The Regular Meeting of the Gilroy City Council was called to
order by His Honor Mayor Norman B~ Goodrich at 8:00 p.m.
Present: Council Members: Fred P. Batrez, George T. Duffin,
Mark E. Kennedy, John E. Pate, Anthony C. Si lva, Everett C. Wentworth,
and Norman B. Goodrich.
The Minutes of the Regular Meeting of January 18, 1971 were
approved a~ mailed and recorded.
City Administrator Wood reported on the following bids
received January 28, 1971 for the Gilroy Fire Headqua'rters Station:
1) Gordon Farotte, Gilroy - Base Bid - $133,260.00, Alt. #1 - $5,416.00,
Alt. #2 - $2,420.00; 2) Joe W. Cullumber - San Juan Bautista - Base Bid-
$145,600.00, Alt. #1 - $5,248.00, Alt. #2 - $1,383.00; 3) William Radtke-
Gilroy - Base Bid - $153,000.00, Alt. #1 - $6,590.00, Alt. #2 - $3,215.00;
4) Dyal Stone & Assoc., Inc. - San Jose, Base Bid - $141,515.00, Alt.
#1 - $5,264.00, Alt. #2 - $4,942.00. The total estimate was in the
amount of $160,000.00.
Mr. Robert Wong, A.I.A. addressed the Council recommending
that the low base bid and Alternate No.1 be awarded and recommending
that $3,000.00 be ear-marked for contingencies; and if required that
the City Administrator be authorized to approve change orders up to
the amount of $500.00.
Motion was made by Councilman Kennedy seconded by Council-
man Silva and carried that the low bid of Gordon Farotte be awarded
for the base bid of $133,260.00 plus Alternate No.1 in the amount of
$5,416.00; that the Architect's recommendation to allow an additional
$3,000.00 for contingencies and that the City Administrator be auth-
orized to approve change orders up to the amount of $500.00.
Secretary of the Planning Commission Henry presented and
explained the Report of the Planning Commission Meeting of January
21, 1971 recommending approval of a Planned Unit Development and zone
change requested by Samuel R. Spencer for property located we\s~terly of
and adja~ent to Mesa Road northerly of Gavilan Jr. College containing
24.1 acres. Motion was made by Councilman Wentworth seconded by
Councilman Pate that' a Public Hearing date of February 16, 1971, be
set for the proposed Planned Unit Development and rezoning request.
The Planning Commission report further noted approval of a
Conditional Use Permit granted to allow two (2) free standing signs
at 8655 Monterey Street; noted approval of a Conditional Use Permit
to Donald J. Triolo for a Texaco Inc. Service Station located on the
northerly side of Tenth Street approximately 206 feet east of Chestnut
Street; recommended amendment to Sections 23.2 and 24.9 to change
density requirements in R-3 zones and require a conditional use permit
for more than three (3) bedroom units in an R-2 zone. Motion was
made by Councilman Pate seconded by Councilman Wentworth and carried
that a Public Hearing date of February 16, 1971 be set for said zoning
ordinance amendment proposal.
Secretary of the Personnel Commission' Reinsch presented and
explained the report of the Personnel Commission Meeting of January
25, 1971 informing Council of the Grievance matter of Patrolman John
Arde and action taken on same by the Commission; recommended approval
of a new classification of Senior Account Clerk, Part-time Recreation
and Mechanic's Helper positions. Resolution No. 1544 approving said
classifications at the recommended ranges was presented. Motion was
made by Councilman Pate seconded by Councilman Silva that the reading
of Resolution No. 1544 be waived and that it be adopted.

City Administrator Wood presented and explained the Report
of the Parks and Recreation Commission Meeting of January 19, 1971,
informing Council of the Northwood Home Owners' Association request
before the Commission; and recommendation of the Commission to~ire
Royston, Hanamoto, Beck & Abbey as Architects to design Northside
Park. Motion was made by Councilman Pate seconded by Councilman
Silva and carried that the Architect firm of Royston, Hanamoto,
Beck & Abbey be hired to des,ign Northside Park.

The Monthly Reports of December 1970 were noted and discussed.
A Report on Bids for Gasoline and Diesel fuel for the period
of February 1, 1971 to Janu~ry ~l, 1972 was presented. Discussion was
had in regard to same. Motion was made by Councilman Batrez seconded
by Councilman Silva and carried that the bid be awarded to Shell Oil
Company for the period of February 1, 1971 to January 31, 1972.
A Notice of Intention to Relinquish Highway Right of Way
from the State of California for SCl-152-Gil. (Old Gilroy Street) was
presen te,d.
City Administrator Wood presented and explained a Report on
applications to the Board of Supervisors for Land Conservation Contracts
under the Williamson Act. Discussion was had in regard to same.
Motion was made by Councilman Duffin seconded by Councilman Pate and
carried that the City oppose the granting of said contract for 200
feet north of Leaves1ey Road on Parcel 822-31-18 (now parcel 835-15-19),
G. P. Sgheiza, but had no obj~ction to the remainder of said parcel to
be included under said land conservation contract.

Motion was made by Councilman Pate seconded by Councilman
Duffin and carried that the City has no objection to Parcel 786-14-6
being granted said land conservation contract.
Motion was made by Councilman Duffin seconded by Councilman
Wentworth and carried that the City has no objection to Parcel 841-15-11
being granted said land conservation contract.
Disbursements The Report of Disbursements from January 1, 1971 to and in-
cluding January 31, 1971 was presented and df~cussed.

Salaries
City Administrator Wood presented a request of ABAG for City
comments on five (5) preliminary comprehensive planning assistance
grant applications by the County of Santa Clara. Discussion was had
on the matter. Motion was made by Councilman Pate seconded by Council-
man Batrez and carried that the City support the County of Santa Clara
in regard to said Grant Applications.

previously introduced and published by title and summary was presented.
Motion wasmade by Councilman Pate seconded by Councilman Batrez that
Ordinance No. 908 be adopted.

Motion was made by Councilman Pate seconded by Councilman
Silva and carried that a Public Hearing date of February 16, 1971 be
set for hearing demolition costs of cabins at Seventh and East Streets
(Rainbow Court B1dgs.)
A letter commending Gilroy Police Officer Sgt. Lemos was
noted.
A letter in regard to a Certificate of Achievement awarded
to Patrolman Lee Eloff was noted. The Mayor requested a letter of
commendation on behalf of the Council be forwarded to Patrolman Eloff
for said achievement.
The Municipal Financing Letter from Stme & Youngberg was
noted.
A letter from Senator Petris in regard to Mandatory Flare
Bill was noted.
Councilman Duffin noted that he will furnish Council with a
written report of the recent South County Consolidation Committee
Meeting.
Discussion was had in regard to amendments, revIsions, etc.
to the General Plan of the City of Gilroy. Discussion was had in
regard to said matter. Council requested that a Joint Meeting of the
Council and Planning Commission be scheduled by Staff to discuss said
General Plan.
Councilman Batrez inquired of additional information in
regard to the availability of the proposed federal funding for the
work training program. City Administrator Wood noted that the matter
would be pursued.
Fire Exercise Fire Chief Brittain informed Council of a Fire Training
. Exercise scheduled for February 7, 1971 at 8:00 a.m. at the Old
Apostolic Church Building.

Adjournment
The Mayor noted the presence of Planning Commissioner Childers.
The Mayor noted the League of California Cities meeting of
February 11, 1971 in San Mateo.
The Mayor noted a letter from the Flood Control District in
regard to a Santa Clara County Water Commission Meeting of February 3,
1971 in Los Gatos was noted. Councilmen Wentworth and Silva indicated
that they would be attending said meeting.
The Annual General Assembly of ABAG February 18, 1971 at
8:00 p.m. in Berkeley was noted.
At 9:43 p.m. motion was made by Councilman Wentworth seconded
by Councilman Kennedy and carried to adjourn to Tuesday, February 16,
1971 at 8:00 p.m.
