Minutes 1962/02/05 2175 Gilroy, California February 5, 1962 r~' lw": This regular monthly meeting of the CityCouncil Is called to order by his Honor Sig Sanchez. Present: Council Members: Wilford E. Jordan, Kenneth l. Petersen, Char~es F. Quartiroli, Everett C. Wentworth, and Sig Sanchez. Absent: Council Members: George T. Duffin, and Norman Goodrich. The Mayor asks if all Councilmen have received copies of the regular meet- ings of January 2nd and 15, 1962. All Councilmen answer in the affirmative. The Mayor now asks if there are any errors or omissions in the minutes as presented. No errors or omissions are noted. The Mayor now declares the minutes of the regular meetings of January 2nd and l5, 1961 approved. The Mayor states that this is the time and place for opening of bids for a pollcevehicle. Purchasing Agent Reinsch opens the bids and they read as follows: Bill Boyle Ford Sales - $2,252.71; Pioneer Dodge Inc. - San Jose - $1,871.00; and Bishop Motor Sales - Hollister - $1,8l5.00. The Mayor instructs the City Attorney to check the low bid to determine if it is In ~ccord with the specifications. A letter is read from the Gilroy Garbage Disposal' requesting a raise in rates for household garbage collection. Discussion Is had on the matter. . Motion by Councilman Wentworth second by Councilman Jordan and carried that the City Attorney be instructed to prepare an ordinance to conform with the re- quest by the Gilroy Garbage Disposal for increase in rates of household garbage co II ec t i on . The City Attorney reports that the bid from Bishop Motors for one police vehicle is. In order. Motion by Councilman Quartiroli second by Councilman Wentworth and.carried that the low bid of Bishop Motors Sales in the amount of $1,815.00 be awarded. Applications for transfer of liOn-Sale Beer Licenses" for Bernice Shurden, Club O.K., at 27 South Monterey Street and for Arnaldo Narvaez, Arnold's Place at 309 South Monterey Street are presented. City Administrator Carr reports that the Pol ice Department has no objection to these appl icatfons. A letter Is read from Bill Boyle requesting a change in the license ordin- ance regarding fees assessed On volume sales. Mr; Boyle and Mr. Richard Brooks address the Council and request that a maximum license fee be established in the license ordinance on volume sales~ Discussion is had on the matter. The Mayor requests that a license survey be conducted in other cities to determine "f they have a maximum I icense fee for merchants who are on a volume ba s is. . City Administrator Carr reports that the Planning Commission has recommended repeal of Subdivision 2, subsection (c) of Section 7t of Appendix A of the City Code and recommends zoning the "Second Southern Addltion" to District "D". ()-1 '7h .:..:~ u The Mayor states that all Councilmen have received copies of the Gilroy Police Benefit Association's By-Laws and states that they desire Council recog- nition of their organization. Discussion is had. Motion by Councilman Petersen second by Councilman Wentworth and carried that the City Council are in accord with the present By-laws of the Gilroy Police Benefit Assoc~ation and request notification if any amendments' are contemplated in the original By:laws. ' City Administrator Carr reports that he contacted the Flood Control District regarding construction of buildings over Miller Slough and it has been determined that the Flood Control District has control and regulates building over Miller Slough. He reports that any person desiring to'build over the Slough must sub- mit plans prior to building. City Administrator Carr states that Director of Public Works Kludt is ill, and willnot be able to report on the parking situation at the Tenth and Monterey Street Intersection but that Mr. Kludt and Chief laizure had investigated this intersection. He states that after investigating this parking situ~tion they have recommended that one parking space be painted red at the North West corner of Monterey Street at Tenth Street, that two car parking spaces be marked after the red space and that another "No Truck Parking Between Slgns" be installed to correct the truck parking at this location. He states that no further action of the Council is necessary. ' . The Mayor suggests that a pedestrian cross-walk be painted at Tenth and Monterey Streets and requests Director of'Publlc Works Kludt to investigate this proposal. ' A letter from the Division of Highways is read regarding a survey that they will conduct to determine the need for traffic signals at Third and Mont- erey Streets. , City Administrator Carr presents and reads Resolution No. 670. Motion by Councilman Petersen second by Councilman Wentworth that Resolution No. 670 be adopted. . RESOLUTION NO. 670 RESOLUTION OF THE CITY COUNCil OF THE CITY OF GILROY ADOPTING BUDGET PROPOSAL FOR EXPENDITURE OF FUNDS ALLOCATED UNDER'SECTION 2107.5 OF THE STREETS AND HIGHWAYS CODE. RESOLUTION NO. 67l RESOLUTION OF THE CITY COUNCil OF THE CITY OF GILROY ADOPTING AND SUBMITTING A BUDGET FOR EXPENDitURE OF FUNDS ALLOCATED FROM THE STATE HIGHWAY FUND TO CITIES. ROES: COUNCIL MEMBERS: None ' ABSENT: COUNCil MEMBERS: Duffin, and Goodrich. Purchasing Agent Reinsch reports on the proposed gasoline contract with Shell Oil Company. He states that the County has awarded their gasoline bid to Shell Oil Company which requires that the City enter into agreement with Shell Oil Company for the City's gasoline. Motion by Councilman Wentworth second by Councilman Jordan that the City of Gilroy enter'into an agreement with Shell Oil Company for the gasoline contract. The Mayor states that all Councilmen have received copies of a letter from Mr. W. J. Hanna Sr. recommending conservation of usuabJe water and calls on Mr. Hanna Sr. to explain his letter. and Mr. Hanna Sr. 'addresses the Council/explains his recommendation further. Discussion IS had. The Mayor thanks Mr. Hanna Sr. for his continued interests in the Clty's problems and states that his proposals 'to conserve water will be considered. The City Attorney presents and reads Resolution No. 672. Motion by Councilman Wentworth second by Counci Iman Petersen that Resolution No. 672 be adopted. Resolution No. 673 Is presented and read by the City Attorney. Mo- tion by Councilman Petersen second by Councilman Wentworth that Resolution No. 673 be adopted. l.J RESOLUTION NO. 673 RESOLUTION OF THE COUNCIL OF THE CITY OF GilROY ACCEPTING CONVEYANCE FROM FILPER CORPORATION, A CORPORATION, FOR EXTENSION OF CHURCH STREET. PASSED, APPROVED AND ADOPTED this 5th day of February, 1962, at a regular meeting of the Council of the City of Gilroy by the following vote: AYES: COUNCIL MEMBERS: Jordan,Petersen,Quartlroli,Wentworth, and Sanchez. NOES: COUNCil MEMBERS: None ABSENT: COUNCIL MEMBERS: Duffin and Goodrich. - I City Administrator Carr requests that a Committee of the Council be appointed to study proposals for improvements to the water system. The Mayor appoints Counci Imen Jorden, Quartlroli, and Duffin to study the proposals for Improvement to the water system and requests that the remilnlng Council Members be notified when the Committee meets,so they may attend if they so desire. The Mayor states that a II Counci I Members have recei ved cop'i es of the report of the Police Department, Poundmaster, Building Inspector; the City Auditor's report from July I, 1961 to January 31, 1962; the Financial report for January 1962; the progress report of projects completed or underway during the month of January and anticipated to begin In February; the reports of receipts of City Officers; and the yearly report of the Gilroy Volunteer Fi re Department. Motion by Councilman Wentworth second by Councilman Petersen and carried that all the reports be accepted as submitted. Councilman Wentworth requests a two months leave of absence because he will be hospitalized and convalescing for at least two months. 'Motion by Councilman Jordan second by Councilman Quartiroli and carried that Councilman Wentworth be granted a two ~onths leave of absence. Councilman Petersen reports that Mr. Alex Balanesi is having prob- lems obtaining sewer facilities at a site inside the City limits and that the property owner involved will not give him permission to go through his property to connect with the City sewer line. Discussion is had. The City Attorney states that this Is a problem that does not Involve the City and that Mr. Balanesi will have to obtain a right-of-way from the private property owner. Discussion is had concerning utilization of sewer water. The Mayor asks anyone in the audience if they have anything to dis- cuss at this time. There is no response. Purchasing Agent Reinsch expresses his appreciation to the Council for allowing money in the budget for his attendance at the Purchasing Agent's Convention In Long Beach. City Administrator Carr reports that Patrolman Biafore was called ,back into the United States Armed Forces for nine months thus creating a vacancy In the Police Department. He reads a recommendation from Chief of Police Laizure to hire Jimmie Matthews for Patrolman on a temporary basis. City Administrator Carr reports that he is In accord with this appointment. City Administrator Carr requests that consideration be given to lowering the pump at the City well on First Street rather ~han installing a new pump at I.O.O.F. Avenue. -He states that the purchase of a new pump at I.O.O.F. Avenue could be delayed until It Is determined whether or not we will have more rain.
