In the absence of His Honor Mayor George C.Milias the City Clerk
calls this meeting of the Common Council to order at 8 o'clock p.m.
Present:Councilmen Carl W.Pate,Sig Sanchez,Charles Gallo,Kenneth
1.Petersen,Courtland M.Rush,Everett C.Wentworth.
The City Clerk now calls for nominations for the office of Mayor
Pro. tern.
Motion by Councilman Rush,seconded by Councilman Sanchez and
carried that Councilman Pate be Mayor pro-tern.
Councilman Sanchez,cpairman of the Police Committee, reports that
his committee met with the Superintendent of Schools and his
assistant to discuss the matter of protection for school children
crossing the intersection of First and Hanna streets;that the
Superintendent of Schools had reported, since the meeting, that the
County Counsel had advised that the schools could not pay any of
the costs of maintaining crossing guards. Councilmen Gallo and
Wentworth report their investigation of the matter of the schools
participating in paying a portion of the cost of crossing guards
in Hollister and had found that the City of Hollister pays the
entire cost xof maintaining crossing guards.
It is unanimously agreed thettth~-matt~rofproviditig ~ crossing
guard at FIrst and Hanna streets be referred to the Finance Committee
for investigation and report at the next meeting.
His Honor Mayor George C.Milias is now present and occupies his
chair at the Council tagle.
The City Clerk reads a letter from the Division of Highways with
refereneeto making a study of speed limits on First Street and
North Monterey street.
This being the time specified in a legal notice calling for bids
for improvements at the Gilroy Public Library building two bids are
presented and read:
Gordon E.Farotte-all work in accordance with plans and specifications-
prepared by Higgins & Root-$l7,093.00 .
Alternate No.l-$2,088.00.
George G.Renz Construction Company-all work in accordance with plans
and specifications perpared by
Higgins & Root-$17,860.00.

Alternate No.l-$2,400.00.
It is unanimously agreed that the bids be referred to the
Buildings and Grounds Committee, the Finance Committee and the
Gilroy Public Library Board for discussion and report to the
Council. Mr.Root of Higgins & Root,architects,states that h~~ill
advise the Library Board of the Council's decision and that the
meeting date has been set for November 27,1956.
Motion by Councilman Pate,seconded by Councilman Wentworth and
carried that action to award the bid for the library improvement
work be deferred until the Council committees-Finance and Building
Grounds-report the the Council.
Councilman Pate presents and reads a letter from the Continental
Service Company with reference to the purchase by the city of the
old Bank of America property-the company stating that they will
hold the property for the city until January,1957.
Motion by Councilman Pate, seconded by Councilman Rush and carried
that a letter be written to the Continental Service Company stating
that the city would be ready to consumate the transaction for the
~urchase of the old Bank of America property for the sum of
$17,500.00 cash by January l5,l957.
Councilman Pate reviews the progress to date in the widening
of the Lewis street bridge and states that the Building Inspector
has held a conference with Martha Rodriguez,owner of property
adjacent to the bridge, with reference to using some of her prop-
erty during the construction period and that the property owner
has made a request that the bulkhead on the west bank of the
slough be strengthened.
It is unanimously agreed that the City Attorney write a letter
to Martha Rodriguez advising hetithat the city will provide the
bulkhead work, requested by her,~ext year.
Councilman Pate reports that he has nothing to report on all
night parking on Eigelberry Street.
Councilman Sanchez reports that he has met with the school
trustees and school architect to discuss further the matter of
constructing a swimming pool on high school property. The school
architect is gathering more information on the subject which will
be presented at a meeting in the near future.
It is unanimously agreed that the pine tree located on the rear
of city property at Monterey and I.O.O.F.Avenue should be removed
and the Building Inspector is authorized to contact Eugene Crocker
to do this work.
Councilman Pate reports on the meeting of the Peninsula Division
of the League of California Cities held at Millbrae recently,
stating that Councilman Petersen and the City Clerk accompanied
him on the trip.
Councilman Gallo reports on his conversation with the property
owner at the southeast corner of First and Hanna streets with
reference to removing shrubs and trees that are making this
intersection dangerous. The Clerk is instructed to request per-
mission of the Division of Highways to remove two old walnut trees
located on the south side of First Street a short distance from
the east line of Hanna street.
Councilman Rush reports that a recent storm sewer improvement on
south Church street between 7th and 8th streets in proving to be a
hazard to children. It is unanimously agreed that metal bars should
be welded into the catch basin to remove the hazard.
Councilman Petersen discusses the installation of Christmas lights
in the park at Monterey and I.O.O.F.Avenue. It is unanimoasly agreed'
that Hollenback Electric be contacted for the lights for the tree
and the city crew to instal the lights.
A communication signed by officers of the Churmof Jesus Christ
of the Latter Day Saints requesting water service for a proposed
church and youth recreation center to be constructed on the west
side of Miller Avenue between Hecker Pass Highwayx and Gilroy City
Limits is presented and read. Mayor Milias agrees to accompany Mr.
W.E.Jordan,presidant of the Gilroy Brankh of the church,on a visit
to the residents of the area to discuss with them the possibility
of annexing their property to the city.
The Clerk is instructed to obtain a map o~ the area under dis-
cussion and the names of the several owners of the property.
Councilman Sanchez discusses the possibility of raising water
rates. This matter is referred to the Water Committee for invest-
igation and report to the Council.
Councilman Petersen presents the report of the Buildings and
Grounds Committee with refeeence to fees for rent of Wheeler
Auditorium and other regulations.

Motion by Councilman Petersen, seconded by Councilman Sanchez and
carried that the following fees and regulations apply' to Wheeler
Auditorium: nightly rate-where admission is charged-$60.00; nightly
rate-where no admission is charged-$30.00;that at the time of
issuance of the permit for use of the auditorium a deposit of $25.00
be made by the rentor to cover cost of any damage that might occur
to the building-the rentor to sign such an agreement;that inspection
of the condition of the premises shall be made within twenty-four
hours for damage,if any;that waiver of deposit in cases of free use
of the building shall be at the discretion of the Council;that in all
cases in which free use of the building is requested approval must be
obtained from the Council;that a condition of the rental agreement
shall be that an officer or authorized person shall remain at the
entrance door and refuse entry to any person having metal cleats on
their shoes;that in cases where food is served the auditorium floor
shall be covered temporarily to prevent damage to the floor;that
the new rates and regulations apply immediately except for those
dates that have been made up to this date.
A communication is read from the Instructor of Music of Gilroy
High school requesting permission to use Wheeler Auditorium for
the annual Christmas program given by the high school students.
Motion by Councilman Pate, seconded by Councilman Sanchez and
carried that Gilroy High School be granted permission to use
Wheeler Auditorium for their annual Christmas program, December 19,
1956,free of charge.
The funds remaining to the credit of the city in the state's
Chapter 47 funds amounting to $3003.00,is discussed.lt is unanim-
ously agreed that the Water Committee, the City Clerk and the City
Engineer meet and draw applications for these funds.and have them
ready for the Council for the first meeting in December.
The City Attorney presents and reads RESOLUTION NO.404.
Motion by Councilman Petersen, seconded by Councilman Pate that
RESOLUTION NO.404 be adopted.
RESOLUTION NO.404
ESTABLISHING A PARKING COMMISSION FOR THE CITY OF GILROY.
WHEREAS, the business houses along Monterey Street,in the City of
Gilroy,which constitute by far the main business district in the said
City,are confronted with the very serious problem of maintaining
their businesses with the present limited parking facilities to be
found in the City of Gilroy,and
WHEREAS, experience in other cities has shown that the shopping
public will trade with the establishment which provide easily
available parking facilities, and that business houses which do not
have said facilities suffer a great or considerable loss of business,
and
WHEREAS, the most valuable property in the City of Gilroy is that
located along Monterey Street, which is the main business street in
the City and any coniserable loss of business by the mercantile and
other concerns located along said street will result in vacancies
and a deterioration in the value of the property,as well as a loss
in the tax base of the City of Gilroy,and
WHEREAS, the Common Council of the City of Gilroy believes that
the values of the property along Monterey Street should be maintained
~nd that parking facilities should be made available for the business
houses along the said street and that an immediate investigation and
study should be made of said parking problem, with the object of
providing off-street parking facilities, and it is the opinion of this
Common Council that such investigation should be made by an independent
commission or committee,and that this commission should be appointed
by the Mayor.
NOW,THEREFORE,BE IT RESOLVED:
That there shall be,and is hereby, established a commission to
be known and designated as the Off-Street Parking Commission,to be
composed of five members ,all of whom shall be appointed by the
MaTor of the City of Gilroy,with the approval of the Common Council,
and that the duty of said commission shall be to study the parking
problem of the City of Gilroy,particularly pertaining to business
establishments along Monterey Street,to investigate the availability
of land that may be secured for Off-street parking facilities, the
price asked for property for that purpose, and the fair price which
should be paid for such land, and that the commission,in determining
the location of various possible pariing areas,bear in mind not only
the present conditions,but the future growth of the City,so that
parking facilities cae be provided for all the business district.
BE IT FURTHER RESOLVED:

That the said commis$1on make such investigations and study
and report back to this Common Council at the earliest possible
date,and that when the members of the Commission have beeb selected
that the City Clerk notify each appointee of his appointment.
