Minutes 1929/07/01 431 Gilroy, California. July 1st, 1929. The regular monthly meeting of the Common Council was called to order by His Honor Mayor Jas. Princevalle. Present Councilmen Walter G. Fitzgerald, E. Martin John- son, C. E. Fredrickson, Irvin Hollister, Elmer J. Chesbro; Absent Councilman John A. Clark. The minutes of meetings of June 3rd, June lOth and June 17th, 1929, were read and ordered approved. Monthly reports of License and Tax Collector, POlice Judge, City Clerk, Water Gollector and Milk Inspector, quarterly reports of Treasurer and Clerk, and yearly report of Librarian were read, and on motion of Fredrickson, seconded by Chesbro, the same were ordered accepted and placed on file. C:ouncilman Fitzgerald reported back in reference to bids for alterations at Fire House. Motion by Johnson, seconded by Fredrickson and carried, that bid for work on ~ity Hall office be awarded to John Rik- sheim and that check be returned to Wm. Radtke. Motion by Fitzgerald, seconded by Johns.on and carried, that bids be opened for alterations at Fire House. Two bids were presented--Wm. Radtke in the sum of $5807.00 and John Riksheim $5257.00, each with minor amounts for additions and deductions. RESOLUTION NO. 22-1929 RESCINDING RESOLUTIONS NOS. 6-1929, 9-1929, 14-1929, 15-1929, 16-1929, 17-1929, 18-1929, 19-1929, 20-1929 and 21-1929. WHEREAS, an error was made in the notices posted for receiv- ing and hearing protests as provided for in Resolutions of In- tentions No. 6-1929 and No. 9-1929, that may invalidate the pro- ceedings, and as new Resolutions of Intention must be adopted, therefore, be it, RESOLVED, That Resolutions Nos. 6-1929, 9-1929, 14-1929, 15-1929, 16-1929, 17-1929, 18-1929, 19-1929, 20-1929 and 21- 1929, be, and the same are hereby rescinded. RESOLUTION OF INTENTION NO. 23-1929 RESOLVED, By the Mayor and Gommon Council of the City ot Gilroy, that it is the intention of the Mayor and Common Council to order the following work and improvement in said City of Gil- roy, to-wit: That Eigleberry Street from the south line of Seventh Street to the south line of Sixth Street and from the north line of Sec- ond Street to the south line of First Street; also, That Sixth Street from the easterly line of Railroad Alley to a point two feet west of \he most westerly rail of the S. P. R. R. Tracks and trom a point two feet east of the most easter- ly rail of the S. P. R. R. Tracks to the westerly line of Forest Street and from the easterly line of Church Street to the westerly line of Eigleberry Street; also, That the alley lying between Monterey Street and Eigleberry Street from the north line of Sixth Street to the south line of 433 Fifth Street, and from the north line of Fifth Street to the south line of Fourth Street; also, That Martin Street from the westerly line of Railroad Alley to a point two feet west of the most westerly rail of the S. P. R. R. Tracks and from a point two feet east of the most easterly rail of the S. P. R. R. Tracks to the westerly line of Forest Street; also, That Second Street from the easterly line of Church Street to the westerly line of Eigleberry Street; also, That Third Street from the easterly line of Church Street to the westerly line of Eigleberry street and from the easterly line of Eigleberry street to the westerly line of Monterey Street; also, That Fourth Street from the easterly line of Church street to the westerly line of Eigleberry Street; That the roadways of all of the portions of said streets, avenues and lanes as above described, and all intersections thereon, be improved by grading and constructing and laying thereon a Portland cement concrete pavement, in accord with their respective grades and in the manner indicated by the plans and specifications hereinafter referred to; Also, for Portland cement concrete curbs, gutters and side- walks, where they do not now exist at places shown on plans, along the above mentioned streets; Excepting, however, from the aoove described work such por- tion or portions of the concrete curbs, concrete gutters, con- crete sidewalks and pavement above described as are already constructed to the line and grade hereinaf_er referred to; and excepting also from the above described work any and all por- tions thereof which are described more than once or repeated because of descriptions recrossing streets at intersections, it being the intention to describe only one improvement at such street crossing. That all said work be done according to plans, prOfiles and specifications therefor, prepared by R W. Fisher, aity Engineer of the City of G~lroy, dulyand regularly adopted by the Mayor and Common Gouncil on May 22nd, 1929, and now on file in the office of the city Clerk of said Oity, and according to the e1e- vations and lines and grades as shown on said plans, which said 434 plans, profiles and specifications are hereby referred to for the full and detailed descriptions of said proposed work and improve- ,-~ x - v '.. - ~ ments. And the said Mayor and Cornmon Council does hereby determine and declare that the aforesaid work and improvement is of mOre than local or ordinary public benefit and will affect and benefit the district, the boundary lines and descriptions of which is shown upon a map or diagram of said district, prepared by R. W. .-'. Fisher, City Engineer, approved by the Mayor and Common Council and on file in the office of the City Clerk, which said map or diagram is hereby referred to and made a part hereof, and is here- by declared to be the District benefitted by such_work and improve- ment, and that, therefore, the entire cost and expenses of said work and improvement shall be and is hereby made chargeable against and shall be assessed upon said district, hereafter to be known as Improvement District Number Three, which district is situated with- in the city of G41roy, Oounty of Santa Clara, state of California. Excepting, however, from the said area as shown upon the map or diagram thereof as adopted by the Mayor and Common Council, of all public streets, lanes and public ways, the same not to be as- sessed for any expenses of said work and improvement. Notice is heneby given that serial bonds to represent unpaid assessments and bear interest at the rate of seven percent. per an- num, will be issued hereunder, in the manner provided by the Improve- ment Act of 1915, and amendments thereto, the last installment of which bonds shall mature ten (10) years from the 2nd day of July next succeeding ten (10) months from their date. Except as hereinabove otherwise provided for, the issuance of said serial bonds, all of the herein proposed work shall be done in pursuance of an Act of the Legislature of the State of California designated ItThe Improvement Act of 19111t approved April 7, 1911, and amendments thereto. !IiN';. M. at the regular meeting place of the Mayor and Common Council, to-wit: In the City Hall of said City, any and all persons having any objections to the proposed work and improvement may appear before said Mayor and Cornmon Council and show cause why said proposed improvement should not be carried out in accordance 435 with this resolution. The Clerk of the City of Gilroy shall cause this resolu- tion to be published twice in the "Gilroy Evening Dispatch", a daily newspaper printed, published and circulated in said ~ City of Gilroy, and hereby dem gnated for that purpose by said ~ Mayor and Common Coune il of said ai ty of Gilroy. Clark. Motion by Charles E. Fredrickson, seconded by Irvin Hollister, that Resolution No. 24-1929 be passed and adopted: RESOLUTION OF INTENTION NO. 24-1929. RESOLVED, by the Mayor and Common Council of the City of Gilroy, that it is the intention of the Mayor and Common Council to order the following work and improvement in said City of Gll- roy ,to-wit: That Church Street from the southerly line of Sixth Street to the southerly line of First Street; also, .
