Petersen at 8:00 p.m. Roll Call Present: Council Members: John E. Allemand, George T. Duffin, Chester R. Eckard, Norman B. Goodrich, Charles F. Quarti- roli, Everett C. Wentworth, and Kenneth L. Petersen. Award of Certificates The Mayor awarded Certificates of Service to the following to retiring retiring Commissioners: Mrs. Dorothy Chiesa, Parks & Recreation Commissioners Commission; Mrs. Kendall Pine, Library & Culture Commission and Edware Peterman, Planning Commission. The following Commissioners were absent and said certificates will be delivered to them: Roy O. Mead and Vernon Gwinn Sr., Personnel Commission and James Neilson, Planning Commission. Minutes The minutes of the-Regular Meeting of January 16, 1967 were approved as mailed and recorded. Council tabled approval of the minutes of the Special Meeting of January 25, 1967 in order to hear an objection to same by the City Attorney later on in the meeting. Pub.Hear.re: Wren-Monterey Farrell Annex. The Mayor stated that it was the time and place scheduled for the Public Hearing on a proposal to annex 50.521 acres of un- inhabited territory to be known as "Wren-Monterey-Farrell Annexa- tion to the City of Gilroy'l. City Administrator Wood explained the location of the proposed annexation. The Mayor declared the Public Hearing open and asked if anyone in the audience wished to speak for or against the proposal. Mr. William Betzner, of Route I Box llA, Farrell Avenue, and Mr. Joseph R. Viviano of 1501 North Monterey Street, respect- ively add reseed the Council and inquired about city services to the proposed area if same were annexed to the City of Gilroy. Motion was made by Councilman Goodrich seconded by Coun- cilman Allemand and carried that the Public Hearing be closed. '-. 06;) ') - .::..J_ Res.#1078 & Ord.787 re: Wren-Monterey- Farrell Annex. Res.#1079 re: Se If-He 1 p Project The City Attorney presented and read Resolution No. 1078 referring to no majority protests. Motion was made by Councilman Goodrich seconded by Councilman Wentworth to adopt Resolution No. 1078. RESOLUTION NO. 1078 RESOLUTION DECLARING THAT NO MAJORITY PROTEST HAS BEEN MADE TO THE ANNEXATION OF TERRITORY DESIGNATED IN THE PROCEEDINGS AS "WREN-MONTEREY-FARRELL ANNEXATION TO THE CITY OF GILROY". PASSED AND ADOPTED immediately following the hearing mentioned in this Resolution, this 6th day of February, 1967, by the follow- i ng vote: AYES: ""'-\ ...... City Administrator Wood presented a Resolution of the Gilroy area Service Center requesting Council Support in,'re: to a Proposed Self-Help Project. Mr. Joe Sarsoza of the Gilroy Area Service Center addressed the Council and further explained the proposed Project. Motion was made by Councilman Goodrich seconded by Coun- cilman Duffin that Resolution No. 1079 in Support of said Self- Help Project be mopted. RESOLUTION NO. 1079 GILROY HOUSING PROJECT 8ASSED AND ADOPTED by the City Council of the City of Gilroy this 6th day of February, 1967, by the following vote: AYES: COUNCIL MEMBERS: Allemand, Duffin, Eckard, Goodrich, Quartiroli, Wentworth, and Petersen. COUNCIL MEMBERS: None COUNCIL MEMBERS: None NOES: ABSENT: City Administrator Wood noted that such a Project would have to be completed on lands outside the City since Farm Housing Administrati,on qualifiCations are based upon a community of less than 5,500 population and stated that sewer "and water facilities would be requested of the City. It was noted that this coulcf be accomplished by an Agreement between the property owners and the City because othese services are not ordinarily furnished to land not annexed to the City. Further that in said proposed Agreement a stipulation could be included that after completion of said Self-Help Project the property owners would agree to be annexed to the City of Gilroy. Council concurred with this arrangement and noted that it was not the City's policy to provide City services to territory outside the City but that this type of arrangement could possibly be negotiated. ...- ........ 062B Mrs. Hannah Costello, addressed the Council and inquired about rezoning property on Swanston Lane from Industrial Zoning to ResidentiaJ Zoning. Mrs. Costello was informed that rezoning requests must be submitted in writing to the Planning Commission. St. I mprovemen t re: N.Forest St.-Swanston Lane City Administrator Wood presented and read a Petition from North Forest Street-Swanston Lane Homeowners, requesting Street Improvements Under an Assessment District. City Administrator Wood described the location of said request and noted that ap- proximately 34.2% of the property owners had signed said petition and noted that two additional property owners have indicated that they would possibly sign, total land area, if approved by these additional two owners would be approximately 66 2/3% in favor of said Assessment District. ...... -- City Engineer Henry reported on the estimated cost for said proposed Improvements. Council recognized the filing of said Petition and referred same to Staff for further study. I.F.D.E.S.Annual City Administrator Wood presented a request of the I.F. Parade D.E.S. Portuguese Society for its Annual Parade on April 30, 1967. Motion was made by Councilman Goodrich seconded by Councilman Allemand and carried that the request be granted. Plan. Com. Report 1119/67 Meet. Secretary of the Planning Commission Kludt reported on the Planning Commission meeting of Thursday, January 19, 1967 informing the Council of the Commissions' dicussion of Official Plan Lines for Chestnut Street, review of the rezoning on the extension of Church Street and heard a request to establish an architectural review committee. He also noted that the Commis- sion requested a Joint Plan. Com.-Council work meeting on February 27, 1967, at 8:00 p.m. to discuss with Mr. Warren Jones, Planning Consultant, the regulations of signs within the Com- munity. Council agreed to meet with the Planning Commission at the date suggested and requested that the rezoning proposal on the extension of Church Street also be discussed and reviewed at this Joint Meeting. -" ...... / Plan. Secretary of the Planning Commission Kludt reported on the Planning Commission meeting of Thursday, February 2, 1967, informing the Council of a Public Hearing held on the rezoning request of Dr. Joseph McCormack for a zone change at the South- west corner of Sicth Street and Miller Avenue From "R-l", Single Family Residential District to "C-01I Commercial Office District, noting that the Commission denied said request: informed of a Pub 1 i c Hear i ng he 1 d on the Use Perm it reques t of I:J.gnnah ,R--CQS- tello to install a single family residence at 649 Swanston Lane, noting that same was granted; informed of three (3) Public Hearings held on amendments to the Zoning Ordinance involving the following items: establishment of an li_Z" Interim Zone, lengthening the time of appeal from 10 to 15 days and changing the title of the "C-O Zone to liP-Oil Professional Office Dis- trict. Secretary of the Planning Commission Kludt also noted that the Commission is presently studying and reviewing Archi- tectual Control permits and House Moving Permits of other cities. Pub. Hear. re: Zon.Ord.amend- ments Motion was made by Councilman Wentworth seconded by Councilman Goodrich and carried that Monday, February 20, 1967 at 8:00 p.m. be set for three (3) Pbblic Hearings on amendments to the Zoning Ordinance as recommended by the Planning Commission, in the above report. ...... ... Minutes 1/25/67 The City Attorney presented a statement regarding the Sp1.Meet. minutes of the Special Meeting of January 25, 1967 re: the matter of his "reversed Decision regarding Section 6.2 of the City Code". He requested that said minutes be changed to in- dicate that he "suggested that Section 6.2 of the City Code cou I d be fo llowed'l. Council instructed Staff to review the recording of said Council minutes and the minutes of the Council meeting of January 3, 1967 when Section 6.2 was first d~scussed for presen- tation to the Council at their next meeting. 2624 Plan Li ne I n- fluence re: Assessed Val- uat ions City Administrator Wood presented and explained a Report on Plan Line Influence on Assessed Valuations. Appointment re: City Administrator Wood reported on Ordinance in re: to Henry as Dir. Re-Organization of the Department of Public Works. Motion was Pub.Wks.-City made by Councilman Eckard seconded by Councilman Wentworth and Eng. carried that William K. Henry's appointment as Director of Public Works-City Engineer be officially approved as recommended by City Administrator Wood. Review re: Appointement Water Fore- man Attn.Gen.Zone Meet. Report ---- City Administrator Wood reviewed Council action regard- ing the appointment of a Water Foreman. Discussion was had. Council concurred with said appointment with the understanding that said Foreman continue as a Ilworking foreman". ....... Council acknowledge the appointment of Max D. Kludt as Assistant Director of Public Works-Assistant City Engineer and thanked him for his previous services as Director of Public Works. Noted Police Chief Laizure's Report in regard to Attorney General's Zone Meeting. 701 Application City Administrator reported on status of the City's 701 App 1 i ca t i on . 1967 Gasoline Cont. Purchasing Agent Reinsch reported on the Gasoline Contract for 1967. Discussion was had regarding the uee of premium gasoline in six cylinder City Vehicles. S.C.Co. Council agreed not to submit an argument against the proposed ordinance as presented with the Initiative Petition. - A letter from the Santa Clara County Flood Control and Water District in re: to Consolidation of the District and the Two Water Conservation Districts, was presented. Councilman Wentworth reported that Mayor Petersen, Dr. Elmer J. Chesbro, and himself attended said meeting in which it was agreed to con- solidate said districts under the name of "Santa Clara County Water Resources District". A letter from the State Department of Public Health Reporting and Congratulating the City in regard to its Water Quality During the Past Year was presented. A letter from the California Roadside Council in regard to a request for Billboard Sign Control was presented. Council had no objection to any of the solicitation requests presented. Public Land Law A letter from Senator Kuchel was presented in regard to Review Com. Hearings of the Public Land law Review Commission. 25 yr. Service Dinner-Fazio The Twenty-five (25) Year Service Dinner for Tony Fazio on February 7, 1967 in Morgan Hill was noted. Letter of Thanks A letter of thanks from St. Stephens Welfare Society was St. Joseph's presented in regard to the donation in the name of the City of Welfare Gilroy from Wal~ Corporation. Letter of Thanks A letter from Dennis DeBell in regard to the City's D.DeBell efforts at the Wagon Wheel Mobile Park during the recent flood at that location was presented and read. ABAG Home Rule Lease re: Junk Autos 167 St. Program Roy Uyeno's contribution to City during heavy rains Letters from the Cities of Santa Clara, Los Gatos, and Palo Alto were presented regarding ABAG Home Rule, noting that Los Gatos approves, Palo Alto approves with certain conditions and Santa Clara opposes same. Council tabled the matter as to City of Gilroy act;on. City Administrator Wood presented a proposal from "A-l Auto Wrecking" in regard to a Lease arrangement with Frank W. Robinson & Jessie Abbott, owners, for disposal of Junk autos on City owned property between the Garbage Dump and Levee. Council requested that the City property and service be advertised for bi ds. Discussion was had regarding the proposed Street Program for 1967. Assistant Director of Public Works Kludt reported that Mr. Roy Uyeno furnished the City with his pump, operator and fuel during the heavy rains on January 31, 1967 at no charge to the City. Council requested that a letter of appreciation be for- warded to Mr. Uyeno for this contribution to the City. Not Thru Street The Mayor requested that a sign indicating "not a S.Alexander through street" be installed at South Alexander Street and 9th Street. Crum Tract access Mayor Petersen reported that residents at the Ctum Tract to homes were unable to get into their homes during the recent heavy rains due to the large dip in the road. Assistant Director of Public Works Kludt reported that the City did everything possible to alleviate the situation without a major construction project.
