Minutes 1929/05/22 408 Gilroy, California. May 22, 1929. The regular adjourned meeting of the Commpn Council of May 13th, 1929, was called to order by His Honor Mayor Jas. Prince- valle. Present, Councilmen, Walter G. Fitzgerald, E. Martin John- son, C. E. Fredrickson, John A. Clark, Irvin HOllister, Elmer J. Chesbro. Specifications for both white and black face paving were presented by City Engineer, Ray W. Fisher. Motion by E. Martin Johnson, seconded by Elmer J. Chesbro, that Resolution No. 4-1929, be adopted as follows: RESOLUTION NO. 4-1929 ADOPTING PLANS AND SPECIFICATIONS RESOLVED, by the Mayor and Common Council of the City of Gilroy, that the plans and specifications be, and they are here- by approved and adopted, for the following work to be done md improvement to be made in the City of G~lroy, to-wit: That Eig1eberry Street from the South line of Seventh Street to the South line of Sixth Street and from the North line of Second Street to the South line of First Street; also, That Sixth Street from the Easterly line of Railroad Al- ley to a point two feet West of the most Westerly rail of the S. P. R. R. Tracks and from a point two feet East of the most Easterly rail of the S. P. R. R. Tracks to the Westerly line , of Forest Street and from the Easterly line of Church Street to the Westerly line of Eigleberry Street; also, That the Alley lying between Monterey Street and Eigle- berry Street from the North line of Sixth Street to the South line of Fifth Street, and from the North line of Fifth Street to the South Line of Fourth street; also, /"1 n,;.'l ~..; -~ ':LJ --,,_U._ That Martin street from the westerly line of Railroad Alley to a point two feet West of the most westerly rail of the S. P. R. R. Tracks and from a point two feet East of the most Easterly rail of the S. P. R. R. Tracks to the Westerly line of Forest street; also, That Second Street from the easterly line of Church Street to the Westerly line of Eigleberry Street; also, That Third street from the Easterly line of Church Street to the westerly line of Eigleberry Street and from the Easter- ly line of Eigleberry street to the westerly line of Monterey Street; also, That Fourth Street from the Easterly line of Church Street to the Westerly line of Eigleberry Street; That the roadways of all of the portions of said streets, avenues and lanes as above described be improved by grading, constructing and laying thereon a Portland cement concrete pave- ment in accord with their respective grades and in the manner indicated by the plans and specifications hereinafter referred to; Also, for Portland cement concrete curbs, gutters and side- walks, where they do not now exist, at places shown on plans, along the above mentioned streets; Excepting, however', from the above described work such portion or portions of the concrete curbs, concrete gutters, concrete sidewalks and pavement above described as are already constructed to the line and grade hereinafter referred to; and excepting also from the above described work any and all portions thereof which are described more than once or repeated because of descriptions recrossing streets at intersections, it being the intention to describe only one improvement at such street crossing. All of said work to be done to the grade described in and in accordance with the plans, profiles and specifications pre- pared by R. W. Fisher, City Surveyor and Engineer, and Submit- ted by said Engineer on the 22nd day of May, 1929, and said plans, profiles and specifications be and the same are hereby adopted as and for the plans and specifications for doing said work, and are hereby referred to for further particulars. 410 ;,< Vote: Ayes, Councilmen E. Fisher, City Engineer of the City of Gilroy, did, on the 22nd day of May, 1929, file with the Cith Clerk, a map or diagram showing the boundary lines of the District which is to be benefitted by the improvements set forth in the plans and specifications adopted by the Mayor and Common Council by resolution on the 22nd day of May, 1929, reference to said Map or diagram being hereby adopted as the boundary lines and de- scription of said Improvement District to be and the same is her:o.eby designated as "Improvement District No. Three," and the District to be benefitted by said proposed improvements. RESOLVED, by the Mayor and Common Council of the City of Gilroy, that it is the intention of the Mayor and Common Coun- cil to order the following work and improvement in said City of Gilroy, to-wit: That Eigleberry street from the south line of Seventh Street to the South line of Sixth Street and from. the North line of Sec- one Street to the South line of First Street; also, That Sixth Street from the Easterly line of Railroad Alley to a point two feet West of the most Westerly rail of the S. "'""''''"l And the said Mayor and Cornmon Council does hereby determine and declare that the aforesaid work and improvement is of more than local or ordinary publis benefit and will affect and bene - fit the district, the boundary lines and description of which is shown upon a map or diagram of said District, prepared by R. W. Fisher, City Engineer, approved by the Mayor and Cornmon Council and on file in the office of the City Clerk, which said map or diagram is hereby referred to and made a part hereof, and is here- by declared to be the District benefitted by such work and improve- ment, and that, therefore, the entire cost and expenses of said work and improvement shall be and is hereby made chargeable against and shall be assessed upon said District, hereafter to be known as Improvement District Number Three, which District is situated within the City of Gilroy, County of Santa Clara, state of Cali- fornia. Excepting, however, from the said area as shown upon the map or diagram thereof as adopted by the Mayor and Common Coun- cil, of all public streets, lanes and public ways, the same not to be assessed for any expenses of said work and improvement. Notice is hereby given that serial bonds to represent un- paid assessments and bear interest at the rate of seven percent. per annum, will be issued hereunder, in the manner provided by the Improvement Bond Act of 1915, and amendments thereto, the last installment of which bonds shall mature ten (lO) years from the 2nd day of July next succeeding ten (10) months from their date. Except as hereinabove otherwise provided for, the issuance of said serial bonds, all of the herein proposed work shall be done in pursuance of an Act of the Legislature of the state of California, designated "The Improvement Act of 1911" approved April 7th, 1911, and amendments thereto. NOTICE IS HEREBY GIVEN, That on the lath day of June, 1929, at eight o'clock P. M. at the regular meeting place of the May- or and Common Council, to-wit: In the City Hall of said City, and and all persons having any objections to the proposed work and improvement may appear before said Mayor and Cornmon Council d'fr) _-". The Clerk of the City of Gilroy shall cause this resolution to be published twice in the "Gilroy Evening Dispatchll a daily newspaper, printed published and circulated in said City of Gilroy, and hereby designated for that purpose, by said Mayor and Common Council of said City of Gilroy. The street Commissimer of said City of Gilroy shall cause to be conspicuously posted along the lines of said contemplated work or improvement and along the lines of all open streets, avenues, lanes, alleys and roads within said District, as here- in adopted and described, notices of the passage of this Reso- lution of Intention in the manner and form required by law.
