Minutes 1951/09/104- Gilroy, California. September 10, 1951. 1275 In the absence of the Mayor, this regular adjourned meeting is called to order by the Deputy City Clerk. Present: Councilmen J.H. Wentworth, Carl W. Pate, J-.B. Thomas George M. Mason, David Stout. Absent: Councilman, Dale D. Daniels. A large number of property owners in the Second Western Addition to the City of Gilroy are also present. 1276 Motion by Councilman Stout, second by Councilman Mason and carried that Councilman Geo. M. Mason be Mayor pro -tem. Councilman Mason, Mayor protem, states that the purpose of the meet- ing is to hear a report from the committee from the Second Western Addition who were to call upon those who had not paid their costs for extension of utilities. Mr. John Bozzo, one of the committee, appears before the Council and states that about 90 % of the property owners had now paid and urges that the Common Council proceed with the extension of the utilities. Dr. Leon Melkonian appears and asks to see the plans for rights of way for sewers, and objects to giving a right of way thru his property. He states that he will give right of way through his property if his front foot costs are alloted to the remaining property owners in the area. It is the unanimous opinion of the Councilmen present that Dr. Melkonian should be omitted from front foot charges in return for a right of way and his front foot costs allocated to the remaining property owners in the area. Mr. Hardman appears and states that he had bought property and built his house in the area on the prospect that the area would be severed and that he could g.et no satisfactory answer as to when the sewer lines were to be installed. Mr. Mark Kennedy appears and calls attention to the fact that the front foot costs are estimated costs and that if the cost of the pro- ject is more than estimated an extra assessment would have to be made. Dr. Russell Crane appears and compliments the Common Council for making it possible for the property owners to get their utilities at a low cost and urges that the Council go ahead with the installation of the utilities because of there being so large a percentage having paid their assessments. After discussion by the Council, Councilman Pate moves, Seconded by Councilman Stout and carried, that the City Attorney be instructed to prepare an ordinance amending ordinance No. 477A which would allow the extension of the utilities to property owners in the Second Western Addition. Mr. Robert Hollar appears before the Council and asks if it will be necessary for property owners, whose septic tanks are in good order to connect with the proposed sewer when installed. 1277 The City Attorney replys that Ordinance 477A requires that property owners connect with the City sewers within 30 days. It is the unanimous opinion of the Common Council that due to the hardship that it might work on some of the property owners in the area those property owners whose septic tanks were in good working order and not a health menace would not be compelled to connect with the sewer system immediately Adjourned subject to the call of the chair.
