This regular monthly meeting .of the Common Council is called to
Order by His Honor Mayor George C.Milias.
Present:Councilmen Carl W.Pate,Courtland M.Rush,J.Hughes Kennedy,
Charles Gallo,Jack W.Ronald. Absent:Councilmen George W.White.
Minutes of the regular monthly meeting of December 1,1952 are
read and approved.

A communication is read from Bruce McKnight with reference to rep-
cities
presenting several/before the Public ijtilities Commission in the matter
of a raise in rates for the Pacific Telephone and Telepgr,ph Company;
this cities share of the cost,$50.00.
It is unanimously agreed that the matter of ccntributing $50.00 to
hiring of Mr.McKnight be tabled and the Clerk instructed to advise
him that the Council is not interested.
The City Attorney now discusses a recent decision of a Superior
Judge in Petaluma with reference to a decisicn that the telephone
company is not required to pay a franchise to,~.the cities. The City
Attorney advises the Council that he had discussed this matter with
the League of California Cities and they are of the opinion that
if the decision of the Superior Judge at Petaluma is upheld it would
not effect Gilroy's franchise with the Gilroy Telephone Company on
account of this city's charter.
A communication is read from the Tide Water Associated Oil Company
requesting permission to make their Sales Tax return on an annual
basis. It is unanimously agreed that no discrimination be made and
tha t the oil company be required to file their :returns quarterly
the same as other businesses.
A communication is read from the Santa Clara County Committee For
RR Grade Crossing Safety. This communication is ordered filed.
Applications for Police Patrolman from Florencio Velasco and
Anthony Fisher are presented and read. These applications are
referred to the City Marshal.
Reports of water samples taken by the Santa Clara County Health
Department are presented are ordered filed.
A report for the year 1952 from the Gilroy Volunteer Fire Depart-
ment is presented and read. The Mayor praises the department for

its excellent work in keeping/the fire losses for the year to
$3,135.00. This report is ordered filed.
The report of the Building Inspector for the month of December,
1952 is presented and read and ordered filed.
The report of the Gilroy Police Department for fue month of Dec-
ember,1952 is presented and read and ordered filed.
The matter of a claim of the Clare Dell Dairy for towing charges
resulting from an unstable ditch on Oak Court Drive is referred to
the city insurance carriers.
Councilman Patediscusses the matter of an ordinance requring all

future excavations made by contractors, plumbers and others shall be
backfilled with sand and the surface of the street or alley at the
excavation to be'made to conform with the surrounding surface. It is
unanimosuly agreed that the street Committee make a study of this matter
and present their findings to the Council."
Councilman Pate discusses the matter of the Purchasing Agent attending
the state conven~ion of California state and County Purchasing Agents
at Santa Cruz in January,1953.
Motion by CouncilmanPate,seconded by Councilman Kennedy and carried
that purchasing Agent G.B.Carr attend the state convention of California
state and County furchasing Agents at Santa Cruz with expenses to be paid
by the city.
Councilman Rush discusses the matter of changing th e alignment of
the seventh hole at the Gilroy Golf Club.
Motion by Councilman Rush,seconded by Councilman Pate and carried
that no change be made at the Gilrcy Golf Club grounds which will dis-
turb the soil adjacent to the city reservoir.
Councilman Gallo discusses the matter of the three months leave of
absence requested by Patrolman Ercole Silacci.
Motion by Councilman Pate, seconded by Councilman Kennedy and carried
that Partolman Ercole Silacci be granted a three months leave of absence,

as requested, and at the end of the leavce of absence period the City
Marshal to employ'him;whenever he is in need of an officer to work on
a temporary basis.
Councilman Kennedy presents figures for the construction of a room
for the Judge adjoining the present office.
Motion by Councilman Kennedy Seconded by Councilman Rush and carried
that the Buildings and Grrunds Committee proceed with the construction
of a room for the District Judge on the bid of Gordon Farotte of $409.00
for the construction and materials and the bid of $40.00 by Hollenback
Electric for wiring.
Councilman Kenneny states that he has an estimate of $340.00 for
painting the city jail. It is unanimously agreed that bids be secured
for 'this work.
Councilman Kennedy submits an estimate of $516.00 for heating the
jail. It is unanimously agreed 'that bids be asked for.
The matter of pay for nite officers doing relief work is discussed
and this matter is referred to the Finance Committee for recommenda ti.on.
Ccuncilman Ronald discusses the matter of the request of the National

Guard to fence a portion of the rear yard at the ~leeler Auditorium.
Reports of the of{'icers are presented and read.
Motion by CcunciJman Pate,seccnded by Ccu~lcilman Ronald and carried
that the reports of city officers be accepted as read and placed on
file.
It is unanimously agreed to meet with Mr.M.J.Filice to discuss
future annexation and drainage in the Castlewood Park area on
Thursday,January 22,1953 at 8 o'clock P.M.,Council Chambers,City
Hall.
Motion by Councilman Pat~;seconded'by Counc~lman Kennedy and carried
that bills as presented be allowed and warrants drawn on the
Treasurer.
