Abandonment Portion Maple St. 1/3/67 ,.- Gilroy, California December 5, 1966 The regular meeting of the City Council was called to order by Mayor Petersen at 8:05 p.m. Present: Council Members: John E. Allemand, George T. Duffin, Chester R. Eckard, Norman B. Goodrich, Charles F. Quartiroli, Everett C. Wentworth and Kenneth L. Petersen. The minutes of the Regular Meeting of November 21, 1966 were approved as mailed and recorded. The Mayor extended a welcome to Gavilan College Students. The City Attorney presented and read Resolution No. 1067 upon the passing of Walter J. Hanna Sr. Motion was made by Councilman Eckard Seconded by Councilman Goodrich to adopt Resolution No. 1067. RESOLUTION NO. 1067 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY UPON THE PASSING OF WALTER J. HANNA, SR. PASSED AND ADOPTED this 5th day of December, 1966 by the following vote: AYES: COUNCIL MEMBERS: NOES: ABSENT: Allemand, Duffin, Eckard, Quartiroli, Wentworth and None None Goodrich Petersen. COUNCILMEMBERS: COUNCIL MEMBERS: City Administrator Wood reported and explained request from Joseph Mondelli and L.G. Edwards for abandonment of a porttio~ of Maple Street between Eighth and Old Gilroy Streets. Mr. Alan Nicolson, Attorney for Mr. Mondell i addressed the Council and explained the procedure of title research and an un- successful attempt to contact one John O'Sullivan. The City Attorney confirms Mr. Nicolson's report and the City's right to abandon the unimproved portion of Maple Street as requested. The City Attorney presented and read Resolution No. 1068 setting a Public Hearing date of January 3, 1967 on the proposed abandonment of a portion of Maple Street between Eighth and Old Gilroy Streets. Motion was made by Councilman Duffin seconded by Councilman Eckard to adopt Resolution No. 1068. '---~--~ ""..... ... 0603 RESOLUTION NO. 1068 RESOLUTION OF INTENTION TO VACATE ALL THAT PART OF MAPLE STREET IN THE CITY OF GILROY LYING BETWEEN OLD GILROY STREET AND EIGHTH STREET. NOES: ABSENT: COUNCIL MEMBERS: COUNCIL MEMBERS: Plan.Com..B.eport The report of the Planning Commission meeting of Thursday, December I, 1966 was presented by Secretary of the Planning Com- mission Kludt, informing the Council of three (3) public hearings; the first public hearing was held on the establishment of official plan I ines for Chestn!!'!: Street from Luchessa Avenue to 8th Street. Many persons in the audience registered protests, therefore the public hearing was continued until December 15, 1966 to allow the area property owners sufficient time to gather additional informa- tion; the second public hearing was held on a use permit request of the Union Oil Company to erect an electrical identifying sign at 900 South Monterey Street. The Commission after review, granted the said permit for the erection of the sign. The third public hearing was conducted on a use permit request of Atlantic Richfield Oil Company to relocate its sign at 298 First Street. The Commis- sion continued this hearing until January 5, 1967 in order to further study the proposal; the Council was also informed that a letter was received from George Duffin requesting the Commission to study the rezoning of the properties in the area of the North Church Street Extension. Chairman Connell appointed a Commission Committee to work with Warren Jones on the general area suggested by Mr. Duffin; the Commission recommends to the Council that pro- cedures to rezone the "C_l", Neighborhood Commercial Districts on First Street to "C_2", General Commercial Districts. The Commis- sion is of the opinion that the First Street area has sufficient commercial enterprises to warrant the "C-211 zone rather than the transitional "C_Jll District. Council concurred with said recommen- dation but felt that the First Street area to be included in the "C_2" zone be limited to the Safeway Shopping Center; the Com- mission also recommends the establishment of an interim Zoning District,"I':'Z", for newly annexed areas. Presently annexed properties are automatically zoned 11R_lll, Single Family Residence District and the Commission feels that an Interim Zoneprovides more flexibility than the "R-JlI. Council concurred with said recommendation. ~""l IIlIoIt Water Samples Mayor- Council Pay ~.,..,. ........ Assist.under C i v i.l Defense Act. Res. 1069 City Administrator Wood presented a report of satisfactory Water Samples by the Santa Clara County Health Department. Motion was made by Councilman Duffin seconded by Councilman Wentworth and carried that the report be placed on file. City Administrator Wood reported on the survey of Mayor- Council Pay Plan of the seven cities contacted. Discussion was had on the suggested proposal as previously presented by Councilman Wentworth. Council instructed staff to prepare an Ordinance setting the pay rate as recommended by Councilman Wentworth. City Administrator Wood presented and read Resolution No. 1069 requesting assistance under the Civil Defense Act of 1950. Motion was made by Councilman Goodrich seconded by Councilman Eckard to adopt Resolution No. 1069. COUNCIL MEMBERS: COUNCIL MEMBERS: Chief Laizure reported on the Governor's Traffic Safety Conference held in Sacramento on November 17 and 18, 1966. - City Administrator Wood reported and explained that the Beautification Lease on S.P.R.R. Depot property provides for one year and continuance thereafter on a month to month tenancy at no charge to the City. Motion by Councilman Duffin seconded by Councilman Goodrich and carried to authorize the Mayor to sign the said lease subject to the City Attorneys review and approval. ,""~,,,,- City Administrator Wood presented and read Resolution No. 1070 setting a Public Hearing date of December 19, 1966 re: Declaring Weeds to be a Public Nuisance. Motion was made Councilman Wentworth seconded by Councilman Allemand to adopt Resolution No. 1070. RESOLUTION NO. 1070 RESOLUTION OF COUNCIL OF THE CITY OF GILROY DECLARING CERTAIN WEEDS GROWING IN THE CITY OF GILROY TO BE A PUBLIC NUISANCE, DESCRIBING WEEDS WHICH CONSTITUTE SUCH NUISANCE, AND PROVIDING FOR GIVING NOTICE OF THE ADOPTION OF THE RESOLUTION BY PUBLI- CATION THEREOF. COUNCIL MEMBERS: COUNCIL MEMBERS: City Administrator Wood presented and explained a report on the proposed Phase I I, Expressway Financing Plan as recommended by the Technical Committee. City Engineer Henry reported on re: six inch sewer main, between Swanston Lane and Forest Street, recommending Alternate IWI that property owners grant a 10 ft. rear lot public utility, easement to the City, City will prepare easements. In the future property owners who redevelop will or new developments shall sewer to Forest Street at their expense. Council concurred with the City Engineer1s recommendation. City Attorney Johnson reported on re: Junk Car Ordinance recommending amendments to the zoning ordinance. A letter from the Chamber of Commerce was read thanking the City for the use of Wheeler Auditorium for the Children1s Christmas Party and a special than~s to the Custodian for hi6 services. City Administrator presented and read a letter from Inter- City Council in re: to Representatives on the County Planning Policy Committee. Mayor Petersen appointed Councilman Went- worth and Dale Connell, Chairman of Gilroy Planning Commission to represent the City of Gilroy. - ..... City Administrator Wood presented and read a letter in re: to the San Martin Water Works, presenting a new proposed sale price. Motion by Councilman Goodrich seconded by Council- man Wentworth and carried that said letter be filed for future reference. 0605 Councilman Buffin reported a City Hall Parking Lot Light was leaning and was not lit. Councilman Duffin inquired about installation of the police and Court House identifying signs. Chief Laizure explained that the Police Signs were ready for installation. -- Mayor Petersen reported the street light out at 1st and Monterey Streets. Director of Public Works explained the policy of replacing lights by waiting until several were out before contacting the Telephone Company for service. .... Councilman Duffin inquired when Representative George Milias would attend the Council meeting to give reasons why the 101 By- Pass Signs should not be installed. Mayor Petersen reported that he would contact Mr. Milias and Supervisor Sig Sanchez and would promise to have one or both at the next Council meeting. City Administrator Wood presented and read letters from Van Amburg of San Francisco, Peter J. Ilios of San Francisco and Gordon Liebert of Cupertino in re: traffic problems through Gilroy. City Administrator Wood presented and read a letter from the Highway Commission in re: to acquisition of right of ways and construction of the By-Pass. City Administrator Wood reported that Mrs. Lena Goicovich has requested the installation of Cit~ parking lot signs on Monterey Street indicating the location of Eigleberry Street. Discussion is had on parking limitation and concurred with the 2 hour limitation. ! Councilman Wentworth suggested that the cork board in the Council room be moved from the side wall to the front to give the audience a clear view of any presentation by staff. -.i Councilman Quartiroli suggested that the large zoning map on the wall be updated. Councilman ~uartiroli inquired about provisions for sidewalks or curbs at the new 7th Street crossing to protect pedestrians. Director of Public Works informed Council that sidewalks and curbs would have to be installed by Division of Highways. City Administrator Wood reported many favorable comments of the Arts and Crafts Show held in the Wheeler Auditorium on Friday, Saturday and Sunday. He also announced that a Christmas Show entitled Christmas Around the World, under the auspices of the Recreation Dance Program will be held on Friday, December 9, 1966 in the Wheeler Auditorium. Budget Amend. City Administrator Wood requested a Budget Amendment to Animal Control increase Acoount 17Cl in the amount of $350, regarding a dog box for Animal Control. Motion was made by Councilman Goodrich seconded by Councilman Allemand and carried that the 1966-67 Budget be amended to increase Account l7Cl in the amount of $350 as recommended. Mary Goshert, Chief Librarian extended an invitation to the Mayor and Councilto view Livermore and Tracy Libraries on Satuciday, December 10, 1966. """. .... Employee Xmas Turkeys turkeys made by carried Purchasing Agent Reinsch requested authorization to purchase for Council's annual gift to City Employees. Motion was Councilman Wentworth seconded by Councilman Allemand and authorizing Purchasing Agent Reinsch's said request. Director of Public Works Kludt reported that the Division of Highways submitted a proposal to install signal lights at First and Church Streets providing the City prohibits parking on First Street from Rosanna Street to Eigleberry Street on both sides of the street. Council concurred with the prohibition of parking on First Street at the time of signalization. ~G06 " City Engineer Henry reported on train speed zone change through the City. Council concurred with speed change if signalization is accomplished at Luchessa Avenue. At 11:00 P.M. motion was made by Councilman Goodrich seconded by Councilman Wentworth and carried to adjourn.
