Minutes 1957/06/03 10n/! J_ I) ri '':t Gilroy, California June 3,1957. This regular monthly meeting of the Common Council is called to order by His Honor Mayor George C.Milias. Present: Councilmen Carl W.Pate,Charles Gallo,Kenneth L.Petersen, -----lrourtland M.Rush,Everett C.Wentworth. Absent:Councilman Sig Sanchez. -'The Mayor now calls upon Rev. Ernest Tufts of the Presbyterian Churhh to give the invocation. The Mayor now asks if all 60uncilmen have received copies of the minutes of the regular monthly meeting of May $th,the regular adjour- ned meeting of May 13th and the regular adjourned meeting of May 20th, 1957. All Councilmen answer in the aftirmative~ The Mayor now asks it there are any errors or corrections to be made in the minutes as presented. No errors or corrections are noted. The Mayor now declares the minutes of the regular monthly meeting ot May 6th and the regular adjourned meetings of May 13th and May 20th, 1957, approved. A communication with a lease attached is read from the Southern Pacific Company offering to lease to the city for parking lot purposes a piece of land east of the alley between Lewis Street and Monterey Street for $225.00 per year. This matter is referred to the Buildings and Grounds Committee. A communication is read from the County Tax Collector advising the Council the the taxes for 1956-57 on the old Bank of America property purchased by the city,are delinquent.c This matter is referred to the City Attorney to prepare the necessary papers to present to the Board ot Supervisors requesting cancellation of the taxes. A schedule of cost to retire the debt on the Monterey Street electrolier system is presented and referred to the Finance Comm- ittee. A communication 1s read from the '~te~ans of Foreign Wars re- " ques.tlng a donation to be used to stage their 8th annual Pre-Gymk- parade. - .... ,p.,.,,~ ~,..;fi "".-. - 1835 Motion by Councilman Rush,seconded by Councilman Wentworth and carried that the sum of $100.00 be given tbpthe Veterans of Foreign Wars to assist them in defraying expenses conn~cted with their 8th annual pre-Gymkhana parade. A copy of a communication from the County Counsel addressed to the Superintendent of Schools with reference to the roots of trees located along the south line of the Severance school property damaging the adjoining property owners property and giving his opinion that the school trustees and the adjoing property owner can reach an agreement,is presented and read. Councilman Pate reports that he has discussed the matter with the school authorities and this matter will be taken care of. A communication is read from the Girls League thanking the Council for the use of Wheeler Auditorium for their Mothers and Daughters banquet. A communication is read from the Corps of Engineers,U.S.Army, advising the Council that they have inspected the levee work maint- enance on the Uvas and Llagas creeks and have found the work satis- factory. A communtEation is read from the Southern Pacific C.mpany advising the Council that they will give thorough study and consideration to the city's request that the speed of trains through Gilroy be re- duced to 25 miles per hour when the city places arterial "STOP" signs at all railroad crossings within the city limits. The City Attorney reports on his findings with reference to the extension of Forest Street to Ninth Street;that the east 371 feet belongs to the city.The matter of making the street the same width as Forest Street by obtaining addition land from John Triola is r~ferred to the Buildings and Grounds Committee. _ Councilman Sanchez is now present. and occupies his seat at the Council table. , The City Engineer is instructed to prepare a plat of the proposed extension of Forest Street from 8th to 9th street. Councilman Pate reports that the Pacific Gas and Electric Company has presented its check in the amount of $6115.16 which represents the difference between the pegged"':payment amounts and the amount due under the franchise plus five per cent interest from 195i to 1957. Councilman Gallo reports that three property owners residing on Oak Court will not give easements necessary for overhead wires for street lights;that the property owners concerned are willing to pay the amount set forth in the special assessment schedule but they do not want the street light on Oak Court. The City Attorney suggests that the only way to clear this matter is to file condemnation ,-- proceedings against the owners in question. Motion by Councilman Pate,seconded by Councilman Rush and carried that the City Attorney be instructed to institute condemnation pro~eedings against the properties which will not give easements for street lights on Oak Court. Councilman Petersen recommends Mr. James Jepsen to represent the city in ascertaining foom property owners if they will lease, sell or otherwise dispose of their property for parking lot purposes. Motion by Councilman Petersen, seconded by Councilman Pate and carried that Mr.James Jepsen be appointed to interview property owners on leasing or selling their property for parking lot purposes; that his salary be set at $1.00 per year. Councilman Sanchez reports that the engineer for the South Santa Clara Valley Water Conservation District will prepare a sketch of the city'S requirements at the Uvas Dam. Councilman Rush reports that the Division of Highways has a spray rig to dispose of for the sum of $175.00. Motion by Councilman Rush,seconded by Councilman Petersen and carried that the city purchase from the Division of Highways the Hardie Spray Rig t,he have for sale at their Norbh Hollywood Yard for the sum of '175.00 ~lus the cost of transportation from Holly- wood to Gilroy. City Attorney states that he has no report on the state retire- ment plan. Motion by Councilman Sanchez,seconded by Councilman Pate and carried that the Police Committee inspect the aFord 6 Panel Truck the Div- ision of Highways will have for sale within the next 60 days and if found satisfactory that the truck be purchased for the sum of $350.00. Councilman Pate reports that the County has presented its require- ments for the extension of Alexander Street from 8th to 9th streets, The City Engineer's office will contact the Purity Stores, Ltd. and . ""->ill" --- 18~jb advise them of his estimated cost to do the street work connected with the extension of Alexander Street from gth Street to 9th Street. The Building Inspector presents two requests from Foster & Kleiser for signs on south Monterey Street-one sign on Southern Pacific property and other on the west sideD of Monterey Street between gth and 9th Streets. Motion by Councilman Petersen,seconded by Councilman Rush and carried that the permits requested by Foster & Kleiser to erect signs on the Southern Pacific Company's property on South Monterey Street and a sign on the west side. of Monterey Street between gth and 9th streets be granted providing the requests meet with the approval of the Building Inspector. Mr.William Steinberg,representing the Gilroy Auxiliary Poeice,now appears before the Council and presents proposed amendments to their By-Laws. This matter is referred to the City Attorney for a report at the next meeting of the Council. Councilman Sanchez discusses the matter of reducing the bicycle license fee from $1000 to 50~. The City Attorney is instructed to prepare an amendment to the bicycle license ordinance embodying the proposed change in fees. Councilman Sanchez reports that Dr. Robert Young of the County Planning office has advised him that the city's request for the County Planning office to make a land use survey in Gilroy is now on the County Executive's desk and Dr.Young has advised that the cost to the city will be considerablj less than the first figure he presented. It is agreed that the city will move on this matter just as soon as the contract with the county is received. A general discussion is had on the two proposed routes for the freeway that has been proposed by the Division of Highways and the County Planning office. The matter of caring for injured persons needing hospital care is left to the judgment of the police officers. Councilman Gallo reports that a tree in the alley between Lewis and Martin streets i8 interfering with lighting in the alley and states that the cost of removing the tree would be $40.00. Motion by Councilman Gallo,seconded by Councilman Wentworth and carried that the tree in the alley between Martin and Lwwis streets be removed at a cost of $40.00. Councilman Wentworth states that the specifications for the 5th Street-Miller Avenue storm drain will be re~dy for the next Council mmeting. Councilman Rush states that he is awaiting a reply from the Southern Pacific Company on the city's proposal to erect abterial "SlOP" signs at all railroad crossings in the city and the city's request that the company reduce the speed of trains through Gilroy to 25 miles per hour. Councilman Pate reports that he has discussed the elementary school district's request to remove the trees in front of the Jordan school with the school authorities and they have been advised to contact the Forestry Board on this matter. It is agreed that the school be given permission to remove the trees to repair the side- walk but that the parking strip be re~lanted with trees with a different root system than the present trees. Councilman Pate discusses the substitute street for Forest Street from I.O.O.F.Avenue to Leavesley Road and it is unanimously agreed that the right of way should be 60 feet wide and the roadway 30 feet wide. The Mayor now discusses a traffic count on First Street at Hanna Street and the count of children using this crossing is presented. The Building Inspector states that the vehicle traffic count on First Street at Hanna Street will be taken with a counter borrowed from the County. The Mayor asks if the Council is agreed that he should continue his attempt to have the state erect and automatic. traffic signal at this intersection. The Council agrees that further effort should be made to have an automatic traffic signal installed. The Mayor discusses the proposed county-wide highway survey and states that if the County Planners are going to make a land use survey in the area the highway survey should be made to tie in with this survey. It is unanimously agreed that the Street Committee investigate the proposed county-wide highWBY survey further. Reports of the Bumlding Inspector,Police Department,Poundmaster, County Controller and the County Health Department are presented and read. Motion by Councilman Sanchez, seconded by Councilman Wentworth and carried that these reports be accepted as read. ..... ....... ... .... IIIIlIIII ~ 1837 An amendment to the Maintenance Agreement with the Division of Highways is presented and read and Resolution No.i~2 is presented and read. Motion by Councilman Pate, seconded by Councilman Gallo that RESOLUTION NO.432 be adopted. RESOLUTION NO.432 RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF GILROY APPROVING AMENDMENT NUMBER 2 TO AGREEMENT FOR MAINTENANCE OF STATE HIGHWAY IN THE CITY OF GILROY. WHEREAS, the State of California, through its Department of Public Works, Division of Highways,has presented Amendment Number 2 to the Agreement for Maintenance of the State Highway in the City of Gilroy, dated July 1,1957; WHEREAS, the Common Council has heard read said Amendment Number 2 in full and is familiar with the contents thereof; THEREFORE, be it resolved that the Common Council of the City of Gilroy that said Amendment Number 2 is hereby approved and the Mayor and the City Clerk are directed to sign the same on behalf of said x City. It is suggested that the City Marshal contact the A.B.C. Board with reference to this latter matter. Reports of City officers are presented and read. Motion by Councilman Rush.seconded by Councilman Wentworth and carried that the reports of City officers be accepted as r.ad and placed on file. Motion by Councilman Pate, seconded by Councilman Rush and carried that bills as presented be allowed and warrants ordered drawn on the Treasurer.
