Minutes 1964/11/16 1 239"8 '-- Gilroy, Calif6rnia November 16, 1964 The regular meeting of the City Council was called to order by His Honor Kenneth L. Petersen at 8:00 p.m. Present: Council Members: George T. Duffin, Norman B. Goodrich, Wilford E. Jordan, Everett C. Wentworth, and Kenneth L. Petersen. Absent: Council Members: Chester R. Eckard and Charles F. Quartiroli. The Mayor asked if all Council Members present had received copies of the regular meeting of November 2, 1964. All members present answered in the affirmative. The Mayor asked if any errors or omissions were noted in the minutes as presented. No errors or omissions were noted. The Mayor declared the minutes of the regular meeting of November 2, 1964 approved.' City Administrator Wood presented an application from Earl M. Steward for a Card Room License at 19 South Monterey Street, Gilroy and recommended that it be referred to Staff for study and recommendation. City Administrator Wood presented a ietter from the Central Labor Cou~cil of Santa Clara County requesting adoption of the President1s Proclam- ation proclaiming November 15t~ through 21, 1964 as "National Freedom from Hunger Week". . Motion was made by Councilman Goodrich seconded by Councilman Wentworth and carried to prociaim November 15th through 21, 1964 as "National Freedom from Hunger Week". . City Administrator Wood reported that Petitioners, Donald L. Stone Homes, Inc. and Donald Manzo requested deferrment of action on a proposed petition to annex 32.604+ acre parcel of land to be known as IITenth Western Addition to the City of Gilroy" in order to give ffi<?re study to said proposal. No action was taken and the matter was tabled to December 7, 1964. The Mayor introduced new City employee"Ronald Chaffee, Police Patrolman. 2399 Director of Publ ic Works Kludt presented a report of the Planning Com- mission meeting of November 5, 1964 recommending rezoning of property on the eastside of Eigleberry Street between Ninth and Tenth Streets from "R-31' to "C-2"; and recommending approval of a new tentative subdivision map of ('West- wood Acres, Unit No.2" submitted by Kentwood Development Co., Inc. Discussion was had regarding the tentative map of Westwood Acres, Unit No.2. Councilman Goodrich reported on water pressure complaints received in Westwood Acres, Unit No.1 and suggested that careful planning be given to water line improvements in proposed Unit No.2. Motion was made by Councilman. Duffin seconded by Councilman Wentworth and carried to accept the tentative map of Westwood Acres, Unit No.2 provided adequate water lines are planned as required by Staff in order to alleviate possible insufficient water pressure. The City Attorney was instructed to prepare a Resolution setting the time and place for the Public Hearing before the Council on rezoning of the East side of Eigleberry Street between Ninth and Tenth Streets. City Administrator Wood presented the report of the Personnel Commission meeting of November 10, 1964 recommending adoption of new qualifications for Chief LJbrarian and approval of a new salary range. Motion was made by Councilman Duffin seconded by Councilman Wentworth and carried to approve the qualifications and new salary range for Chief Lib- rarian as recommended by the Personnel Commission. City Administrator Wood presented a report of water samples taken by the Santa Clara County Health Department and recommended that they be placed on f i Ie. City Administrator Wood presented a summary of the monthly reports for October 1964. Discussion was had. City Administrator Wood presented the report of Disbursements from October 10, 1964 to November 10, 1964. City Administrator Wood recommended step increases in the salary pay plan for the following employees: Richard Lake, Patrolman - Range 21.3 Step "A" $449.00 to Step "B" $472.00; Karol Castle, Clerk-Matron Range 17.3 Step "C" $407.00 to Step "D" $427.00; and Duncan DeMers, Police Cadet - Range 12.3 Step "AII $289.00 to Step "B" $304.00. Motion was made by Councilman Jordan seconded by Councilman Wentworth and carried that. the three employees be advanced to the next step in the pay plan as recommended by City Administrator Wood, effective December 1, 1964. City Administrator Wood presented two Alcoholic Beverage Control ap- pI ications for On-Sale General Liquor License at 31 South Monterey Street, Jimmie Carl Queen, Applicant and for On-Sale Beer and Wine License at 63 S. Monterey Street, Alberta Stenson, Applicant. There were no objections to the applications. The Mayor presented a letter from the Community Service Organization, Gilroy Chapter inviting the Council to attend the Organization's National Convention to be beld at Gilroy High School November 21st and 22, 1964 and requesting the Council to proclaim welcoming delegates to the City. The Mayor issued said proclamation. Mr. Guillermo Villasana addressed the Council and explained the pur- pose of the Organization's Convention. Director of Public Works Kludt presented and explained a report re- garding building violations re: Legge Apts. at 444 North Hanna Street, Gilroy. Discussion was had and the report was ordered filed. Mr. Davis, representing Emerald Irrigation Supply Co. addressed the Counc i I and exp I a i ned the reason f or defau 1 t on the bid to ins ta 11 the turf and sprinkler system at Christmas Hill Park. Discussion was had on the matter. Motion was made by Councilman Goodrich seconded by Councilman Duffin and carried to retain the 10% Cashier's Check in the amount of $845.00 as a result of the forfeit and reject all bids submitted for the project. The City Attorney presented and read a r,eso]ution setting the Public Hearing date of December 7, 1964.for rezoning of the east side of Eigleberry Street between Ninth and Tenth Streets. Motion was made by Councilman Jordan seconded by Councilman Goodrich to adopt Resolution No. 871. RESOLUTION NO. 871 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY FIXING TIME AND PLACE OF HEARING REPORT AND RECOMMENOATION OF PLANNING COMMISSION UPON THE APPLICATION OF PROPERTY OWNERS OF PREMISES LOCATED ALONG THE EASTERLY SIDE OF EIGLEBERRY STREET FROM NINTH TO TENTH STREETS TO AMEND ZONING ORDINANCE OF SAID CITY BY 2~lOO REMOVING SAID PROPERTY FROM R3 DISTRICT AND PLACING IN C2 DIS~RICT. PASSED AND ADOPTED this 16th day of November, 1964, by the following vote: AYES: COUNCIL MEMBERS: Duffin,Goodrich,Jordan,Wentworth, and Petersen. NOES: COUNCIL MEMBERS: None ABSENT: COUNCIL MEMBERS: Eckard and Quartiroli. The City Attorney presented a proposed ordinance setting forth citation procedure for violation of any City ordinance. City Administrator Wood explained that the proposed Ordinance would be helpful in providing documented proof of the fact that ordinance violat~rs were warned or cited for such violations. Motjon was made by Councilman Goodrich seconded by Councilman Wentworth and carried that the ordinance setting forth citation procedure for violation of City ordinances be introduced and published by title and summary. City Administrator Wood presented and read the Chamber of Commerce building site Lease-Agreement noting corrections and amendments. The City Attorney was instructed to prepare a Resolution authorizing acceptance of a Quit Claim Deed from the Presbyterian~Missionary Organiza- tion for full title to said property prior to authorizing execution of the Lease-Agreement. The 70th National Conference on Government to be held in San Francisco on November 18-21, 1964 was noted. City Administrator Wood noted the Governor's Safety Conference December 3rd and 4, 1964. City Administrator Wood reported that Gavilan Jr. College representa- tives would like to meet with the Council Committee composed of Mayor Peter- sen and Councilman Goodrich on Monday, November 23, 1964 at 8:00 p.m regard- ing sewer facilities. The Committee agreed on said meeting date. City Administrator Wood noted an Inter-Departmental Memo of the Police Department commending the Gilroy Auxiliary Pol ice Departments' outstanding performance on October 18th regarding traffic from Laguna Seca Races. Councilman Goodrich also noted the good performance of the Auxil iary at the local football games. The Mayor instructed the City Administrator to write a letter.of com- mendation to the Auxil iary Pol ice Department for their outstanding perfor- mance. Discussion was had on progress of Parking District No.1. Councilman Jordan noted the newspaper article of November 2, 1964 in the San Jose Mercury & News classifying Gilroy as "Poverty" area. Discus- sion was had on the matter. Motion was made by Councilman Jordan seconded by Councilman Goodrich and carried congratulating and approving the local Chamber of Commerce and City Officials' action in reply to said newspaper article. Councilman Jordan further requested the local newspaper to print ac- tion of the Council and further supplement the reply to the San Jose News= paper article of November 2, 1964. The Mayor reported that he recently attended United Nation Day cere- monies representing the City. Oirector of Public Works Kludt requested ad~itional time to condense a report of Church Street capacity for heavy trucks. Chief of Police Laizure reported that assistance from Hollister Pol ice Department at Gilroy vs Holl ister Football Game in Gilroy proved to be psychologically effective. The Mayor instructed the Chief of Police to write a letter of appreciation to the Hollister Police Department. Mr. Guillermo Villasana addressed the Council and thanked the City for cooperation ~iven to the Community Service Organization, Gilroy Chapter. . The City Attorney presented and read Resolution No. 872 authorizing acceptance of a Quit Claim deed from the Presbyterian Missionary Organiza- t i on. NOES: COUNCIL MEMBERS:None ABSENT: COUNCIL MEMBERS: Eckard and Quartiroli Motion was made by Councilman Wentworth seconded by Councilman Duffin and carried, authorizing the Mayor and City Clerk to sign the Chamber of 2401 Commerce Lease-Agreement on behalf of the City.
