Minutes 1951/09/171279 Gilroy, California September 17,1951. This regular adjourned meeting of the Common Council is called to order by His Honor Mayor George C.Milias. Present: Councilmen George M.Mason,J.H. Wentworth, James B.Thomas,David V.Stout,Carl W.Pate. Absent:Councilman Dale D.Daniels. The Mayor states that the purpose of this meeting is to discuss the Miller Avenue,drainage problem. The Mayor now reviews the entire problem and reads two letters from Mr.Howard Campen,County Counsel for the County of Santa Clara,one dated e• September 12,1951 and the other dated July 12,1951,the first letter - September 12th - setting forth what the County would do and what the County expected the City to do;.Cd)That the City of Gilroy would be obligated to make up any difference between the 410,000.00 contrib buted bye the county and the amount of the cost of the project;and 1 280 (b) That the City of Gilroy be the contracting party for the construction of said improvement and supervise the progress of the work. The County of Santa Clara will supply,without charge, any and all plans it presently has for this project; and (c) That after the completion of construction, the City of Gilroy will be solely responsible for any and all costs of operation and maintenance of said project ;and (d)The City of Gilroy must notify this office prior to 9:00 A.M. on September 19,1951,of its acceptance or rejection of this offer. The City Engineer presents tentative figures stating that instead of 422,500.00 as figured by the County Engineer he believed the work could be done for approximately w17,000.00 by substituting steel pipe for reinforced concrete pipe. The engineer states that there is a possibility that the Division of Highways might stand part of the cost and stated that Mr.Fred I.lontell of the Division of Highways would be in Gilroy September 18,1951. It is uhatimously agreed that the !;ouncil meeting with 1 r.Montell on September 18,1951. The Clerk is instructed to invite Mr.John Stelling to attend a meeting of the Council at 1 o'clock P.M.,Septeiaber 18,1951. RESOLUTION NO.268 is presented and read. Motion by Councilman +lentworth,seconded by Councilman Pate that RESOLUTION NO.268 be adopted. RESOLUTION NO.268 RESOLUTION PROVIDING THAT RESOLUTION NO.260 SHALL BE INOPERATIVE SIX MONTH AFTER DEPART1LIENT OF PUBLIC ;'aORKS,DIVISION OF HIGHWAYS, WITHDRAWS THE DEPARTMENT'S APPROVAL OF SAID RESOLUTION NO.260. ,JHEREAS the Common Council of the City of Gilroy,did , on the 7th day of May,1951, adopt Resolution No.260 providing for the parking of vehicles on Mionterey Street between Fourth Street and Seventh Street in the City of Gilroy,said street being a public highway,and 'i'MI REAS a certified copy of said resolution was forwarded to the said Department of Public Works and the resolution has been approved by the Department of Public Works,conditioned however upon the adop- tion of either ans amendment thereto or a new resolution containing a provision that the said Resolution No.260 cease to be operative six (6) months after receipt of the Common Council of written notice of withdrawal of the approval of the Department of Public Works and =REAS tUe Common Council deems it expedient and proper to comply with the requirement of the said Department of Public Works, NOV ;,THEREFORE,BE IT RESOLVED by the Common Council of the City of Gilroy that said Resolution No.260 shall be inoperative six (6) monthis after withdrawal by the Department oe Public Works of its approval of said resolution in case such approval is withdrawn; BE IT FURTHER RESOLVED that a copy of this resolution,duly certified by the City Clerk,be immediately forwarded to the Depart- ment of Public 1, orks,Division of Highways,State of California.
