Petersen at 8:05 p.m. The Mayor asked, if all Council Members had received copies of the regu- lar meeting of July 6, 1964. All Council Members answered in the affirmative. The Mayor asked if there were any errors or omissions in the minutes as mailed. No errors or omissions were noted. The Mayor declared the minutes of the meeting of July 6, 1964 approved. City Administrator Wood presented copies of a report for the Library site prepared by Hughan & Hughan. Mr. John Hughan addressed the Council and briefly explained the report. Councilman Goodrich entered and took his seat at the Council table. Discussion was had regarding said report. The Mayor referred the report to the Library and Culture Commission for ~, () .~ (\ L.:ddLt comment and recommendation to the Council. A letter from Harold Steinmetz was presented and read appealing the Plan- ning Commissions' decision re: denial of his request to rezone property on Eigle- berry Street between 6th and 7th Streets. Councilman Goodrich suggested that the matter be discussed after the Pub- 1 ic Hearing on Parking District #1. Motion was made by Councilman Goodrich seconded by Councilman Jordan and carried to set Monday, August 17, 1964 at 8:00 p.m. for a Public Hearing on Harold Steinmetzls appeal regarding rezoning. City Administrator Wood presented and read a letter from the Gilroy Ambu- lance Service requesting an ordinance to control ambulance service. Discussion was had. Mr. Holdaway, owner of the Ambulance Service addressed the Council and further explained that it was his opinion that Ambulance Services from other cities should be prohibited to service Gilroy since they do not pay a City license. The Mayor instructed the City Attorney to study the legal procedures and ordinances regarding control of ambulance service and report back to the Council. City Administrator Wood reported that he had received a letter from the King's Rest Motel requesting the City to require improved containment of the neighboring business' garbage storage area and that said adjacent business is cur- rently improving their garbage storage area. City Administrator Wood requested to amend the 1964-65 Budget in the amount of $500.00 to increase Account 27C3 for the Victorino Property acquisition as per Council instructions March 16, 1964. Motion was made by Councilman Wentworth seconded by Councilman Duffin and carried that the 1964-65 Budget be amended in the amount of $500.00 to increase Account 27C3 as recommended. The summary of monthly reports were noted and filed. The report of Disbursements from June 10, 1964 to July 10, 1964 was noted and f i 1 ed . Mr. Joseph Allen addressed the Council and commented on the good construc- tion of the reservoir at Christmas Hill Park site. City Administrator Wood recommended a budget amendment to clear overtime balances for the 1963-64 Budget for certain Public Works Personnel in the amount of $305.63 to be transferred from Account 40Al to 41A2. Motion was made by Councilman Wentworth seconded by Councilman Jordan and carried that the budget be amended as recommended to clear the overtime balances. The City Attorne~ requested additional time to study the matter of the proposed settlement of Tax Lien to determine if the City can authorize a quit claim deed in such cases. Councilman Wentworth noted a mathematical error in the overtime calcula- t ions. Motion was made by Councilman Wentworth seconded by Councilman Jordan and carded that the Budget amendment transfer be corrected to allow for the addi- tional amount, correct total of $316.63 for overtime balances in the 1963-64 Budget. Mr. John Hughan addressed the Council and presented the plans for the proposed Police & Jail Building. He explained the minor changes in the plans re- garding the parking spaces adjacent to the building and the floor plan changes. Motion was made by Councilman Jordan seconded by Councilman Wentworth and carried that the plans and specifications for the Police and Jail Building be approved and that authorization be given for the call for bids subject to a detailed review by Council Committe~ composed of Councilman Quartirol i, Goodrich, and Jordan. City Administrator Wood presented and read Resolution No. 845. Motion was made by Councilman Duffin seconded by Councilman Wentworth to adopt Resolution No. 845. RESOLUTION NO. 845 RESOLUTION OF THE CITY COUNCIL AUTHORIZING THE ADOPTION OF PERMIT AND INSPECTION FEES OF THE SANTA CLARA VALLEY UNIFORM HEATING AND COMFORT COOLING CODE OF 1961, PROVIDING FOR COLLECTION OF FEES, ISSUANCE OF PERMITS BY THE ~ITY OF GILROY. The City Administrator requested a Personnel Session immediately fol- lowing the meeting and it was noted. Director of Publ ic Works Kludt presented his report on cost for weed abatement on private property and requested authorization of special assessments to reimburse the City. The City Clerk presented and read the title of Resolution No. 846 confirm- ing the report of the Dtrector of Public Works. Motion was made by Councilman Wentworth seconded by Councilman Goodrich to waive the reading and adopt Resolution No. 846. . RESOLUT ION NO. 846 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY CONFIRMING REPORT OF DIRECTOR OF PUBLIC WORKS SETTING FORTH THE DESCRIPTIONS OF PROPERTY, THE OWNERS THEREOF, AND THE COST OF ABATING THE NUISANCE CAUSED BY THE GROWING OF WEEDS IN THE CITY OF GILROY AND PROVIDING THAT SUCH COSTS WILL CONSTITUTE ~PECIAL ASSESSMENTS AGAINST THE RESPECTIVE OWNERS OF LAND. Director of Public Works Kludt reported that property along the Miller Slough is expected to be maintained by the County. Director of Public Works Kludt noted that there are bui~ding violations at the premises at 36 South Monterey Street of which an application for "on-sale" beer and wine 1 icense from Helen P. Rodriguez and Rosa" M. & Victor C. Soto had been filed. He stated that the owners indicated their intent to comply and cor- rect the building violations. City Administrator Wood indicated that he would notify the Alcoholic Beverage Control of the stated violations. Director of Publ ic Works Kludt requested authorization to advertise bids for Paving Projects. on Church Street - 10th St. southerly to existing; 8th St. Dowdy St. to Hanna St; and 2 alleys between Monterey and Eigleberry 5ts. - 6th to 7th and 8th to 9th Sts. Mr. Don. Chesbro addressed the Council and requested paving of his alley in back of his residence between Rosanna and Church Streets and between 4th and 5th Streets. He also requested additional lighting on his block. Director of Publ ic Works Kludt noted that the alley referred to is in- cluded in the 1964-65 alley maintenance program and trn t the Master Street light- ing Study will be presented soon. Motion was made by Councilman Wentworth seconded by Councilman Duffin and carried that the call for bids for the recommended Paving Projects be authorized. The City Clerk presented and read the title of. Ordinance No. 720 estab- lishing "R-3XII, High Density Multiple Residence District. Motion was made by Councilman Goodrich seconded by Councilman Wentworth that Ordinance No. 720 be adopted. ORDINANCE NO. 720 ORDINANCE AMENDING SEC. 4 OF ORDINANCE NO. 711 (ZONING ORDINANCE OF THE CITY OF GILROY) BY ADDING TO SAID SECTION AN ADDITIONAL ZONING DISTRICT TO BE KNOWN AS R3X, OR HIGH DENSITY MULTIPLE RESIDENCE DISTRICT, AND BY ADDING TO SAID ZONING ORDINANCE SECTIONS 24.10 TO 24.20, INCLUSIVE, DESIGNATING REGULATIONS APPLYING TO SAID R3 X DISTRICT. NOES: COUNCIL MEMBERS:None ABSENT: COUNCIL MEMBERS:Eckard City Administrator Wood noted a letter from the Chairman of the Flag Pageant Committee urging Citizens of Gilroy to attend the "Pageant of National and State Flags" at Kezar Stadium, July 25, 1964 at 2:00 p.m. The Mayor urged everyone to attend if possible. Councilman Wentworth noted the decision of the Supervisors in regard to the Use Permit for Pacific Cement & Aggregates on Burchell Road. Discussion was had. Counci.lman Wentworth complimented the City Administrator for his efforts in obtaining the deed for the Victorino Property. Councilman Wentworth complimented the Dinner Committee at the City Barbe- cue. Councilman Duffin inquired about the meeting with Mr. M. J. Fil ice regar~ ing obtaining easements for installation of the proposed water line through San Martin Vineyard Property, believed to alleviate water pressure in Castlewood Park A rea. City Administrator Wood noted that a meeting was scheduled for July 14, 1964 however Mr. Filice was unable to attend and that another meeting will be scheduled. Councilman Duffin inquir~d about progress of sidewalk installation for areas where more than 50% of the block has sidewalks already installed. Director of Public Works Kludt informed the Council that contractors have been obtained and the work is proceding. The City Attorney noted a correction in the Gilvoy Evening Dispatch re- garding his opinion on requiring property owners to install sidewalks if less than 50% of the sidewalks are in. He noted that 60% of the owners of the frontage can petition the Council for sidewalk ~nstallation and the City can also install side- walks by an improvement district. Councilman Duffin asked if reservations had been made for the Los Angeles League Conference. It was noted that reservations had been made for the City Administrator and all Council Members. Discussion was had regarding other City Officials attending said Conference. It was ooted that 2 members of the Planning Commission should also attend if they so desire. The Secretary of the Planning Commission was instructed to determine from the Commission if they would be sending representatives to the Conference. ,);) -'... ~' ~) . ;) Councilman Jordan thanked the Staff for removing the illegally parked trailer on Hanna Street. Mrs. Jack Holson seated in the audience thanked the City Recreation Department for sending the children to the Giants' Baseball Game. Mr. Joseph Allen addressed the Council and asked how one becomes appointed to the Planning Commission. He was informed to submit his name to a Council Member in order that his name could be considered at the next vacancy on the Commission. City Administrator Wood asked the Council if they wished to meet with Morgan Hill City Council regarding the County Sewer Study on Wednesday, July 22, 1964 at 8:00 p.m. in the Gilroy Council Chambers pending approval from Morgan Hill. The Council concurred. Planning Commissioner Neilson asked if the Airport Committee was still active and functioning. City Administrator Wood stated that he would contact the local Chamber of Commerce regarding this matter.
