This regular adjourned meeting of the Common Council is
called to order by his Honor George c. Milias.
Present: Councilmen Carl W. Pate, Courtland M. Rush,
Kenneth L. Petersen, Everett C. Wentworth, Charles Gallo, and
Sig Sanchez.
A resolution from the Planning Commission recommending the
rezoning of certain property north and south of I. O. O. F.
Avenue from "En to "B" District is read. Resolution No. 458 con-
cerning the re-zoning from Zone "E" District to Zone "B" District
is presented by the City Attorney. Motion by Councilman Sanchez
second by Councilman Gallo that Resolution No. 458 be adopted.

WHEREAS the City Planning Commission of the City of Gilroy has
reported, found and reco~ended that Ordinance No. 422 of the
City of Gilroy, commonly known as the Zoning Ordinance, be
amended by re-zoning from Zone "En District to Zone "B" District,
the following described premises, to wit:

A letter from Congressman Charles Gubser explaining the
status of National Guard A;mories in the 10th District is read
and ordered to be 'placed on file.
A communication from the Wheeler Rospital Auxiliary is
read requesting permission to stage a festival on the Wheeler
Auditorium grounds. Motion by Councilman Pate second by Council-
man Petersen and carried that the request from the Wheeler Hos-
pital Auxiliary to hold a festival on May 17th on the Wheeler
Auditorium grounds be granted free of charge and that Sixth
Street between Church and Rosanna Streets be blocked off from
12:00 to 9:30 p.m. on that date.
A letter from the I.F.D.E.S. is read requesting permission
to hold a parade on May 11th. Motion by Councilman Wentworth
second by Councilman Petersen and carried that the I.F.D.E.S.
be granted permission to hold a parade on May 11th, 1958.
Councilman Pate introduces Mrs. A. Barnett leader of the
4-H group and Mrs. R. Snyder Assistant. Marie Scovel, President
of the 4-H group, presents a waste can, a donation to the City,
which is to be placed on Monterey Street. The Mayor thanks the

4-H Club for the gift. Mrs. R. Snyder states that the waste
can cannot be used until the liner for the can, which has been order-
ed, arrives.
At this time there is a hearing on the Miller Avenue annexa-
tion. The Clerk states that the notices of the proposed annexation
have been mailed to the property owners. The Mayor asks if there
are any protests. There are none. The Clerk reports that the total
assessed valuation of the land in the area is $2860.00.
Jesolution No. 459 is presented by the City Attorney. Motion
by Councilman Pate second by Councilman Rush that Resolution No. 459
be adopted. ~

A Resolution No. 459 calling election for annexation of the Fourth
Western Addition.

The election in the 4th Western Addition is set for April
17, 1958. The Polling place will be at Mrs. Doris Williams' resi-
dence at 451 Miller Avenue. Mrs. Doris Williams is appointed as
Inspector and Mrs. Ruth Sargent and Mrs. Constance Johnson are
appointed as Judges. The Clerk is also instructed to notify by Mail
the people appointed to act as Inspector and Judges.
The City Administrator reports that the City Engineer, Mr.
V. Lundy and himself met with the Community Facilities Administra-
tion to further investigate interest rates on the proposed bond issue
for the water pipe line from the Uvas Daa. The City Administrator
states that he believed that the City would have same difficulty ~
in qualifying for a loan from this agency. He also states that
Mr. V. Lundy would meet with the Council if it so desired, and ex- ~
plain his conception of the proposed loan. This matter is tabled.
The City Administrator reports that he has received a
model license ordinance from the League of California Cities and
license ordinances from various cities to help in a study of pro-
posed changes in the Cit~'s licenses for service stations, volume
business and retail truck delivery. He states that the entire
license ordinance should be studied and that he was preparing a
chart of the licenses charged in various cities Bnd would have it
read to present to the Ordinance Committee within a week.
The City Administrator reports that he has prepared ten-
tative increases in the garbage rates. This matter is referred to
the Ordinance Committee for study.
The City Clerk reports that the only information he has
received concerning the possibility of installing an underground
tank in Lou Clark's building is the recent copy of the Board of
Fire Underwriters Code for storing inflammable aiquids. Mr. Lou
Clark comes before the Council and asks if there is any possibility
of changing the present Fire Ordinance, regarding underground
storage within a building. Councilman Gallo reports that he is
not in favor of installing an underground tank inside of any build-
ing. Councilman Rush advises Mr. Lou Clark to install the tank
under the sidewalk outside of the building. The possibility of
changing the ordinance for the amount of gasoline that can be ~
stored in a tank underground outside of a building is referred to I i
the Ordinance Committee for further study. --
An application for a transfer of off-sale beer and wine
license from Joe Leon for Joe's Market is read and there being no
objection it is ordered filed.
Reports on water samples taken by the Santa Clara County
Health Department on January 30th and February 6th are read.
These reports are satisfactory and are ordered filed.
At this time the representative from the Associated Con-
sultants presents his salary survey and job classification plan.
Councilman Pate recommends that no action be taken on the
salary survey at this time but that it be referred to a committee
of the whole in order to give the Mayor and Councilman Gallo to

study the plan. Wednesday, February 19th at 8:00 p.m. was
set as the time for the committee meeting.
Mr. Joe P~tane who resides on Rucker Avenue appearsJ
before the Council regarding the proposed plan for the incor-
poration of San Martin. He states that those who live on and
south of Church Avenue do not wish to be incorporated within
the City limits of San Martin. Mr. Ellis Bogle residing on
Masten avenue and Mr. Barney Harris who resides on Monterey
Highway also appeared before the Council protesting the territory
to be included in the proposed incorporation of San Martin.
It is brought out that Church Avenue is the northern Boundary
of the Gilroy Union High School District and that peop~e re-
siding in that area considered themselves part of the trading
area of Gilroy.
Motion by Councilman Wentworth second by Councilman
Pate and carried that the City Clerk write a letter to the
County Planning Commission and the San Martin Civic Improvement
Group recommending that the southern boundary line for the pro-
posed incorparation of San Martin be reconsidered and that
members of the City Council would be glad to meet with the
SannMartin Civic Group and discuss the matter.
Councilman Sanchez reports that the Police Department
needs new police cars and recommends that the Council con-
sider advertising for bids for two new cars. This matter is
referred to the Police and Financ~ Committees for study.
Councilman Sanchez reports that the Water Committee
will have a future meeting on the water project.
Councilman Pate states that the salary survey and
classification plan should be kept in confidence until after
the Committee of the Whole meets.
Mr. Patane thanks the Council for the time given him
and his group.
There being no further business this Council meeting
is adjourned.
