
WHEREAS, it is the intention of the City Council that
the City Code be consistent with State law so that breaches of
quarantine are declared to be misdemeanors; and
WHEREAS, it is the further intention of the City
Council to broaden the City Animal Control Ordinance to expand the
category of animals restricted in zones not agriculturally zoned
(Section 4.20 (a)) to regulate waterfowl and thus preserve and
maintain the public's health, safety and welfare.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GILROY
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION I
Section 4.14. (d) of the Gilroy Municipal
amended to read in its entirety as follows:
Code shall be
(d) Any person who fails, refuses or neglects to quarantine
any animal as ordered by the animal control officer, or who

refuses to allow the animal control officer to inspect any private
premises where the animal is kept, is guilty of a misdemeanor. No
animal shall be removed or released during the quarantine period
without permission of the health officer.

(a) It is unlawful for any person to keep,

~Ratitae", or livestock on any premises within the City that have
not been zoned for agricultural use. The term swine as used
herein does not include pot-bellied pigs harbored in strict
accordance with restrictions related to noise or sanitation as
provided in this Chapter.
SECTION III
This ordinance shall take effect and be in
thirty days from and after its adoption and approval.
