The Regular Meeting of the Gi lroy City Council was cal led to
order by His Honor Mayor Norman B. Goodrich at 8:00 p.m.
Present: Council Members: Fred P. 8atrez, George T. Duffin,
Mark E. Kennedy" John E. Pate, Anthony C. Si lva, Everett C. Wentworth,
and Norman B. Goodrich.
Absent: Counci I Members: None.
The Minutes of the Regular Meeting of June 2, 1969, and the
Adjourned Meeting of June 3, 1969, were approved as mai led and re-
corded.
The City Attorney read Resolution No. 1361 honoring the heroic
actions of Miss Susan Hansch and Mr. Bruce Hagen, local youths, who
were credited with saving the life of Carlos Valdez at the High
school swimming pool on Friday, May 30, 1969. Motion was made b,y
Counci lman Wentworth seconded by Counci lman Silva and carried that
Resolution No. 1361 be adopted.

The Mayor stated that it was the time and place for a Publ ic
Hearing on the adoption of the 1969-70 Fiscal Year Budget.
City Administrator Wood reported on the A~journed Meeting o~
June 3, 1969, with representatives of the three (3) employee associ-
a t i on s .
Salary Inc., Council recommended granting a 7~% salary increase (effective
Vacation Bene- 7-1-69) and a 2~% salary increase (effective 1-1-70); recommended
fits, etc. unlimited accumulation of sick leave without compensation; vacation
Lenefit of three 0) weeks vacation after five (5) years of employ-
ment with the City; and recommending that overtime and compensating
time off for Fire Department employees be based on a forty (40) hour
week. The City Administrator was authorized to work out an agree-
ment with Fire Department emplo~ees for compensation of accrued time
off to date. Discussion was had. Motion was made by Councilman
Wentworth seconded by Councilman Si Iva and carried that the Memoran-
dums of Understanding on Wage and Fringe Benefits as presented by
the three employee associations, with adjustments made at toni.ght1s
meeting, be approved.

$1,000 per year salary in c~ease.

City Administrator Wood presented Resolution No. 1362 Approv-
ing the 1969-70 Fiscal Year Budget. Motion was made by Counci Iman
Pate seconded by Counci Iman Si lva and carried that the reading of
Resolution No. 1362 be waived and that it be adopted.

Director of Public Works-City Engineer Henry reported on the
Planning Commission Meeting of June 5, 1969, noting a public hearing
on the petition of A. G. Stevens, agent for Standard Oi 1 Co., for a
conditional use peemit to construct a. service station at the north-
east corner of Murray Avenue and Leavesly Road, noting the Commis-
sion's approval granting said use permit subject to improvement plans
and a development agreement; heard report of a public hearing held w
on the request of W. R. Howson and Darol Gardner to rezone approxi-
mately 22 acres on ~anta Teresa Expressway South of Hecker Pass High-
way from "R-I" to IIR-4". At the request of Mr. Howson, the Counci I
referred the matter back to the Planning Commission for their meet-
ing of June 19, 1969. Noted a pubi lc hearing on the request from
Horace Wi I lard to rezone 10 acres at the north side of Hecker Pass
Highway, Approximately 700' east of Morey Avenue, from "R-I" to "R-
3" and "C-I", noting the Commission's recommendation for rezoning
of the "R-I" to "R-3" property and denial of the "R-I" to "c-I" por-
tion; noted pubi Ic hearing held on a petition of Mr. Hy Weisel to
prezone 154 acres at the southwest corner of Monterey Highway and
Fitzgerald Roadlto "R-qll , "R-2", "R-3", and "C-I", noting.
denial of prezoning request due to density and recommending against
annexation at this time; noted pubi Ic hearing held on Section
68.10 of the sign ordinance; noted request of George Duffin to
rezone property on N. Church Street to "R-3", further noting that

Motion was made by Councilman Wentworth Seconded by Counci 1-
man Pate and carried that a Pubilc hearing date be set for July 7,
1969, to consider the rezoning I-equest of Horace Wi lIard.
Motion was made by Councilman Pate seconded by Counci Iman
Duffin and carried that a Public Hearing date of July 7, 1969, be
set to consider the prezoning lequest of Hy Weisel.
City Administrator Wood reported on the minutes of the Lib7
rary and Culture Commission Meeting of June 3, 1969.

City Administrator Wood reported on Uncollectable Water and

Councilman Wentworth seconded by Councilman Pate and carried that

the 1968-69 Fiscal year be granted.
City Administrator Wood presented and recommended Salary Mer-
it Increases for the following three (3) employees to become effec-
tive July 1, 1969: Mrs. I. Wenneberg, Cleck-Tyist - Range 19 from
Step A ($427/mo. ) to Step B ($4491 mo.) ; Anthony Martin, Streets and
Fore~an - Range 27 from Step D ($713/mo.) to Step E ($767/mo.; and
Sheldon Shelvock, Sewer Plant Operator - Rangle 25.5 from Step B ($617
Imo.~ to Step C ($647/mo.). Motion was made by Councilman Kennedy
seconded by Councilman Pate and carried that the salary merit increa-
ses as recommended be granted to become effective July 1, 1969.
City Administrator Wood requested approval and authorization
to execute a Purchase. Agreement for a one (1) acre parcel of lan~
and a small residence from Mrs. Elisa Garcia in the amount of $7,800)
for the Northside Park Project. Motion was made by Councilman Ken-
nedy seconded by Counci lman Pate and carried that the request of the
City Administrator to execute a purchase agreement for the acquisi-
tion of said property be granted.
City Administrator Wood reported on the Population Estimate
for the City of Gi lroy by the State Department of Finance noting
that the in-city population, as of Apri 1 I, 1969, was 11,250.
City Administrator Wood reported on three (3) narrow strips
of residual land left under the Tenth Street Project. Discussion
was had. Council tabled actnon to the egular meeting of July 7,
1969, so that the City Administrator can discuss same with the Coun-
ty.
City Administrator Wood noted approval of a Federal Grant for
a proposed Senior. Education Program in the amount of $2,280.00. Mo-
tion was mad~ by Councilman Duffin seconded by Councilman Wentworth
and carried that the City Administrator be authorized to execute the
Agreement with the California Commission on Aging.

City Administrator Wood noted approval of a Highway Safety
The report of Satisfactory Water Samples taken by the Santa
Clara County Health Department was noted, covering the period to
May 20, 1969.
City Administrator Wood noted that requests for l'Whi.tehurst
Annexation 69-111 and "Fitzgerald Ann~x~_t_ion~9=1" have been filed
with the Local Agency Formation Commission and will appear on the
July 2, 1969 Agenda. Discussion was had on Open Space Plans on
Leavesly Road. Motion was made by Councilman Duffin seconded by
Counci lman Wentworth and carried that the Council take a non- commit-
tal attitude towar,ds these annexations.

Unsafe Bldg.- demolition proceedings regarding an unsafe structure at 223 East
223 E. 6th St. Sixth Street, noting that Mr. Glen O. Smallcomb, Jr, owner, will

The City Attorney presented a proposed ordinance establish-
ing sewage standards,and control and amending or repealing certain
sec~ions of the of the Gilroy City Code in conflict therewith. Dis-
cussion was had. Councilman Wentworth noted approval of the Sewer
Committee in regard to the proposed ordinance. Motion was made by
Counci lman Wentworth seconded by Counci lman Kennedy and carried that
the reading of the proposed ordinance be waived and that it be
published by title and summary.
City Administrator Wood reported on the Agreement for
lease of the concession stand at Christmas Hi 11 Park. Motion was
made'by Councilman Duffin seconded by Councilman Wentworth and
,carried that the agreement form be approved and that the Director
of Parks and Recreation be authorized to call for bids for bids for
lease of the concession stand.
The City Administrator reported on the Northside Park
Relocation Plan and presented Resolution No. 1366 Setting Schedule for
Annual Gross Rentals. Motion was made by Counci;lman Wentworth sec-
onded by Councilman Duffin and carried that the reading of Resolution
No. 1366 be waived and that it be adopted.

of license fees for refreshment stands was noted. Mot i on was made
by Councilman Wentworth seconded by Councilman Kennedy and carried
that the request for waiver of license fees be denied and that the
City Administrator send a letter of explanation to the Committee.

A letter from the Post Office Department regarding possible
traffic problems at the proposed three post office sites was pre-
sented. Council requ6~ted the City Administrator to advise the
Post Office Department that the Council is agreeable to any
Downtown location and that there are no serious traffic problems
in regard to the three downtown locations being considered.

A letter from Congressman Charles S. Gubser was noted
in regard to the Library Grant.
A letter from Senator Clark L. Bradley expression his
opposition to Assembly Bill No. 1414, was noted.
A letter from Assemblyman George W. Milias expressing
his oppostion to Senate Bi 11 No. 1[,.14, was noted.
Councilman Wentworth reported on the Sewer Committees
meeting with Bob & Howard Linderleaf regarding the problem of
sewer farm water on their property. Possible solutions were dis-
cussed. Mr. J.ohn Hopkins, attorney representing the Linderleafs,
addressed the Council. The Mayor thanked Mr. Hopkins for his
presen ta t i on.
Director of Public Works Henry reported on the street
repairs on Mi Iler Avenue resulting from trenching done by the
Telephone Company. It was noted that repairs on the west side of
Miller Avenue are the responsibility ,of Mr. Sam Spencer, and
street repairs on the north side of Sixth Street, between
Princevalle and Mi Iler Avenue, are the City's responsibility.
Counci I Wentworth noted the League of California Cities
Annual Convention to be held in San Francisco from September 28,
1969, to October I, 1969, recommending that reservations be made
as early as possible.
Counci Iman Pate inquired as to the status of the new
Library facility. City Administrator Wood commented on same.
Counci Iman Si Iva inquired about some old pipe that was
lying about the sewer farm after the building of the levee.
Director of Public Works Henry stated that he would send his crew
to clean up.
Counci lman Batrez asked if there were any problems in
regard to acquisition of properties for the Northside Park
Project. City Aministrator Wood commented on the housing short-
age in the Gi Iroy area.
Fire Chief Bnittain invited the Council to review train-
ing exercises at Luchessa Avenue on the morning of June 21, 1969.
The Mayor noted the presence of Supervisor Sig Sanchez
