The Regular Meeting of the Gilroy City Council was called to
order by His Honor Mayor Norman B. Goodrich at 8:00 p.m.
Present: Council Members: George T. Duffin, John Hughan, John
E. Pate., Anthony C. Silva, David V. Stout and Norman B. Goodrich.
Absent: Council Member: Fred P. Batrez.
The Mayor introduced Michael Casey, Jr., recently appointed
Po 1 ice Cadet.
The Mayor presented Merle Johnson, Fire Captain, with a Certi-
ficate of Achievement in Firemanship, noting that same represented 30
college credits earned.
Councilman Batrez entered at 8;04 p.m. and took his seat at the
Counc i 1 tab 1 e.
The Minutes of the Regular Council Meeting of June 21, 1971 and
of the Adjourned Council Meeting of June 22, 1971 were approved as mailed
and recorded.
The Mayor stated that it was the time and place scheduled for the
public hearing on an application of Charles A. Gilmore to rezone the rear
200 feet of a lot located at 7841 Miller Avenue from R-l to R-3. City
Administrator Wood noted that the applicant has requested a 30 day con-
tinuance in regard to said rezoning request.
The City Attorney noted th"at if the proposed plan is revised that
same would have to be referred to the PEnning Commissi on prior to action
on same by Council.
Mr. Gilmore addressed the Council and noted that he is considering
a revision in said plan.
The Mayor continued the Public Hearing to August 2,1971, at the
request of Mr. Charles A. Gilmore, applicant, and thanked those interested
in sa,id rezoning proposal for being present at this meeting.

Ordinance No. 925 Adopting 17.16(a) of the City Code regarding
vacation for city employees was presented. Motion was made by Councilman
Duffin seconded by Councilman Silva that the reading of Ordinance No. 925
be waived and that it be adopted.

AN ORDINANCE OF THE CITY OF GILROY ADOPTING SECTION 17.16(a) OF THE
GILROY CITY CODE SO AS TO PROVIDE FOR TWENTY DAYS VACATION LEAVE AFTER
FIFTEEN YEARS CONTINUOUS SERVICE WITH THE CITY.

The City Attorney. presented and explained a proposed ordinance
providing for a 5% Utility Users Tax on gas, electricity, telephone, and
cable TV services.

Mr. Langdon, representing the Gilroy Chamber of Commerce, addressed
the Council noting that the Chamber was opposed to the proposed Utility
Tax.

Mr. Dahl, representing Gentry Corp. addressed the Council oppos-
ing said proposed utility tax.
Mr. Vantress, representing Gilroy Foods, Inc. addressed the
Council opposing said proposed utility tax.
Mr. Frank Caliri, representing Gilroy Cable TV addressed the
Counc i 1 oppos i ng sa i d proposed uti U ty tax.
Mr. William Mcintosh, representing Pacific Central addressed the
Council oppo~ing sai~ proposed utility tax.
Mr. Don Gallagher, representing Pacific Gas and Electric Company,
addressed the Council explaining said company's problems in administering
a graduated scale for a utility tax.
Discussion was had on the proposed ordinance by Council. Motion
was made by Councilman Batrez seconded by Councilman Pate and carried
that the reading of the proposed ordinance be waived and that it be
introduced and published by title and summary. The following Ro,11 Call
vote carried said motion: Ayes: Councilmembers: Batrez, Duffin, Hughan,
and Pate; Noes: Council Members: Silva, Stout and Goodrich.

by Councilman Stout and carried that the reading of the proposed ordi-
nance be waived and that it be introduced and published by title and sum-
mary.

The City Attorney presented and explained Resolution No. 1580
providing for an increase of 15% in Development Fees. Motion was made
by Councilman Stout seconded by Councilman Pate that the reading of
Resolution No. 1580 be waived and that it be adopted.

RESOLUTION NO. 1580
A RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY ESTABLISHING STANDARDS
FOR THE SUBDIVISION OR DEVELOPMENT OF PROPERTY: DEFINING MINIMUM TYPE
AND QUALITY OF THE PUBLIC SERVICE FACILITIES REQUIRED.

re: The City Attorney presented and explained a proposed ordinance
providing for Swimming Pool Regulations. Motion was made by Councilman
Stout seconded by Councilman Pate and carried that the reading of the
proposed ordinance be waived and that it be introduced and publ ished by
title and summary.
The City Attorney reported that the City is presently operating
under the 1967 Building Code Fees; that it is not necessary to adopt
the fees under the 1970 Code as they are the same.
Resolution No. 1581 allocating salary for the City Administrator
and City Attorney w~s presented and read. Motion was made by Councilman
Pate seconded by Councilman Duffin that Resolution No. 1581 be adopted.

The City Administrator ,presented Resolution No. 1582 approving
execution of a contract with H.U..D. for Northside Park Project Amendment
to Increase the fund allocation to $108,570. Motion was made by Council-
man Hughan seconded by Councilman Silva that the reading of Resolution
No. 1582 be waived and that it be adopted, authorizing the Mayor to
execute said contract on behalf of the City.

City Administrator Wood presented and read a letter from Mrs.
Bonnie Baldwin, Library and Culture Commissioner, resigning from said
Commission. Motion was made by Councilman Hughan seconded by Council-
man Batrez and carried that Mrs. Baldwin's resignation be accepted
with regret. The Mayor requested that Council submit names of citizens
interested in replacing Mrs. Baldwin on said commission.
City Administrator Wood noted a request from the League of Calif.
Cities for the city's support in opposition to A.B. 1057 re: IIRegional
Government". Discussion was had in regard to same. Motion was made by
Councilman Duffin seconded by Councilman Stout and carried that the City
support ABAG and the League of California Cities urging local legislators
to oppose said Assembly Bill.
Director of Public Works-City Engineer Henry reported that a
request before the County Planning Department for a Conditional Use

Vehicles
Permit on the F. V. Hopkins Property (26 acres) adjacent to Lena Avenue
and south of the Knepper parcel. He recommended that the Council request
said permit be issued with the same stiput1ations and conditions placed
upon the Conditional Use Permit for a Quarry on the Knepper Property and
that a letter be forwarded to the County Planning Department in this ....
regard. Motion was made by Councilman Duffin seconded by Councilman
Hughan and carried that a letter be forwarded to the County Planning ...
Department as recommended by the Director of Public Works-City Engineer
in regard to the Conditional Use Permit for a quarry on the F. V. Hopkins
property adjacent to Lena Avenue.
The Mayor appointed Councilman Duffin, Chairman and Council
Members Pate and Silva to a Classification Study of all city supervisory
personne 1.

Councilman Hughan inquired of the'charges in regard to dumping
garbage, etc., at the city dump, noting .that he had received a complaint
in regard to said charges. City Administrator Wood noted that he would
contact the South Valley Refuse Disposal in regard to same.
The Mini Minutes of the Planning Policy Committee of Santa Clara
County meeting of June 24, 1971, were noted. Representative Pate further
explained said minutes, noting that the Grant had been approved for the
Housing Element Project and that the ,Open-Space element proposal re-
quirement for inclusion in the cities' general plans, had been scheduled
for July, 1972.
Councilman Batrez inquired of the re-turfing of S. P. Park noted
in the monthly reports. Staff noted that said pro~ct was for only pot
hole areas of said park.
Director of Public Works-City Engineer Henry informed Council
of the proposed schedule of the Allan Meat Co. proposal to locate their
plant in the Gilroy area.

Director of Public Works-City Engineer Henry reported on the
progress in regard to signs located throughout the city in violation of
the city ordinance regulating same.
Purchasing Agent Reinsch noted that the city barbecue has been
scheduled for July 24, 1971.
Purchasing Agent Reinsch requested permission to advertise bids
for new police vehicles. Motion was made by Councilman Silva seconded
by Councilman Duffin and carried t~t Staff be authorized to adv:ertise
bids for city pol ice vehicles as soon as the new 1972 vehicles are
avai 1able.
Chamber of Com. The Mayor introduced Mr. Paul Baxter,new Secretary-Manager of
new Sec1ty- the Gilroy Chamber of Commerce replacing Mr. Roy Westphalinger.
