This special meeting of the Cornmon Council called by Mayor
George M.Mason by mai1ing a letter to each member of the Council
and the pres~more than 24 hours in advance of the meeting is
called to order by His Honor Mayor George M.Mason at 1:10 o~clock
P.M.
Present:Cpuncilmen Carl W.Pate,Charles Gallo,Kenneth Petersen,
Segundo Sanchez. Absent:Councilmen J.Hughes Kennedy,Courtland
M.Rush.

The Mayor states that the purpose of this meeting is to consider
the matter of a change in the award of a contract for building a
bridge across the Llagas Creek at the City Sewer Farm..
The Mayor now orders the communication received from Gordon Farotte,
the lowest bidder on a reinforced steel and concrete bridge to be
constructed across the Llagas Creek at the City Sewer Farm.

The Clerk r~ads the letter from Mr.Farotte in which he stated
that "an A-l (State License) is needed to build the above project"
(the bridge across the Llagas Creek at the City Sewer Farm)."It was
my understanding that I could qualify with my B license. Upon checking
with the State,I was informed that it is necessary to have an A
license to build bridges and cul~erts for public works". "In view of
the circumstances I am unable to build the bridge and therefore am
withdrawing my bid".
Motion by Councilman Pate, seconded by Councilman Petersen and carried
that the bid of Gordon Farotte to construct a bridge across the Llagas
Creek at the City Sewer Farm be withdrawn by reason,as stated in his
letter,that he is unable to qualify for this work under his B-l-

Councilman Kennedy is now present and occupies his place at the
Council table.
Councilman Rush is now present and occupies his place at the Council
table.

During a general discussion the matter of the type of bridge is
discussed and also,the'possibility of selling the 47 acres of land
lying east of the Llagas Creek at the City Sewer Farm.
Motion by Councilman Kennedy, seconded by Councilman Gallo that all
bids for the bridge across the Llagas Creek at the City Sewer Farm
be rejected.

In the absence of His Honor Mayor George M.Mason the City Clerk

calls this adjourned meeting of the Common Counc~l to order.
Present:Councilmen Carl W.Pate,Charles Gallo,J.Hughes Kennedy,
Courtland M.Rush,Kenneth L.Petersen,Segundo Sanchez.
The Clerk now calls for nominations for Mayor Pro-tern.
Motion by Councilman Sanchez, seconded by Councilman Gallo and
carried that Councilman Kennedy be Mayor Pro-tern.

The Clerk reports a telephone conversation with Mr.William Radtke,
Sr. of the firm of William Radtke and Son, Contractors, relative to
the matter of postponing the awarding of the bid for the contract
to construct a bridge across the Llagas Creek at the City Sewer
Farm for thirty days and that Mr.Radtke had agreed to the reauest
providing his steel supplier will guanantee the figures quoted to
Mr.Radtke for a period of thirty days.
The matter of the type of bridge called for in the specifications
is discussed.
Motion by Councilman Rush,seconded by Councilman Pate that the
award of the contract to construct a bridge across the Llagas Creek
at the City Sewer Farm be postponed for a period no longer than 30
days, subject to the approval of William Radtke & Son, contractors; WI
that if the cODtractor advises that his bid will not stand, then,
that all bids will be rejected.
Councilman Rush agrees and Councilman Pate who seconded the motion,
consents to withdraw the motion.
The City Attorney now presents and reads RESOLUTION NO.381.
Motion by Councilman Rush,seconded by Councilman Pate that
RESOLUTION NO.381 be adopted.

RESOLUTION CONDITIONALLY POSTPONING AWARDING OF CONTRACT FOR THE
CONSTRUCTION OF THE LLAGAS CREEK BRIDGE FOR THIRTY DAYS.
WHEREAS, the City of Gilroy through its Common Council, has
heretofore advertised for bids for the construction of a bridge
over the Llagas Creek to provide access to and from a firty-seven

WHEREAS, bids for said bridge have been received and considered
and the bid of Wm.Radtke and Son for $8353.00 for a reinforced
steel and concrete bridge, under Alternate No.2 Proposal, set forth
in the plans, proposals and specificationsx forms under which said
bid was submitted, is the lowest bid of any submitted by a
qualified bidder, and
WHEREAS, the said Common Council,in considering said bids,has
determined, in view of the amount of the said lowest bid, that it
may be advisable to sell the said forty-seven acre tract of land
and not build said bridge,or,if said land is retained,to build a
less expensive bridge, and desires to postpone awarding said
contract for a period af thirty days, instead of the three days
provided for by the proposal forms,to allow time to further
investigate and determine said matter,and has reauested said

Wm.Radtk~ and Son to keep its said bid binding and in effect for
said period of thirty (30) days, within which the said City may
accept or reject said bid.
NOW,THEREFORE,BE IT RESOLVED that the awarding of said contract
be postponed for a period not over thirty days from the date of the
adoption of this resolution, subject to the approval and consent of
Wm.Radtke and Son, and if such consent and approval is not given in
writing on or before June 4,1956, then all bids submitted for said
project, including that of said Wm.Radtke and Son,shall be auto-
matically stand rejected.
