This regular monthly meeting of the Common Council is called to
order by His Honor Mayor George M.Mason.
Present:Councilmen Carl W.Pate,Charles Gallo,J.Hughes Kennedy,
Courtland M.Rush,Kenneth L.Petersen,Segundo Sanchez.
The Mayor now asks if all Councilmen have received copies of the
the minutes of the regular monthly meeting of April 2nd, the regular
adjourned meetings of April 9th,16th,23rd and the Special meeting of
May 1,1956.
All Councilmen answer in the affirmative.
The Mayor now asks if.there are any errors or corrections to be
made in the minutes.
No errors beihg noted and no corrections to be made the Mayor now
declares the minutes of the regular monthly meeting of April 2nd and
the regular adjourned meetings of April 9th,16th,23rd and the Special
meeting of May lst,1956,approved.
This being the date specified in the law for canvassing of the
vote for the regular municipal election of,rMay 7,1956 the Mayor

now appoints Councilman Carl W.Pate as Inspector and Councilmen
Charles Gallo and Councilman Kenneth L.Petersen as Clerks of the
the canvassing board and orders that the canvassing of the regular
municipal election returns proceed.
At the conclusion of the canvassing the totalling of the vote
for both the returns from the precinct boards and the absentee
ballots delivered to the City Clerk are turned over to the City

Attorney.
This being the time specified in notices mailed to several
local contractors to open bids for street maintenance wprk for
the period June 1,1956 to October 31,1956 one bid is presented
and read;
George C.Renz Cmnstruction Company, Inc.
It is unanimously agreed that the awarding of the bid be post-
poned in"order that the figures presented be examined further.
The City Engineer presents plans for a new bridge to be erected
across the Llagas Creek on the City Sewer Farm property.
Motion by Councilman Sanchez, seconded by Councilman Pate and
carried that advertisement for a new bridge across the Llagas

Creek on the City Sewer Farm property be made and that bids
be opened on Monday,May 28,1956 at 8 o'clock p.m.,Council
chambers,City Hall,Gilroy,California.
The chairman of the Finance Committee states that he has no
report,on the Bank of America property.
Councilman Gallo reports that he has investigated the build-
ing located on North Church Street to the rear of the Pres-
byterian church, and states that the owner has agreed to repair
the electric wiring in the building.
Councilman Pate reports that he will recommend certain changes
be made in STOP signs on Second Street to allow the school busses
to use this street instead of First Street.
The chairman of the Finance Committee reports that he has
investigated the matter of the salary of Tom Sanchez and his
Committee recommends that the salary be increased to $300.00

Motion by Councilman Rush, seconded by Councilman Gallo and
carried that the salary of Tom Sanchez be increased to $300.00

per month effective May 1,1956.

Councilman Pate reports that the matter of an opening in the median
strip on North Monterey Street opposite the 53 foot right of way
between the Pentacostal church property and the Gilroy Motor
Company is being discussed with the local representative of the
Division of Highways.
Motion by Counci1man Pate, seconded by Councilman Rush and carried
that election officials serving for the regular municipal election
held on May 7,1956 be paid the sum of $15.00 each.
A communication is read from Robert Hagen,Director of Recreation,
setting forth the program for 1956.
The matter of a contract for any city property used for the
recreation program is referred to the City Attprney.
A communication is read from the State Compensation Insurance
Fund advising the Council of a refund on the 1954-1955 premium
and commending the employees for their fine safery record. This
communication is ordered filed.
A communication is read from the Division of Highways advising
the Council that a portion of First Street from Monterey Street
to Carmel Street will be resurfaced. The City Engineer's office
requests th?t the contractor for the wIDrk be required to raise
the monuemets on First Street and provide caps for same.
A communication is read from the Bank of America thanking the
Council for the plant which the city presented on the occasion of
the opening of their new office.
A communication is read from Mrs.Edith Ayer requesting that some
action be taken to increase street lighting in the reaidential
area of the city. It is unanimously agreed that the Lighting
Committee investigate this matter with representatives of the
Pacific Gas and Electric Company.
A communication is read from the State Military Department with
reference to land for an armory site. The matter is referred to
the Buildings and Grounds Committee to discuss the subject with
the Elementary School board.
Resolution No.58-City Planning Commission of the City of Gilroy
is presented and read.
The City Attorney presents and reads RESOLUTION NO.378.
Motion by Councilman Kennedy, seconded by Councilman Gallo that
RESOLUTION NO.378 be adopted.

RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY FIXING
THE TIME AND PLACE OF HEARING REPORT AND RECDMMENDATION OF THE
CITY PLANNING COMMISSION OF THE CITY OF GILROY THAT ALL THE
PREMISES WITHIN THE SECOND NORTHERN ADDITION TO THE CITY OF
GILROY BE PLACED IN ZONE "D" DISTRICT AND THAT CERTAIN OTHER
PROPERTY BE CHANGED FROM ZONE "A" TO ZONE "B" DISTRICT, AND
THAT THE ZONING ORDINANCE OF THE CITY OF GILROY BE AMENDED
ACCORDINGLY.
WHEREAS, the City Planning Commission of the City of Gilroy
has reported, found and recommended, after due public hearing
had thereon, that Ordinance No.422 of the City of Gilroy,
commonly known as the zoning ordinance, be amended by changing
the boundary of Zone "D" District to as to include therein all
the premises in the City of Gilroy known as "Second Northern
Addition to the City of Gilroy", and changing the houndary lines
of Zone "A" D~strict and Zone "B" District so as to include in
Zone "B" District all that part of the following described
premises not now in said Zone "B" District,to-wit:
Commencing at the point of intersection of
the northerly line of Broadway Street with
the easterly line of Wayland Lane, and
running thence in an easterly direction along
said northerly line of Broadway Street 327.10
feet to an alleYithence alpng the northwesterly
line of said alley 233.80 feet to a proposed
alleYithence at right angles in a southwesterly
direction 315.78 feet,more or less,to the
easterly line of Wayland Lane,and thence in a
southeasterly direction along the easterly line
of Wayland Lane to the point of beginning.
Reference is hereby made to the map and Zoning Ordinance
now on file in the office of the City Clerk of the City of Gilroy,
and,
WHEREAS, the law requires that a public hearing on said
report and recommendation be held before the Common Council of
City of Gilroy,after notice duly given of said hearing.
NOW,THEREFORE, be it resolved, and it hereby ordered, that a
public hearing will be held before the Common Council of the
City of Gilroy on the 28th day of May,1956, at the hour of
8 o'clock p.m. of said day,at the Common Council Roon in the
City Hall in the City of Gilroy,County of Santa Clara, State of
California, and
BE IT FURTHER RESOLVED that the City Clerk give notice of
the said hearing in accordance with law and the ordinances of
the City of Gilroy.

ELECTION OF OFFICERS OF THE CITY OF GILROY.
~
WHEREAS, the regular municipal election for the municipal offices
of the City of Gilroy was held in said City of Gilroy on the 7th day
of May,1956, in accordance with the provisions of the City Charter,
and pursuant to law and to due and legal notice given of said
election;and
WHEREAS, all of the absentee ballots applied for at said election
have been voted, and returned to the City Clerk;and,
WHEREAS, the Common Council of the City of Gilroy has on the 8th
day of May,1956,canvassed the returns of said election including
the absentee votes, and found and ascertained that the total number
of votes,excluding absentee votes, cast at said election was 1952;
that the number of votes cast at Precinct HAH was 480~ that the
number of votes cast at Precinct HBH was 616; that the number of
votes cast at Precinct HCH was 444; that the number of votes cast
at Precinct HDH was 412;and
WHEREAS, the said Common Council of the City of Gilroy did
proceed to also canvass the absentee ballots cast at said election
and found and ascertained that the total number~f absentee votes
cast at said election was 23;that the total number of votes, including
absentee votes,was 1975,and the following named persons received the
total number of votes,exclusive of absentee votes, the number of
absentee votes,and the total number of votes set opposite their
respective names for the respective offices for which they were
candidates, to-wit:

Councilman Sanchez reports on a meeting at the Brownell school
with about 40 persons residing in this community to discuss
recreation facilities.
~
Councilman Pate asks permission to be excused for this meeting
and the Mayor now grants permission for Councilman Pate to retire.
Councilman Sanchez reports on his discussions with representatives
of Miller & Lux,Inc. with reference to the use of the Las Animas
Hospital Reservation site for a recreation center.
Mr.Ted Chavez, representing the group interested in promoting
a recreation center, now appears before the Council to discuss
the plans discussed by his group.
Councilman Petersen suggests that there may be a possibility
that the Miller & Lux people would be interested in leasing the
Las Animas Hospital Reservation to the city for recreation purposes.
It is unanimously agreed that the Council will copperate with

the group promoting a recreation center and playgrounds.
Cpuncilman Sanchez reports on his conversation with Mr.Jack
DeBell, subdivider of Sherwood Park,with reference to the city
using the water well located on the property and the four acres
of land offered by Mr.DeBell for a park. The park area would be
given to the city providing the city would develop the area
for park purposes immediately.

Motion by Councilm~n Rush, seconded by Councilman Petersen and carried
that the sum of $150.00 be donated to the Volunteer Fire Department
for their clothing replacement fund.
The report of Logan and Frazer,city auditors, stating the the
city's books of account and record have been audited to the quarter

ended March 31,1956 and all had been found in order. This report is
ordered filed.

The March report of the County Controller on fines collected for
the month of M~rch,1956,the report of arrests by the Police Depart-
ment for April,1956,the Building Inspector's report for April,l956
and the Poundmaster's report for April,1956 are presented and read
and ordered filed.
Applications for On Sale Beer licenses from Joshua T.Walker,d.b.a
Liberty Billiards,221 N.Monterey St.;Joe Fortino,d.b.a.Club 14-0,

\VHEREAS,the State of California, through its Department of Public
\vorks,Division of Highways,has presented ~endment Number 1 to the
Agreement for Maintenance of the State Highway in the City of Gilroy,
dated March 1,1956;
\ffiEREAS,the Common Council has heard read said Amendment Number 1
in full and is familiar with the contents thereof;
THEREFORE,be it rrsolved that the Common Council of the City of
Gilroy that said Amendment Number 1 is hereby approved and the Mayor
and the City Clerk are directed to sign the same on behalf of said
City.
