This regular monthly meetin~ of the Common Council is called
to order by His Honor George C. Milias.
Present: Councilmen Carl W. Pate, Courtland M. Rush, Kenneth
L. Petersen, Sig Sanchez, Everett C. Wentworth, and Charles Gallo.
The Mayor now asks if all Councilmen have received copies of
the minutes of the regular monthly meeting of January 6th and the
regular adjourned meeting of January 20th.
All Councilmen answer in the affirmative.
The Mayor now asks if there are any errors or omissions in
the minutes as presented.
No errors or omissions are noted.
The Mayor now declares the minutes of the regular monthly
meeting of January 6th and the regular adjourned meeting of Jan-
uary 20, 1958 approved.
A letter from Sterling Lumber Company regarding the removal
of the building on the Southern Pacific property is read and
ordered to be placed on file.
A communication from the Health Department declaring Santa
Clara County as a rabies area is read and ordered to be placed

A letter from the Gilroy Garbage Disposal Company request-
in~ nermission to raise the garbage rates is read. Motion by
Councilman Wentworth second by Councilman Pate and carried that
the request from the Gilroy Garbage Disposal Company be referred
to the Sewer Committee for study and recommendation to the Council.
Councilman Petersen, Chairman of the Buildin~ and Grounds
Committee, renorts that the Committee has given the heatin~ and
air-conditionin~ bids for the proposed new city offices complete
study and- recommends that the Council accent the low bid of Larkin
Sheeb Metal. Motion by Councilman Peterse~ second by Councilman
Sanchez and carried that Larkin Sheet Metal be awarded the '1eating
and air-condi tioninp: contract for Proposal ill, for the sum of -

~4052.35, as recommended by the BUlldlngs and Grounds Commlttee.
Councilman Petersen states that he has received a letter ~uarantee-
ing the Derformance of the eauinment.
. The- City Administrator asks for authorization from the Coun-
cil to advertise for bids for alterations at the new city offices.

carried that the plans and specifications for the alterations at
the new City offices as submitted by the City Engineer be approved.

carried that the City Administrator be authorized to advertise for
bids for the alterations at the new City offices.
The Mayor now asks if the City Attorney has revised the
Ordinance regarding the installation of butane tanks. The City
Attorney presents and reads Ordinance No. 565. Motion by Council-
man Gallo, second by Councilman Sanchez that Ordinance No. 505
be adopted.

AN ORDINANCE AMENDING ORDINANCE NO. 420 OF THE CITY OF GILROY BY
ADDING A NEW SUBDIVISION TO SECTION 12 OF SAID ORDINANCE TO BE
KNOiJvN AS 12 (d) PERMITTING THE STORAGE OF NOT IN EXCESS OF ONE
THOUSAND (1000) GALLONS OF PETROLEUM PRODUCTS OR HYDROCARBON
LIQUID DURING AN EMERGENCY.

The City Clerk reports that a satisfactory bond has been fur-
nished for Castlewood Park Unit No. 3. r~e City Attorney reports
that this matter is now in order and that Castlewood Park Unit No.
3 had been approved at a previous Council meeting with the pro-
vision that the nroner bond be furnished and the contract si~ned.
Councilman Sanchez reports on the interest rates and require-
ments for a proposed loan,from the Community Facilities A~ency.
He reports that in order to qualify for a loan the City must be
turned down by three private agencies, and the rate of interest
is 4 1/8% on a thirty (30) year loan and for every five years less
than thirty (30) years the interest rate drops 1/8 of 1% and also
that the City must hold an election. Councilman Sanchez suggests
that the City Administrator and City Engineer discuss this matter
further with the Community Facilities Agency. Councilman Pate
suggests that the City Administrator contact Mr. v.~. Lundy to
discuss the matter further. Councilman Sanchez suggests that the
City Administrator contact ~lr. Lundy and arrange a meeting with
the Council. '
The City Clerk reports that Mr. V. N. Lundy has advised the
City to sell its Treasury certificates. Motion by Councilman
Pate second by Councilman Sanchez and carried that V. N. Lundy be
advised to sell the Treasury certificates and that the money be
deDosited in the bank.
. The City Administrator reports that the deeds for the alley
between Seventh and Eighth Streets and between '{anna and Dowdy
Streets are in order and are ready for recordation.
The City Administrator reports that he has received a model
license ordinance from the League of California Cities, for in-
formation to aid in making the proposed changes in the present
license ordinance. This matter is referred to the Ordinance Com-
mittee for further study.
The City Clerk states that the Inter-City Council I'1eeting on
February 6, 1958 at Santa Clara will be on municipal management.
The City Clerk presents and reads the quarterly auditor's
report from Log?n and Frazer. Motion by Councilman Pate second
by Councilman Wentworth and carried that the quarterly auditor's
report of Logan-and Frazer be accepted as read.
Reports of the Police Department, the Building Inspector,
and the Poundmaster are presented and read. I'lotion by Council-
man Petersen second by Councilman Wentworth and carried that these
renorts be accented as read.
. Councilman W~ntworth proposes that an investigation be made
into the matter of changing the present City charter. He states
that he is in favor of creating a City Manager form of govern~
mente The City Attorney renorts on the variations in the dif-
ferent types of charters, the City Manager form of government
including the City Manager's nowers, and the powers granted under
the administrative form of government, and he also states that
our present City Charter cannot be changed by amendment. Council-
man Wentworth suggests that this matter be held in abeyance until
the salary survey is completed and then referred to committee for
study. The Councilmen were in agreement with this suggestion.
Motion bv Councilman Pate second bv Councilman Sanchez and
carried that C. B. Carr, City Administr~tor be given a vote of
confidence.
The Mayor reports that the State has included in the budget
~75,OOO.00 for a National Guard Armory in Gilroy.
The City Attorney recommends that the Council accept the
deeds for the alley on Seventh and Eighth Streets and Hanna and
Dowdy Streets. Moiion by Councilman ~ate second by Councilman
Rush and carried that the deeds for the alley between Seventh
and Eighth Streets and between Hanna and Dowdy Streets be
accented.
. The Mayor asks the government students from the I}ilroy High
School who ~re present if they have any questions. There are no -
questions as ked. ,
At this time Mr. Lou Clark comes before the vouncil request-
ing that further consideration be given to his request to install
an underground gasoline tank at his place of business. This
matter is referred to the Public Health and Safety Committee for
consideration.
Reports of City Officers are Dresented and read.

Motion by Councilman Pate second by Councilman Rush and
carried that bills as presented be allowed and warrants ordered
drawn on the Treasurer.
At this time the r~ayor reports that he will not be a candi-
date for Mayor in the next election and expresses the pleasure
afforded him in working with Councilmen and City employees dur-
ing his long tenure as Councilman and Mayor.
The City Attorney congratulates Mayor George Milias on his
apDointment by the governor to serve as an officer in the govern-
ment of the State of California.
Motion by Councilman Pate second by Councilman Gallo and
carried that this meeting adjourn to Ilonday, January 17, 195Q, at
8 o'clock p.m., Council Chambers, City Hall, Gilroy, California.
