Minutes 1950/12/04 · 1 ~12 Gilroy ,California December 4,1950 This regular monthly meeting of the Common Council is called to order by His Honor Mayor George C.JJlilias. Present:Councilmen:George M.Mason,J.H.Wentworth,James B.Thomasi Dale D.Daniels,Garl W.Pate. Absent:Councilman David V.stout. Minutes of the regular monthly meeting of November 6th and the regular adjourned meeting of November 22,1950 are read and approved. A report on the investigation of the Gilroy Telephone Company's application to the Public Utilities Commission for an increase in rates from Logan and Frazer,city aU4itors, is presented and read. Motion by Councilman Pate ,seconded by Councilman Daniels and carried that the report of Logan and Frazer on their investigation of the Gilroy Telephone Company's application to the Public Utilities Commission for an increase in rates be returned to Logan and Frazer with a request that they make a definite committment on the amount of raise in rates the company is entitled lP,94 .aD~J;answer these . questions:ls the oompany entitled to the raise requested; and, what is a legitimate raise in rates. A oommunication is read from the Gilroy Chamber of Commerce naming Vernon Gwinn,chair.man,Roy Mead and Carroll Wentz, as me!~ers of the oommittee to meet with the Street Committee of the Council to study the matter of off-street parking. Motion by Councilman Thomas,seconded by Councilman Daniels and carried that the letter from the Gilroy Chamber of Commerce with reference to and insurance on the property of Al Noll/used as a landing field, be returned ,,,,,,,, .J to the Chamber of Commerce for action on their part. A communication is read from the Gilroy City Planning Commission report- ing on the meeting of the Commission and the Ordinance Committee of the Council on the matter of the provisions of Resolution No.240 in connect- ion with Rea Subdivision NO.3,the report stating that it was agreed to waive the provisions of Resolution NO.240,in this particular case,provid- ing /the owners put up a bond of sufficient amount with the city to cover the ,cost of installation of curbs ,gutters am sidewalks. After considerable discussion it was unanimously agreed the this matter be referred to the Ordinance Committee and the City Attorney for invest- igation and report. ,i A communication is read from Mr.E.M. Rea owners of property adjoining complaining the city's sewer farm land/B~KiiKg about the fly and odor nusiance emanating from the sewer farm garbage dump and stating that if some guarantee is not given that the city will cease dumping garbage,garlic and tin cans on the premises without burying them or doing something c cming to prevent their/~~xK~ on his property it will be necessary for him to bring suit against the city and to join the other people responsible for placing the nusiance on the property. It is unanimously agreed that Mr.Rea be notified that the city,JU'l::, November 8,1950, notified Gentry,Inc. and Filice and Perrelli Canning Company,bW registered mail 0: , to discontinue -.s!i:ng'H'3 thel,garpagec,q,ump'1'Qr disposing of industrial wastes, within 90 days of the date of the cow1unication.and to assure him that the city would do everything in its power to abate the nusiance complained of. A communication is read from the San Jose-Santa Clara Chapter of the National Safety Council urging the city to complete the information requested in a communication from the Public Utilities Commission with reference to grade crossings within the city limits and that a copy of the recommendations of the city to the Commission be forwarded to the safety council. Motion by Councilman Wentworth,seconded by Councilman Daniels and 1214 carried that the report to the Public Utilities Coramission urge the improvementx of the Leavesley Road and Ninth Street railroad crossings and that the San Jose-Santa Clara Chapter of the National Safety Council be advised of the ac~ion of the Council on this matter and urged to use its good offices to ass ist in correcting the damrgeraus',.condit iOns aiL'.'.... these two crossings. The Mayor now recommends the appointment of Byron Brown as Vice Commander of the Gilro, Defense Council. ...., Motion by Councilman Wentworth,seconded by Councilman Pate and t .... carried that Byron Brown be appointed Vice Commander of the Gilroy Defense Council. The Mayor now recommends the appointment of H.R.Eschenburg as Executive Officer of the Gilroy Defense Council. Motion by Councilman Daniels,seconded by Councilman Thomas and carried that H.R.Eschenburg be appointed Executive Officer o~ the Gilroy Defense Council. The Mayor now report~ on damage to the Carnadero Creek levee during the recent storm and states that every effort is being made repair t he damage. The annual report of the Gilroy Free Public Library for the year ~ ending June 30,1950 is presented and read. ... -,_Mot ion by Counc ilman Daniels, seconded by Counc ilman Pate and carried that the report of the Gilroy Free Public Library for the year ending June 30,1950, be accepted and placed on file. The report of the Building Inspector for the month of November,1950 is presented and read. Motion by Councilman Wentworth,seconded by Councilman Daniels and carried that the report of the Building Inspector for the month of November,1950 be accepted and placed on file. Councilman 't.':entworth discusses the condi tion of the present street sweeper and urges that something be done toward the purchase of a new sweeper. This matter is referred to the Street Committee for study and ~ re port. The Purchasing Agent reports on the condition of the roof of the City Hall building stating that during the recent storm the roof leaked in several pmaces. The Purchasing Agent is instructed to obtain bids for the repair of the roof. Mr.William Hall now appears before the Council to request that he ~ be granted a pen~it to erect a seven foot board fence on his property located at the southeast corner of Princevalle and Sixth Streets. 1 91' ,..,. ~~ Q It unanimuusly agreed that the Building Inspector write to the League of California Cities to asc~rtain what other cities are doing in regard to limiting the height of fences. ORDINANCE NO.490 (Plumbing Ordinance) is presented and read. Motion by Councilman Thomas ,seconded by Councilman Pate that BRDINANCE No.490 be adopted. NOES: Counc ilmeh None ABSENT: Councilman David V.Stout. ~ report of the City Engineer on his estimate of the city's portion of the cost of the proposed widening of Monterey Street is presented and read, the estimate showing the city's cost to be ~160,000.00. Mr. Frank Blundo now appears before the Council to request a permit to erect a garage building on his property and to use a part of the building to collect and bind paper cartons. This matter is referred to the Build ing Inspector. The City Attorney presents the proposed advertising for bids for Automobile and Comprehensive Liability insurance. I . Motion by Councilman Mason,seconded by Councilman Daniels and carried that the necessary advertising be made to call for bids for Automobile and Comprehensive Liability Insurance and that bids be opened at 8 o'clock P.IJ. ,MondaY,December 18,1950 in the Common Councilroom in the City Hall Building in the City of Gilroy. It is unanimously agreed that each city employee be given a gift of of ;$10.00 in cash as a Ghristmas present. Repo.ts of the city officers are presented and read.
