This regular monthly meeting of the City Council is called to order by
His Honor Sig Sanchez.
Present: Counci I Members: Goerge T. Duff in, No.rman B. Goodr i ch, WI I ford
E. Jordan, Kenneth L. Petersen and Sig Sanchez.
Absent; Council Members: Charles F. Q.uartl roll, and Ev~rett C. W,entworth.
The Mayor asks If all Councilmen ~resent have received copies of the
special meeting of June 30th and the regular meetings of July 3rd and 17, 1961.
All Counci lmen present answer In the affirmative. The Mayor now asks If there
are any errors or omissions In the minutes as presented. No errors or omissions
are noted. Motion by Councilman Goodrich second by Councilman Jordan and car-
ried that the minutes of the special meeting of June 30th and the regular meet-
Ings of July 3rd and Ii, 1961 be approved.
Appl ications for I iquor I icenses from the following are presented: Andrew
Trlnchero at 381 First Street for off-sale general, Food Villa Inc. at 471 South
Monterey for off-sale beer & wine,' Leo F. Arzie for Wlllow's Club at 741 North
Monterey Street for on-sale general, and Dixie & Henry Del Blaggio for adding
wife at 445 FI rst Street for off-sale general. There are no objections to the
applications. ·
Councilman Wentworth enters and takes his ,seat at the Council table.
City Administrator Carr reports that Mr. A. R. Charvez has requested to
deed a portion of his property for an alley between Eighth & Ninth Streets and
Rosanna & Hanna Streets.
Discussion is had.
The Mayor Instructs City Administrator Carr to determine from the Title
Company if any other deeds are recorded for the alley between Eighth & Ninth
Streets and Rosanna & Hanna'Streets and to report back to the Council at the
next meeting. ,
, A report from the Planning Commission Is read recommending the following:
Zoning of Castlewood Park, Unit No.3, amending the zoning ordinance to. include
an "S" Zone, and on a recrea.t I on a rea site.

The City Attorney presents and reads Resolution No. 632. Motion by
Councilman Duffin second by Councilman Wentworth that Resolution No. 632 be
adopted.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY FIXING THE TIME AND PLACE
OF HEARING THE REPORT OF THE PLANNING COMMISSION FINDING AND RECOMMENDING THE
ADOPTION OF AN AMENDMENT TO THE ZONING ORDINANCE OF THE CITY OF GILROY, FORMER-
LY ORDINANCE NO. 422, AS NOW SET FORTH IN THE APPENDIX "A"IN THE CODE OF THE
CITY OF GILROY BY PROVIDING FOR SUPPLEMENTARY OR COMBINED DISTRICTS OR ZONES
TO BE KNOWN AS "S" DISTRICTS.

A report is read from the Recreation Commission regarding a recrea-
tion area site. Discussion is had concerning property offered 'to the City of
Gilroy by Mr. and Mrs. Sydney Johnson for a recreation area.
City Administrator Carr reads a proposed agreement between the City
of Gilroy and Mr. and Mrs. Sydney Johnson for purchase of property located
at "Christmas Hill" for a recreation area site.
Discussion is had.
Councilman Duffin suggests that the name of this proposed recreation
area site be changed from IIChristmas Hill park" to "Sydney Johnson Park'.. Mr.
Johnson requests that the name of the recreation area remain "Christmas Hi 11
Pa rk".
Motion by Councilman Goodrich second by Councilman Jordan and carried
that the City of Gilroy enter into an agreement with Mr. and Mrs. Sydney
Johnson for purchase of property offered for a recreation area site.
'City Administrator Carr reports that the ordinance controlling the
height of hedges and other obstructions that was introduced at the last Coun-
cil meeting Includes fences and trees and that these objects should be elim-
inated from the ordinance.
Discussion is' had.
It is decided that the proposed ordinance shall be rewritten.
City Administrator Carr presents Ordinance No. 657. Motion by Council-
man Goodrl~h second by Councilman Jordan that Ordinance No. 657 be adopted.

AN ORDINANCE OF THE CITY OF GILROY ADDING CHAPTER ;lOA TO THE GILROY CITY CODE,
PROVIDING FOR THE CONSTRUCTION OF SIDEWALKS, CURBS AND GUTTERS, ESTABLISHING
A PROCEDURE THEREFOR, AND PROVIDING FOR THE ASSESSMENT AND COLLECTION OF THE
COSTS OF THE CONSTRUCTION OF SUCH SIDEWALKS, CURBS AND GUTTERS.

City Administrator Carr presents an agreement with the County for col-
lection of weed abatement assessments. Motion by Councilman Duffin second by
Councilman Wentworth and carried that the City of Gilroy enter into an agree-
ment with the County for collection of weed abatement assessments.
A letter is read from City Engineer Hanna Jr. recommending that a pro-
gress payment in the amount of $100,690.82 Is due and payable to Bilardl
Construction for construction of the Southwest Sanitary Outfall Sewer Line.
Motion by Councilman Quartiroll second by Councilman Wentworth and
carried that a warrant be drawn in the amount of $100,690.82 payable to
Bilardl Construction for a progress payment tOward the construction of the
Southwest Sani tary Outfall Sewer Line.
City Administrator Carr presents and reads Resolution No. 634. Motion
by Councilman Goodrich second by Councilman Jordan that Resolution No. 634
be adopted.

RESOLUTI ON OF TH E COUNC I L OF. TH'E City OF GilROY ADOPTED I N MEMORY OF S ERG EANT
ROBERT LEE BAKER OF THE GILROY POll CE DEPARTMENT.
WHEREAS, Robett Lee Baker, a valued officer in the Gilroy Police Department,
died on the twenty-ninth of July, 1961, at the age of thirty six years; and
WHEREAS, said Robert Baker served in that Department as a Patrolman from
July I, 1953 to January 1961, at which time he was appointed to the office
of Sergeant; and
WHEREAS, while serving In the Department he performed his duties with dili-
gence, skill and with great understanding, and ,as a student of police work
was continually on the alert to i,mprove himself and the Department; and
WHEREAS, the said Robert Baker served his cOl,mtry as a member of the U. S.
Navy during the Second World War, for a period of over three years; and

WHEREAS, this Council believes the passing of one of itsva,lued officials
who has served:both the, City and his country so ,well should not be permitted
to go unnoticed but merits a perpetual memorial In the records of this city;

NOW, THEREFORE, BE IT RESOLVED that by the death of said Robert Baker the
City of Gilroy has lost a valued employee and citizen who will be sorely
missed by his fellow employees and his friends and acquaintances;
BE IT FURTHER RESOLVED that this Resolution be entered upon the minutes of
this session of the Council, that a copy thereof be delivered to the survi-
ving wife and family of the said Robert Baker to whom the Council, In be-
half of Itself and the citizens of Gilroy, express their deep sorrow and
sympathy.

Motion by Councilman Goodrich second by Councilman Jordan and carried
that one month's salary be given to Mrs. Robert L. Baker.
City Administrator Carr informs the Council that he has appointed
Eugene Jewell as Sergeant and Gilbert Nuanez as Patrolman in the Police De-
partment personnel.
Director of Public Works requests approval to pay Ernest Camino $3,500.36
for an increase in the size of the water main on Sixth Street from Princevalle
Street to Miller Avenue.
Discussion is had.
Motion by Councilman Petersen second by Councilman Quartiroli and carried
that Ernest Camino be paid $3,500.36 for increase In the size of the water
main when the project is completed.
City Administrator Carr requests that an amendment to the City Code be
prepared to provide for stop signs at railroad crossings. .
The City Attorney reports that Section 1539 of the City Code provides
for stop signs at railroad crossings.
The Mayor states that copies of a report on projects completed or un-
derway during the month of July and anticipated to begin in August have been

submitted to each CouncIl member.
Water samples taken by the Santa Clara County Health Department are
presented and read.
Reports of the Police Department, Poundmaster, and Building Inspec-
tor are submitted to each Council Member.
Reports of receipts of City Officers are presented and read.
Motion by Councilman Goodrich second by Councilman Wentworth and
carr i ecl that reports as submi tted and read be approved.
Councilman Duffin asks if auditing of the City's books has ever been
done by local certified public accountants.
Discussion is had.
,Councilman Duffin reports that the Chairman of the Santa Clara County
Traffic Ways Committee suggested at the last meeting that the City .Counclls'
pay an attendance fee to their representatives on the committee to encourage
better attendance. '
City Administrator Carr instructs Director of Public Works Kludt to
install a foot-rest in front of the Council table.

for initiating proceedings for the American Poultry Company locating their
business in Gilroy.
Di rector of Pub Ii c Works Kludt reports that there is a dra i nage pro-
blem at the Golf Course believed to be coming from the reservoir and requests
that the City Install a drain line since Vernon Brown has had a trench dug at
his own expense.
Discussion is had.
Motion by Councilman Duffin second by Counci lman Wentworth and carried
that the City line the drainage trench at the Golf Course.
City Engineer Hanna Jr. requests permission to prepare plans and speci-
fications for the Sewer Line on Ninth Street.
All Council members agree that City Engineer Hanna Jr. should prepare
plans and specifications for construction of the proposed sewer line on Ninth
Street to be available as soon as possible.
Chief of Police Laizure reports that there is only one person on the
eligibility list in the Police Department and due to the personnel turn-over
recently and damaged vehicle the department is not in as good condition as
the annual report of the department indicated last month.
Motion by Councilman Goodrich second by Councilman Wentworth
carried that this Council meeting adjourn._,
