Minutes 1951/12/04I 4- Gilroy ,xCal,ifornia December 4!1951 This regular monthly meeting o of the Common Council is called to order by His Honor Mayor George C.Yilias. Present:Councilmen George M.MasonjJ.H.WentworthvJames B.Thomas, David V.StouttCarl w.Pate. Absent:Councilman Dale D.Daniels. 1.295 Minutes of the regular monthly meeting of November 5th and the regular adjourned meeting of November 19th,1951 are read and approved. Applications for Police P atrolmen are read from Robert O.Edwards and Frank Stegall. The Mayor states that the City Marshal has requested that Applications for patrolman be laid over until he has time to investigate and make a recommendation. It is unanimously agreed that the applications for Patrolman be placed on file and referred to the City Marshal. A communication is read from the Gilroy High School requesting use of Wheeler Auditorium for tieir annual. Christmas party December 18th and to use the building for rehearsal on the afternoon of December 17th. Lotion by Councilman Stout,seconded by Councilman Pate and carried that the Gilroy Union High School Band and Choral Group be granted free use of Wheeler Auditorium Tuesday evening December 18th and that they be advised to contact the Armory Board for use of the building on the afternoon of December 17th. A communication is read from the Division of Highways acknlwledging the the city's letter requesting that the population figures on the city limit signs be changed to conform with the 1950 census figures. The letter assures the Council that the change will be made at the earliest possible time. The Clerk is instructed to write another letter on this subject two months hence if the signs have not been changed. A communication is read from Logan and Frazer,city auditors, stat- ting that the city's books of account and record had been audited to September 30,1951 and all were found in good order. Motion by Councilman Stout,.seconded by Councilman Pate and carried that the report of Logan and Frazer city auditors, for the quarterly audit ending September 30,1951, be accepted and placed on file. A communication is read from the Continental Baking Company protesting the paying of 'another" license for Hostess Cakes a brand name used by the baking company for their cakes and pastry and distributed separately. The letter is referred to the City Attorney for investig- ation and reply. A communication is read from the Gilroy Elementary School Board offering to dedicate the northerly half of ninth Street f zk street purposes also the southerly half of Eight Street for street purposes providing the owners of the north half would dedicate their one -half 1296 for street purposes. TIhe letter advised that Mrr.Robert Howson of Howson Bros. owners of the north half of Eighth Streett had informed blr.Sydney S.Johnsonfcity attorneys that the Howson Bros. would be willing to dedicate their one-half for street purposes. A deed from James A.ClAyton and Companylowners of the south half of Ninth - Street, is presented and read;the deed granting their 30 feet for street purposes. After some discussion the Clerk is instructed to advise James A.Clayton and Company the Board of Trustees of the Gilroy Elementary School district and Howson B ros. that the city wants a deed from each of these parties for the necessary 60 feet along their west line for the purpose of extending Princevall.e Street to Ninth Street and that the same conditions would apply in this case as in subdivi- sions inside the city limits,namelygthat curbs gutters and sidewalks be installed and that the streets be graded to city specifications and oiled. A communication is read from the City Engineer recommending that bills of Leo Piazza for labor and material for Ninth Street in the amAunt of $2x,554.65 and work on Hecker Pass Road in the amount of $63.00 and f'bhn`_-,B'Xavoline for grading on Ninth Street and Hecker Pas& Road in the total amount of $284.00 be paid. Motion by Councilman Wentworthsseconded by Councilman Pate and carried that the bill of Leo Piazza for material .for: - Ninth,. Streeet and Hecker Pass Road in the amount of $2s617.651be paid. The Council now discusses the matter of extras and agrees that on all future work there will be no extras allowed. Motion by Councilman Pate seconded by Councilman Mason and carried that the bill of John B.Paroline for ectra work grading 9th 6treet and Hecker Pass widening and excavation for fill in the amount of $284.00,be paid. The City Attorney now presents his latest revision of a proposed ordinance governing the erection of television aerials. Several television dealers are present and a general discussion of parts of the proposed ordinance follows.After all corrections are agreed upon the City Attorney is instructed to make a final draft of the ordinance. The City Attorney now presents several ordinance governing the heighth of fences and a general discussion follows.It is generally agreed that the ordinance governing fences should include a seven foot fence along the alley in rear of property;a six foot fence 1297 from the rear property line to the rear of a dwelling and a w ,: foot fence from the rear of the dwelling to the front of the dwelling and a three foot fence from the front of the dwelling to the front property line. It is also unanimously agreed that the ordinance should include a provision requiring Council permission to erect a fence on vcant lots. The Clerk presentsa communication from the City Manager amd City Attorney of Stockton outlining a plan whereby citioa`cauparticipate with the City of Stockton in a hearing before the Public Utilities i Commission to protest 4:.:. request for a rate increase by the Pacific Gas and Electric Company. The: City of Gilroy's share is set down as $50.00. After brief discussion it is decided that the Public utilities Commission will have all the facts before them at the hearings and that they will make the final decision as to whether the Company should be granted the increase in rates they ask for. It is unanimously agreed that this city make no contribution to the matter. Councilman Stout now discusses the matter of a lease on 47 acres of city sewer farm land now under lease to Henry Allemand,stating that Leola Brownellxformer lessee,had approached him and discussed the matter of again leasing the land.Councilman Stout states that two or three M persons had approached him about this: lease. It is unanimously agreed that Councilman Stout and his committee discuss this matter with interested parties. Councilman Mason presents recommendations of the :Finance Committe for the purchase of a new automobile for use of the Police Department. It is unanimously agreed that the recommendations of the committee be accepted and that bids be called for . The report of the Poundmaster for the month of November,1951 is presented and read and ordered placed on file:. . -- ".the Report of Arrests and Report of Traffic Citations issued by the Police Department is presented and read and ordered placed on file. The report of the Building Inspector for the month of N ovember,19 51 is presented and read and ordered pladed on file. Reports of water samples taken by the Santa Clara County Health Department on Oct.29th,31st7Nov.5th,7thtl4th and 15th are presented and read and ordered pladed on file. Reports of the city offeers are presented and read. Motion by Councilman Stout,seconded by Councilman Thomas and carried that reports of City officers be accepted as read and placed on file. Motion by Councilman Stout,seeonded by Councilman Thomas and carried 1 2 ` ' that bills aps presented be allowed and warrants ordered drawn on the Treasurer.
