The Regular Meeting of the Gilroy City Council was called to order
by His Honor Mayor Norman B. Goodrich at 8:00 p.m.

TING NEW SECTIONS 73 AND 74 OF THE ZONING ORDINANCE.

County Med. A letter from the County of Santa Clara regarding a sewer connection
Clinic for the proposed Medical Clinic to be constructed on Highland Avenue in San
Martin was noted. The Mayor tabled action on said letter to await the City
Administrator's return from vacation.
Com. Center A letter from the Gilroy Community Center Senior Advisory Board was
Sr.Adv. noted and discussed requesting to use a portion of budgeted landscaping funds
Bd. ($4,000.00) for an air conditioner. Discussion was had. Parks and Recreation
Director Ayer noted that an application has been filed with the Council on
Aging for additional funds for air conditioning the entire Community Center;
that if said funds are granted the air conditioning system for the Community
Center Building would be installed throughout the entire building and only a
portion of the $4,000.00 may be required. Motion was made ~y Councilman Link
seconded by Councilman Childers and carried that the $4,000.00 .or any portion
thereof of budgeted landscaping funds be ear-marked for the air-conditioning
system at the Gilroy Community Center.

Council for A letter from the Council for a Balanced Community was noted request-
Balanced ing a representative of the City and a citizen to attend a Planning Meeting
Community on August 19, 1976. The Mayor appointed Councilman Stout and retired Plan-
ning Commissioner Trevis Berry to represent the City at said meeting.
The following informational items were noted with no separate discus-
sion on same excepting Items 8 and 9.
Letter from Pacific Legal Foundation regarding the San Felipe Li ti ga-
tion;
Notice of proposed tariff changes in Hestern Union rates;
Report from ABAG on the July 16, 1976 meeting with the Mayor, Counci 1
Members and City Staff;
Letter of appreciation from the Town of Los Gatos for efforts of our
Police Explorer Post at a recent Seminar; --
Reply from Senator Alquist regarding AB 301, 1059, 3000, and SB 839;
Letter from Rose Habing expressing appreciation to the Fire Department
for their prompt action on a recent call;
Letter from Santa Clara County Board of Supervisors regarding their
position on the Uvas-Carnadero Corps. of Engineers' Levee Project;
Copies of letter from Brian Cunningham, Chairman, Industrial Committee
to Assemblyman Alquist and Representative Mineta regarding the new Sewer Treat-
ment Plant. Discussion was had. Council took no action however noted disagree-
ment to said letters;

Letter from Jerry Fuchs, representing the Downtown Merchants' com-
mending the Parks and Recreation Department for the Beautification Project
and recommendation on traffic movement on Church and Eigleberry Streets. The
Mayor noted that recently no mention has been made of one-way traffic move-
ment on Church and Eigleberry Street; that said matter was discussed only
during the proposed Beautification Project plans.
Disbursements The Report of Disbursements from July 1, 1976 through and including
July 31, 1976 was noted and discussed.

A Report on the status of the Industrial Director position was noted
and discussed. Motion was made by Councilman Stout seconded by Councilman
Childers and carried that the Agreement Contract with Industrial Director
Raymond C. Ball be terminated.
A Report on Assessed Valuations for 1976-1977 fiscal year and recom-
mendation on tax rates was noted and discussed. Motion was made by Council-
man Duffin seconded by Councilman Link and carried that the City Tax rate
for 1976-77 be set at $1.20 per $100. assessed valuation. Councilman Stout
voted "no" on the motion.
Ordinance No. 76-14 Fixing amount of revenue from property taxes
necessary to support the City Departments was presented. Motion was made
by Councilman Pate seconded by Councilman Link that the reading of Ordinance
No. 76-14 be waived and that it be adopted.

OF THE CITY OF GILROY FOR THE FISCAL YEAR 1976-1977.

Ordinance No. 76-15 setting the 1976-1977 Tax Rates was presented.
Motion was made by Councilman Pate seconded by Councilman Link that the
reading of Ordinance No. 76-15 be waived and that it be adopted.

CURRENT FISCAL YEAR 1976-1977 NECESSARY TO SUPPORT THE DEPARTMENTS AND
BONDED INDEBTEDNESS OF THE CITY OF GILROY AND THE CITY OF GILROY PARKING
DISTRICT NO. 1 - FIRST AND SECOND DIVISIONS.

Police A memorandum regarding a proposal to remodel the police facilities
Bldg. building was noted and discussed. Council had no objection to advertising
bids for same.
TV Insp. Director of Public Works-City Engineer Hansen presented and ex-
of Sewers plained a report on TV inspection of Sewers - Phase I.
Cal Can Director of Public Works-City Engineer Hansen reported on a request
of Cal Cannery to use City water, noting that he had anticipated a letter
from said company in regard to said request; to date said letter had not been
received. Council took no action to await a formal request of same.
Maint.-Resur- Director of Public Works-City Engineer Hansen presented and explained
facing a report on a change to the Maintenance-Resurfacing Project to include Las
Proj. Animas Park Paths.

PERS Credi t
S.Sanchez
The City Attorney reported on a request of Supervisor Sanchez
re: PERS credit. He further noted that he had presented Council with a
written report on said matter at the last Council Meeting. It was noted
that Supervisor Sanchez had notified the City that he would not be able
to attend this Council Meeting. Motion was made by Councilman Stout
seconded by Councilman Pate and carried that the request of Supervisor
Sanchez for PERS credit be denied.
Plan. Com. App.- The Mayor recommended that Mr. Hiram C. IlHy" Miller be appointed
Hy Miller to fill the unexpired term of retired Planning Commissioner, Trevis
Berry, January 1, 1977. Motion was made by Councilman Link seconded by
Councilman Childers and carried that Mr. Hiram C. Miller be appointed
to fill the unexpired term of Trevis Berry, retired Planning Commissioner.

Councilman Stout reported that the Council Sewer Advisory Com-
mittee has tentatively set a date with Morgan Hill regarding their recent
request for increased sewer capacity; however, do not intend to take any
action on same until the City Administrator returns from vacation.
Councilman Childers requested that the City review its recent
action prohibiting use of outside watering between 8:00 a.m. and 8:00
p.m. and suggested that the hmn's be changed to 8:00 a.m. to 6 :00 p.m.
Discussion was had on the matter.
Resolution No. 76-43 was presented amending the previous water
conservation resolution to permit outside use of water before 8:00 a.m.
and after 6:00 p.m. Motion was made by Councilman Stout seconded by
Councilman Pate that the reading of Resolution No. 76-43 be waived and
that it be adopted.

Councilman Duffin invited present and past elected Council Members
to a Kiwanis Club Barbecue at Renz's Gulch on September 13, 1976, honoring
municipal elected officials.
Discussion was had on recent complaints Councilmen have received
in regard to dogs running at large throughout the City. The Mayor
instructed City Administrator Protempore Reinsch to advise the County of
Santa Clara that many dogs are running at large prior to 8:00 a.m. and
after 5:00 p.m.
Councilman Link inquired about AB 15 suggesting City opposition
to said bill. City Administrator Protempore Reinsch noted that Council
took action on same at the August 2, 1976, Council Meeting and the local
representatives have been advised of this action.

City Administrator Protempore Reinsch reminded the Council of the
City barbecue on August 21, 1976, and that Council will be serving at
7:00 p.m.

The Mayor inquired if any Councilmen were planning to attend the
Chamber of Commerce barbecue on August 28, 1976, since they were invited
to serve at said barbecue. Councilmen Link and Childers noted that they
would be attending. The Mayor noted that he would attend and that the
City will pay for the barbecue tickets of those Council Members attending.

Budget Amendment ;personnel Director" Reinsch presented and explained a request for a
re: Part-time budget'amendment in"the amount of $1,200 to provide for part-time clerical
Clerical emp. services until January 1, 1977, to aid in the City's bookkeeping transition
from hand-posting to the computer. Discussion was had on the matter. Motion
was made by Councilman Duffin seconded by Councilman Chidlers and carried
that the part-time employee for clerical services be approved not to extend
past January 1, 1977, and that the budget be amended in the amount of $1,200
for said employee.
Inter-City
Council
The Mayor reminded Council Members and Staff of the Inter-City
Council meeting on September 2, 1976, at the Gilroy Elks Lodge.
Adjournment
At 9:30 p.m., motion was made by Councilman Link seconded by Council-
man Childers and carried that the meeting adjourn to Tuesday, September 7,
1976, due to the Labor Day Holiday, September 6, 1976.
