AN ORDINANCE OF THE CITY OF GILROY AMENDING CHAPTER 7, SECTION
7.4, OF THE GILROY CITY CODE, ESTABLISHING A SCHEDULE OF FEES AND
SERVICE CHARGES
WHEREAS, the City of Gilroy ("City") staff performs an array of functions relating to
regulation, products and services provided by the City, and the City has incorporated into the
Gilroy City Code ("Code") Chapter 7, entitled "Cost Comparison System for Fee and Service
Charge Revenue," to provide for reimbursement of the City's costs in relation to the regulation,
products and services; and
WHEREAS, Section 7.2 of the Code authorizes the City Administrator to adjust fees and
charges to recover percentages of "costs reasonably borne" as that term is defined in Section 7.3
of the Code, in providing the regulations, products or services specified in that Chapter; and
WHEREAS, Section 7.4 of the Code specifies the types and cost percentages of
regulation, products and services that are reimbursable; and
WHEREAS, the City seeks to update Section 7.4 to provide for reimbursement of
additional services rendered by the City and to specify whether the regulation, product or service
is reimbursed on an hourly or fee basis.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
GILROY DOES HEREBY ORDA1N AS FOLLOWS:
SECTION I
Sections 7.4 of the Gilroy City Code, establishing a schedule of fees and charges for
regulation, products and services provided by the City is h~reby amended to read:
The City Administrator, and each City department head,
under the direction of the City Administrator, shall no less
frequently than annually review the schedule of fees and service
charges. The City Administrator thereafter shall provide to the

City Council for consideration an adjusted fee or charge schedule
that provides for recovery of the listed percentage of costs
reasonably borne to provide the following regulation, product or
service:

ORDINANCE NO. 2000-17
SECTION II
If any section, subsection, subdivision, sentence, clause, phrase or word of this
ordinance is for any reason held to be invalid or unconstitutional by a court of competent
jurisdiction, such decision shall not effect the validity of the remaining portions of this
ordinance. The City Council of the City of Gilroy hereby declares that it would have passed and
adopted this ordinance, and each and all provisions hereof, irrespective of the fact that one or
more provisions may be declared invalid or unconstitutional.
SECTION III
This Ordinance shall be in full force and effect thirty (30) days after the date of its
passage and adoption.
