This regular monthly meet,ing of the City Council Is called to order by
his Honor Sig Sanchez.
Present Councllmembers: George T. Duffin, Norm~n B. Goodrich, Wilford
E. Jordan, Kenneth L. Petersen, Charles F. Quartlroli, Everet~ C. Wentworth,
and Sig Sanchez.
The Mayor welcomes the Boy Scouts and others. In the audience. He thanks
them for their attendance and introduces the City officials.
The Mayor states that this is the time and p~ace for the public h~aring
on establishing of IISIl Zones in IIBIl, IlC", IlC-lll, and IIDII Districts and asks if
anyone in the audience wishes to speak for or against the proposal. There is
no response from the audience.
The City Attorney presents and reads a proposed ordinance establishing
"S" Zones in "B", "CII, IIC-l", and "DII Districts. .
City Administrator Carr reports that there is some question whether or
not the proper notice of hearing was puplished ten days prior to this public
hearing. Discussion is had.
Motion by Councilman Duffin second by Councilman Wentworth and carried
that a new public hearing date for the establishment of "S" Zones in certain
districts be set f?r December 4, 1961 at 8:00 P.M. s4bject to determining
whether the,public notice for this hearing tonlght,was.properly published.
A letter is read from the Gilroy Chamber of Commerce requesting closing
of Martin Street from Railroad to Monterey Streets from 12:00 noon to 4:00 p.m.
on December 9th and for possible use of Wheeler Auditorium for the annual
,
Santa Claus event. .
Motion by Councilman Goodrich second by Councilman Petersen and carried
that the request from the Gilroy Chamber of Commerce be granted.
A letter is read from the Gilroy Union,High School District requesting
parking limitations on I.O.O.F. Avenue and. Murray Avenue.
City Administrator Carr states that a section of the City Code must be
amended if this request Is granted.
Discussion Is had on the matter..
City Administrator Carr states that Chief Laizure is in agreement; with

Director of Public Works Kludt explains the area in question.
Motion by Councilman Duffin second by Counci I man Petersen and carried
'that the City Attorney be instructed to prepare an ordinance that will amend

the proper section of the Code, allowing the Gilroy Union High School District's
request for parking limitations on I .O.O.F. Avenue and Murray Avenue.
The report from the Planning Commission Is read recommending
the Council to authorize the City Administrator to conduct an economic feasibility
study on the alternate routings of Old Gilroy extension to Eigleberry Street and
Seventh Street and recommending that the request from August Piedmont for a Use
Permit be denied for rezoning of 6 acres of land on Lewis Street because of non-
conformity with Section 4.3 of the City Code.
The City Attorney explains the legal aspects of the request to rezone
the property on Lewis Street.
Director of Public Works Kludt explains the two routes for the exten-

carried that the City Administrator be authorized to conduct a feasibility study ...

The Mayor calls for a reces~ SO ,that Chief of Police Lalzure can show
sl ides portraying the many activities of the Gilroy Police Department.
After a twenty-five minute recess the Mayor asks the Boy Scouts if
they have anyt~ing to discuss before this Council Meeting.

The City Attorney presents Ordinance No: 666.
Motion by Councilman Duffin second by CouncLlman Wentworth that the
reading of Ordinance No. 666 be waived and that it be adopted., .

ORDINANCE AMENDING. SEC. 15.10 OF THE. GILROY CITY CODE PROHIBITING "U" TURNS ON
MONTEREY STREET.

. . City Administrator Carr recommends that the City Engineer be instru-
cted to set precise plan lines for an 86 foot s~reetJ from Tenth and Church
Streets, diagonally to Monterey Street, and thence easterly on Ninth to Pacheco
Pass.
The City Attorney states that this matter will have to come before
the Planning Commission for a hearing.
Motion by Councilman Jordan second by Counci Iman Goodrich and carried
that the City Attorney be authorized to prepare the necessary plans for setting
of plan lines on the 86 foot street as recommended by the City Administrator to
be presented to the Plannin'g Commission for public hearing.
The City Attorney presents and reads Resolution No. 660. Motion by
Councilman Petersen second by Councilman Wentworth that Resolution No. 660 be
adopted.

City Administrator Carr states that he is not prepared at this time to
state whether he will use the City Engineer's services or if he will hire a
con~ultant for this proposed survey.
Motion by Councilman Jordan second by Councilman Goodrich and carried
that the City Administrator be authorized to conduct a survey of the City1s
water system.
City Administrator Carr recommends that Assistant City Administrator
Cecil Reinsch be advanced to the next step in his salary range from $505.00 to
$530.00 to become effective December I, 1961.
Motion by Counci Iman Wentworth second by Councilman Duffin and carried
that Cecil Reinsch be advanced to the next step in salary range 23 from $505.00
to $530.00, effect i ve December 1, 1961.
City Administrator Carr reports that Traffic Ways Representative Kludt
has brought to his attention the matter of financing landscaping costs on
streets qualifying under the County Bond Program and requests Council opinion
on th is subj ect.
Discussion is had.

that the City Council go on record that they are against financing landscaping
costs from bond money on streets qualifying under the County Bond Program.
A letter is read from Director of Public Works Kludt recommending that
Ted Carpenetti be advanced to the next step in his salary range $358.00 to
$376.00 to become effective December I, 1961.
Motion by Councilman Goodrich second by Councilman Quartir~li, and carried
that Ted Carpenetti be advanced to the next step in salary range 16 from $358.00
to $376.00, effective December I, 1961.
A letter is read from Chief of Police Laizure ~ecommending that Raymond
Fortado be advanced to the next step in his salary range from $415.00 to $436.00
to become effective December I, 1961.
Motion by Counci Iman Duffin second by Councilman Quartiroli and carried
that Raymond Fortado be advanced to the next step in salary range 19 from $415.
to $436.00, effective December I, 1961.
City Administrator Carr requests a general discussion be had on planning
for future width of First Street.
Director of Public Works Kludt explains the proposed plan for future
widening of First Street.
Discussion is had.
Motion by Councilman Goodrich second by Councilman,Jordan and carried
that the City maintain a 61 foot width street at First Street..
A letter is read from the Gilroy Gliders thanking the Council for use
of Wheeler Auditorium. City Administrator Carr informs the Council that the
cost to maintain the auditorium floor for this event was approximately $30.00
because they required a special non-slippery floor for their folk dancing
event.
All Council Members agre~ that organizations in the future requiring
special processing of the auditori um floor should be required to pay for the
additional expense.
Letters from the State Board of Equalization, Senator Thompson, and
Assemblyman Allen acknowledging receipt of the City.s resolution requesting
tax benefits for fall-out shelters are read.
Water samples taken by the Santa Clara County He~lth Department are
presented and are satisfactory.
Councilman Wentworth requests permission to leave this Council meeting.
The Mayor excuses: Counci Iman 'Wentworth.
Councilman Duffin recommends that City Administrator Carr develop a
plan on how to replenish City funds to finance future growth of the City.
City Administrator Carr states that he is in the process of developing
the new proposed Five Year Capital Outlay Program that will answer Councilman
Duffln1s recommendation.
Discussion is had on the availibility of City funds and on a proposed
sewer and garbage charge to every user. It is suggested that the City Admin-
,tstrator conduct a survey in the surrounding cities to determine their sewer
charges, if any.
The Mayor calls on Dennis De Bell and asks him if he has anything to be
discussed 6efore the Council.
Mr. Dennis De Bell addresses the Council requesting use of City water
on property adjoining the golf course recently purchased from Gladys Milne.
He states that he purphased this property with life tenancy rights to the
former owners and the two widows living on the property do not have any water,
since the ~ell is dry. He requests that he be allowed to install at his own
expens~ a one inch line from the Sixth Tee at the Golf Course to the Milne
house.

The City Attorney reports that when the Milne property owners gave the
City the right-of-way for the City's pipe line from the dam to the reservoir,
which has since been abandoned by the City, that they had the right to use the
water from this pipe line, but that they never used the water at that time
because water was obtained from a well. He states that he does not believe
that the City has a legal obligation to furnish these property owners water.
He states that this matter is strictly a moral obligation and under the circum-
stances the Council might permit temporary use of City water for emergency
purposes.
Discussion is had. The Mayor states that it has been a Council policy
not to furnish water to anyone outside of the City limits.
Motion by Councilman Duffin second by Councilman Quartiroli and carried
that on the basis of a moral obligation the City offer the tenants living on the
Milne property, use of water from the City's line at metered rates with a sixty
day 1 imitation, not subject to an extensi~n after the sixty-day period.
Councilman Jordan asks what progress has been done on purchasing Chris-
tma s H ill .
City Administrator Carr states that 1/5 of the property has been pur-
chased and that an additional 1/5 will be purchased after January I, 1962, and
at that time the City can begin developing the proposed recreation park. He
states that the Parks and Recreation Commission will meet tomorrow night to dis-
cuss tentative ideas on development of the park.
The Mayor compliments Chief of Police Laizure on the slides shown of
the Gilroy Police Department's activities and states that this is a good public
relations project.
Chief of Police Laizure reports that he intends to expand this program
In the future.
Chief Laizure also reports that he met with the law enforcement officials
and laboratory technicians attempting to ~btain better copperatlon from the tech-
nicians in sobriety tests.
