The regular monthly meeting of the Common Council is oalled
to order by His Honor Mayor S.D.Heak.
Present:Counci~en: George C.Milias,Jr.,Jack Roger8~ames

Absent:Councilmen: None.
Minutes of the meetings of ~anuary 3rd and 4th,i~39 are
read and approved.
Mr.Walter Rupar reppesenting the California Federated
Institute,Inc. appears before the Council on behalf of a res-
olution to limit the number of liquor licenses according to
population.
The Clerk reads the proposed resolution.

PETITION

WHEREAS, this Common Council of the City of Gilroy, County
of Santa Clara, State of California, is informed that there is
no power or authority under the existing Alcoholic Beverage Con-
trol Act to limit the number of on and off sale licenses for the
l: sale of alcoholic beverages, and
WIlliREAS, This Common Council believes it to be to the best
interest of the State of California and of the City of Gilroy,
that the number of on and off sale licenses for the sale of al-
coholic beverages be limited and restricted in accordance with
public good and the best interests of the community; now, there-
for e , be it
RESOLVED, that the Common Council of the said City of Gilroy
does hereby petition the Legislature of the State of Cal~ornia
which convened in January, 1939, to amend the Alcoholic Beverage
Control Act in such a way as to limit the number of on and off
sale licenses for the sale of alcoholic beverages to be granted
r- in the City of Gilroy and throughout the State of California.

Motion by Councilman Rogers,seconded by Councilman Milias and
carried unanimously that the petition of the California Federated
Institute,Inc. be adopted.

A communication is read from Logan & Frazer,city auditors,stating
they have examined the city.bOokso:for the quarter ending December
3l,1938,and found everything in order.
A communication is read frOIIl Chas.R.Avis,nresident of the
Safety Council requesting two members of the Comnon Council be
appointed to attend a meeting of the COlfncil on February 9th.
The Mayor appoints Councilmen Battersby and Mason to attend the
meeting.

Motion by Councilman Milias,seconded by Councilman Heiner and
carried unanimously that the City of Gilroy join the League of
California Municipalities fo r the year l~39
A petition from property owners residing on North Chestnut Street
requesting improvement of Chesnut Street to the end that sidewalks
may be built,is read. This matter is referred to the City Engineer
for investigation and report.

Mayor states the matter will be investigated.

Motion by Councilman Milias,seconded by Councilman Rogers and
carried unanimously that the reportsof the city officers be accepted
as read and placed on file.
Motion by Councilman Rogers,seconded by Councilman Heiner and
carried unanimously that that the City purchase an automobile for
use of the Police Department.
It is recommended and accepted that the Police Committee investigate
the type of car necessary and report their findings to the Council.
Mr.Sydney S.Johnson appears before the Council to request that the
residences' on the South side of Tenth Street be furnished city water

at the same rates as other residences in the city, instead of the;~c
calln~rt rate.
This matter is referred to the chairman of the Water Committee for
investmgat10n and report.
Motion by Councilman Martin,seconded by Councilman Heiner and ~
carried unanimously that bills as presented be allowed and warrants
ordered drawn on the Treasurer.
This being the time specified for opening bids for contract for
the disposal of g~rbage, eleven bids are presented and read: :J
