His Honor Mayor S.D. Heck being absent this regular monthly meeting
of the Common Council is called to order by the Clerk.
Present:Councilmen:George C.Milias,Jr.,Jack Rogers,James Battersby,
George A.Martin,George M.Mason,Nat.Heiner. Absent: Councilmen: None.

Motion by Councilman Martin,seconded by Councilman Rogers and
carried unanimously that Councilman Milias be appointed Mayor
pro-tem.
Minutes of the meetimgs of July 6th,l8th,2lst and 25th,1939 are
read and approved.
Motion by Councilman Heiner,seconded by Councilman Mason and
~arried unanimously yhat Logan and Frazer,American Trust Company
Building,San Jose,California,be given the contract to audit the
City's books for the year,July l,l939 to June 30,l940 under the
same terms and conditions as set forth in their letter dated
July 29,1939; namely $200.00 for the year payable $50.00 quarte rly
upon completion of a quarterly audit,report to be filed at the end
of the fiscal year.
Reports of the Gilroy Public Library,Health Department and City
officers are read.
~Jotion by Councilman Battersby,seconded by Councilman Rogers and
carried unanimously that the reports be accepted as read and pJa ced
on file.
Liquor license applications of Shirley Roth,23 South Monterey Street
and Tony Leal,49 South Monterey Street. are presented. No objection
is'made.
Mr. Elmer Weymouth,secretary of the Chamber of Commerce,appears
before the Council to discuss parking spaces in front of the Tourist
Motor Court,North Monterey street.
The Superintendent of Streets is instructed to mark off the curb
in red to a distance of ten feet on each side of the driveway into
the Tourist Motor Court.
The Superintendent of Streets is instructed to place a directional
sign for the I.O.O.F.Children's Home on the Monterey street sne of
the small park at the gore of Monterey Street and Martin Lane.
A request for a directional sign to the Gilroy Hot Springs to be
placed near the intersection of Leavesley Road and Monterey Street,is
discussed.
It is unanimously agreed that a committee of the Council will visit
the proposed site for the sign and establish, proper ,lo cation. that
the permit for said sign be revocable by the Council.
Councilman Rogers discusses the parking of trucks too close to the
intersection of Monterey Street and Leavesley Road. This matter is
to be checked by the night o~ficers.

Councilman Mason calls attention to overhangil~brancheso~ trees
obstructing stop signs at intersections. The Superintendent of Streets
is instructed to check these signs and remove Obstructing branches.
Councilman Heiner discusses the need for a building inspector.No
action is taken.

The City Engineer presents dra~ings for the proposed sewer connec*-
ion at First and Carmel Streets and realignment of First Street
at Hanna Street.

Mr.Sydney S.Johnson appears before the Council to request that he
be given the authority to bring suit,in the name of the City,against
George C.Renz for alleged violation of ordinances with respect to
the establishing of a storage yard at the. northeast corner of Ninth
and Church streets.

Motion by Councilman Mason,seconded by Councilman Heiner and
carried that the resolution presented to the Council by Mr.Sydney
S.Johnson,April l2,1937,be inserted in its proper place in the minutes
of April l2,193? and be given a number.
Mr.Elmer Weymouth,secretary of theChamber o~ Commerce,appears oofor6
the Council with a request from the Chamber of Commerce that the

nanes of streets on curbs be repainted. No action is taken.

Mr. Ed. Piedmont appears before the Council and offers to take care
of the garbage dump for the sum of $35.00 per month. This matter is
to be investigated by Councilmen Milias and Rogers.
Mr.Piedmont r~orts that Mr.Staub and Mr.Sam Newton are hauling
garbage.Mr.Piedmont asks if his garbage franchise requires him to
pay a city license. He is advised that no license fee is required.
Mr.Frank Perrelli of the Filice and Perrelli Canning Company appears
before the Council to request use of the garbage dump for pits and
cannery refuse in the event of an emergency. This matter is to be
investigated.
The matter of setting the tax rate for l~39-l940 is discussed and
by unanimous consent it is agreed to put this matter over until a

Mr.Ray Shields appears before the Council to invite the members
to view some motion pictures on fire protection at the Fire House,
August llth. Mayor pro-tem Milias accepts the invitation on behalf
of the Counc il.
Mot'ion by Councilman Martin,Seconded by Councilman Rogers and
carried that the bills as presented be allowed and warrants ordered
drawn on the Treasurer.
