This regular monthly meeting o~ the Common Council is called to
order by His Honor M~or George M.Mason.
Present:Councilmen Carl W.Pate,Charles Gallo,Courtland M.Rush,
Kenneth L.Peters~n,Segundo.SanChez.Absent:Councilman J.Hughes Kennedy.
The Mayor now asks if all Councilmen have received a copy of the
minutes of the regular monthly meeti~ of February 6,1956 and the
special meeting of February 20,1956.
All Councilmen answer in the affirmative.
The Mayor now asks if there are any errors or corrections to be made
in the minutes.
No errors being noted and no corrections to be made the Mayor now
declares the minutes of' the regular monthly meeting of February 6,
1956 and the special meeting of February 20,1956,approved.
Councilman Rash states this his committee has nothing to report

on conversion of Wheeler Auditorium to City Hall purposes.
Building Inspector Byron Brown is called upon by the Mayor to report
on his: conversations with the occupants of the dwelling at the Golf
Course. Mr.Brown reports that the figure he has obtained to do the work
on the dwelling includdlng painting is $1570.00.
Motion by Councilman Pate, seconded by Councilman Rush and carried
that Building Inspector Byron Brown handle the work of altering the

work of altering the dwelling at. the Golf Course t.he work to
include everything but ~he painting.
Councilman Pate states that he has nothing furt.her to report on
the proposed extension of Alexander Street.
Councilman Kennedy now is present.
City Attomey Johnson states that he rill not be ab'le to contact
Le~e of California Cit.ies officials to discuss the P.G.& E.Co.
franchise tax matter due to the absence of the officials from t.he
]
Berkeley office.
Councilman Rush states that his committee has no report to make
on the request of the Police Department.
Councilman Sanchez states that he has nothing to report on
possible P.M.A.assistance for work on the Llagas Creek but will
have a report at the next. meet.ing.
Councilman Sanchez reports that Colonel Columbia and M~or
Nicholson of the National Guard accompanied by himself and the
City Administrator viewed a possible site for a new armory located
09 the. Glen View school property and that. the Guard officials
were much impressed with this location.
A communication from the Bureau of the Census was read the

letter giving the population of tl!Ite City as of January 30,1956
as 6019.This communication and report. were ordered filed.
It is unanimously agreed that the Clerk write a letter to the
Gilroy Chamber of Commerce thanking them for their efforts on
behalf of the taking of the special census.
A communication is read from the Department of Public Works
acknowledging receipt of special census figures from the Bureau
of the Census and indicating the increase in Gas Tax money for
the city as a result of increased population.
A communication addressed to Mayor Mason from City Manager
A.P.Hamann of Sanjdeee inviting the Mayor to at.tend a meet.ing
with the County Executive in San Jose,is read;a communication
from the County Executive relative to Board of Supervisors
having the Uniform Sales Tax Acto of 1955 before them for
consideration;a communication from the County Executive to the
Board of Supervisors giving them the results of a meeting with
Mayors and other representatives of the cities in the County;s
communication from A.P.Hamann,chairman of the Uniform Sales Tax
Committee of the Inter-City Council, giving the results of the

meeting with the County Executive and city of:fic'ials to discuss the
Uniform Sales Tax Act of 1955 and urging the Council to pass a
resolution similar to the one enclosed with his communication with
reference to the Uniform Sales Tax;s communication from the County
Executive stating that the Board of~pervisors has not placed dis-
cussion of the Uniform Sales Tax Act on their agenda for the February
27th mee-ting.
The City Clerk,at the request of the M~or, presents and reads the
resolution submitted by the Uniform Sales Tax Committee of the Inter-
City Council.
Motion by Councilman Sanchez,seconded by Councilman Pate that
RESOLUTION NO.373 be adopted.

The Common Council 08 the City of Gilroy does resolve as follows:
WHEREAS, state Assembly Bill No.3l1l authorizes the enactment of
a county-wide sales tax ordinance by the County Board of Superviaors,
and
WHEREAS, state Assembly Bill No.311l makes it possible to have a
uniform sales tax ona county-wide basis,and
WHEREAS, the Incorporated Cities of the County of Santa Clara are
urgently in need of sales tax revenues to meet the pressing needs of
their expanding municipalities,and
WHEREAS, the enactment of a sales tax measure would provide these
urgently needed funds in the immediate fUture,and
WHEREAS, the City of Gilroy has pressing needs similar to all of the
municipalities of Santa Clara County,and
WHEREAS, it. is the intent of the Common Council of the City of Gilroy
that the full proceeds of a one per cent (1%) sales tax under the sales
and use tax ordinance now in effect collected within its corporate
limits be retained for the expenditure by said City.
NON,THEREFORE,BE IT RESOLVED that the Board of Supervisors of the
County of Santa Clara enact a Eales tax ordinance for the County of
Santa Clara,and.
BE IT FURrHER RESOLVED that the County Board of Supervi sors indicate
its agreement that. the fu1~ share of any sales tax collections within
the City of Gilroy be retained by the City of Gilroy.

A communication is read from the I.F.D.E.S.Association requesting
I I permission to hold a parade on on May 6,1956.

Motion by Councilman Pate,seconded by Councilman Kennedy and carried
that the I.F.D.E.S.Association be granted permission to hold a parade
on May 6,1956 with the Street Committee and City Marshal handling the
route of the parade.
A communication is read from the Gilroy Public Schools requesting
Second street be made a STOP street from Eigelberry to Hanna street.
It is suggested that school offi~ials be contacted to discuss the

possibility of using First Street instead of Second Street for their
bus route.
A communication is read from the California State Automobile
Association re1ative to their traffoc sign business.
Motion by Councilman Sanchez,seconded by Councilman Pate and
carried that California state Automobile Association services be
used to erect and service all traffic signs within the city.
A communication with a proposed ordinance on pin ball machines
from the County Executive is presented and read.
It is udanimous~ agreed to refer the proposed ordinance on'
pin-ball machines submitted by the County Executive to the Ordinance
Committee and the City Attorney for investigation and recommendation.
A communication is read from the San Ysldro school requesting
permission to use Wheeler Auditorium.
Motion by Councilman Kennedy,seconded by Councilman Petersen
and carried that the San Ysidro school be granted permission to
use,free of charge,Wheeler Auditorium on March ~6th and 22nd for
rehearsals and on March 23rd for their Spring Festival of Music.
A communication is read from the Gilroy Public School requesting
permissi.on to use Wheeler Auditorium for graduation exercises.
Motion by Councilman Kennedy,seconded by Councilman Petersen
and carried that.the .Gilroy Public Schools be granted free use
of Wheeler Auditorium for graduation exercises on June 18,19 and
20,1956.
A communication is read from Arthur W.Brown,member of the City
Planning Commission of the City of Gilroy requesting that he be
be relieved from his duties as a member of the Commission.
Motion by Councilman Pate ,seconded by Councilman Rush that
Arthur W.Brown's request be complied with,to be relieved from
his duties as a member of the Planning Commission and the Clerk
be instructed to write a letter of thanks to him for his past
services.
The Mayor proposes the name of Mr.Paul Scheck to serve as a
member of the City Planning Commission of the C'ity of Gilroy.
Motion by Councilman Patetseconded by Councilman Rush and carried
that the Mayorts recommendation be accepted and that Mr.Paul Scheck
be appointed a member of the City Planning Commission of the City
of Gilroy for a term of four year effective January 15,1956.

from the Board of Trustees of the Gilroy Public Library and recommends
the appointment of Mr.Armand \Vhite to the board.
Moti~n by Councilman Pate,seconded by Councilman Petersen and earried
that Armand White be appointed a member of the Board of Trustees of
the Gilroy Public Library.
A communication is read from Cub Scout Pack 95 thanking the Council
for use of Wheeler Auditorium for t he Cub Scout dinner.
The M~or reports that he met with a representative of the Public
Utilities Commission and a Southern Pacific representative to discuss
the closing of Casey Street crossing. Along with Councilman Pate it
was agreed that the company take a traffic count at this crossing.
The M~or presents a request from Howson Brothers for a building
permit to construct over Miller Slough west of the bridge on North
Monterey Street.
Motion by Councilman Pate,seconded by Councilman Petersen and carried
that the Building Inspector be instructed to issue a building permit to
Howson Brothers to erect a building over Miller Slough west of the
bridge on North Monterey Street all work to be done under the direction
of the Building Inspector.
Councilman Sanche~ reports that bids for a pump for the new water well
on South Forest Street are ready to be sent out and that his committee
had determined to call for bids for an open impeller type pump.
Motion by Councilman Pate, seconded by Councilman Petersen and carried
that the specification for the pump for the new water well on South
Forest Street be sent to prospective bidders as drawn by the Water
Committee and the Purchasing Agent and that bids be opened at 8100
o'clock P.M. on Mond~,April 2,1956 at the regular monthly meeting of
the Council.
Councilman Pate announces that the tank for the flusher !;rupk has
arrived and requests permission to proceed to install the pump.
Motion by Councilman Kennedy,seconded by Councilman Sanchez and
carried that the Street Committee and the Purchasing Agent proceed
with the completion of work on the nusher truck.

the usual $75.00 clothing allowance made to members of the Fire
Department be given to Hurshal Wingo,a new member of the department.
The matter of a hose dryer for use of the fire department is

carried that the Purchasing Agent investigate the various m.akes
of hose dryers and purchase one he believes will be satifactory for
use of the Fire Department.

RESOLUTION APPROVING BOND OF PACIFIC GAS AND ELECTRIC
COMPANY FOR THE PURPOSES SET FORTH IN ORDINANCE NO.453
WHEREAS on the 16th day of June ,1947, the Common Council of the
City of Gilroy passed its ordinance granting to the predecessor in
interest of Pacific Gas and Electric Company,a California corporat:ion,
the franchise to use the public streets and places of said city for
the Dransmission and distribution of gas for the purposes,and upon the
terms and conditions as set forth in said ordinance;and
WHEREAS said Pacific Gas and Electric ~ompany has duly executed
and filed with the Council a bond in the penal sum of One Thousand
($1,000.00) dollars,bearing date the 1st d~ of January,1956,and
conditioned as prescribed by law;and
WHEREAS upon due investigation and consideration,it appears to
the satisfaction of this Council that said bond is in proper form
and that said bond has been duly executed by said Pacific Gas and
Electric Company and by one good and sufficient corporate surety;
NOW,THEREFORE,BE IT RESOLVED by the Common Coupeil of the City
of Gilroy that said bond be,and it is hereby accepted and approved,
and it is hereby substituted for the bond heretofore filed in
connection with the granting of said franchise.

The matter of a meeting with Pacific Gas and Electric Company
officials to discuss the gas and electric franchises is discussed.
The City Attorney recommends acceptance of the checks for payment
of' the 1955' franchise tax by the Pacific Gas and Electric Company
and reads a waiver presented by the company.
The City Attorney now presents and reads ORDINANCE NO. 537 .

RESOLUTION DECLARING DESIRABILITY OF ESTABLISHING LIGHTING DI STRICT
IN A DESCRIBED PORTION OF THE CITY OF GILROY, APPOINTING OFFICER TO
MAKE AND FILE WITH THE CITY CLERK OF THE CITY OF GILROY A REPORT IN
'WRITING.

WHEREAS, a portion of the territory hereinafter described has been
comparatively recently annexed to the City of Gilroy,and has been
subdivided and virtuall.y the entire area has been improved with
dwellings; and,
WHEREAS, the lighting system in the said area is of me~er prop-
ortions and is obsolete,and the ,quipment thereof is obsolete and
does not provide an adequate street lighting system; and,
WHEREAS, the Common Council of the City of Gilroy believes that the
said lighting system should be peplaced by an adequate system, and
that the Street Lighting Act of 1919 o~ the State of California

provides a method of' procuring the said lighting system for the said
area;and, .
WHEREAS, the said Street Lighting Act of 1919 provides that the
Common Council,prior to the adoption of any resolution of intention,
shall name and designate a Board,Commission,officer or person to make
and file with the City Clerk a report in writing containing the matters
set forth in Section 18041 of the Streets and Highw~s Code,and the
Council determines that BYron Brown should be designated and named as
the person to make and file said report.
NOW,THEREFORE,BE IT RESOLVED:
That a lighting district be establised in the area hereinafter described,
under the Street Lighting Act of:1919,and it is hereby ordered that the
said Byron Brown make and file with the City Clerk a report in writing
containing the matters and information set forth in said Section lB04l
of the Streets and Highw~s Code. The said teITit.ory hereinbefore
mentioned and whiCh the Common Council believes should be establised
as said lighting district is described approximately as follows,to-wit:
Being all of Tract 239,Renz Addition to the City of Gilroy,
Tract 971,Renz-Wayland Lane Tract;Tract 1046 a Resubdivision
of a portion of the Loupe Addition (Book ttDIt of Maps page 5,

The City Attorney presents and reads an agreement for for sale of
the Monterey Street electrolier system between the Pacific Gas and
Electric Company and the City of Gilroy.
Motion by Couhcilman Sanchez,seconded by Councilman Gallo and carried
that the Mayor be instructed to sign the agreement between the Pacific
Gas and Electric Company and the City of Gilroy for the sale of the
Monterey Street electrolier system to the City.
........; Building Inspector Brown reports no violation of ordinances by the
person keeping chickens,etc.on their property on South Eigelberry Street
between Eighth and Ninth streets.
Civilian Defense Coordinator Brown reports the receipt of equipment
for a 200 bed h6spital and that the ~uipment has been stored in the
Wheeler Auditorium building.
The City Marshal now appears before the Council to request t hat one

additional man be hired for the police department. It is agreed
that the Marshal present a schedule of working hours for the
department at the present time.
Councilman Pate discusses the matter of making Fourth Street
between Monterey street and Eigelberr,y Street a two hour: parking
zone. The City Attorney is instructed to prepare and ordinance to
accompliSh the ~wo hour parking limit.
The City Marshal presents a request from the Department of Motor
Vehicles t.o reserve two parking spaces in front of their off'ice: on
Nort.h Eigelberry Street to be used during tests for drivers
licenses. Mr.Roy Mead,local manager for Pacific Gas and Electric
Company apP3 ars to discuss this matter. It is unanimously agreed
that this matter be referred to the Streat Committee.
Councilman Sanchez discusses the possibility of calling a meeting
to discuss the conversion of Whee~er Auditoriwn t.o City Hall purposes.
It is agreed that a meeting should be held on March 12th to discuss
this matter.
Reports of city officers are presented and read.
Motion by Councilman Pate~seconded by Councilman Kennedy and
carried that the reports of city officers be accepted as read and
placed on file.
Motion by Councilman Rushtseconded by Councilman Petersen and
carried that bills as presented be allowed and warrants ordered
drawn on the Treasurer.
Motion by Councilman Pate, seconded by Councilman Rush and carried
that this meeting adjourn to Monday,March 12,1956 at 8 0 'clock P.M.,
