The Adjourned Regular Meeting of the Gilroy City Council was
called to order by His Honor Mayor Norman B. Goodrich at 8:01 p.m.
Present: Council Members: Brian D. Cunningham, Roberta H.
Hughan, Marion T. Link, John E. Pate, Robert E. Taylor and Norman B.
Goodrich. Absent: Council Member: Sharon A. Albert.
re: The Mayor noted receipt of the Registrar of Voter.s Certifi-
cate of Official Returns of the General Municipal Election of Tuesday,
November 3, 1981.

Motion was made by Councilman Pate seconded by Councilman
Cunningham that the reading of Resolution No. 81-100 be waived and
that it be adopted.
RESOLUTION NO. 81-100
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING AND
ADOPTING THE REGISTRAR OF VOTERS CANVASS OF THE GENERAL MUNICIPAL
ELECTION AND DECLARING RESULT OF SUCH ELECTION HELD IN THE CITY OF
GILROY ON NOVEMBER 3, 1981.
RESOL VED, by the City Council of the Ci ty of Gil roy, Ca 1 iforni a,
that,
WHEREAS, by order of this Council, a general municipal election
was held and conducted in the City of Gilroy and consolidated with the
Biennial Governing Board Member Election, on Tuesday, the 3rd day of
November, 1981, as required by law and the Charter of said City as
amended;
WHEREAS, it appears that notice of said general election was
duly and legally given; voting precincts were properly established;
election officers were appointed and election supplies furnished; and
in all respects, the election was held and conducted and the votes
cast thereat received and canvassed, and the returns thereof made,
determined and declared in time, form and manner as required by the
Charter of said City as amended and the general laws of the State pro-
viding for and regulating for and regulatin9 municipal elections in
said City;

WHEREAS, the Regi strar of Voters di d conduct the canvass of the
returns of said municipal election and did count the absentee ballots
cast thereat, pursuant to direction and order of the City Council of
sa i d City; and
t~HEREAS, said canvass was duly completed and the results thereof
were certified by the Registrar of Voters and submitted to this Council.
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, as follows:
1. Said municipal election was held and conducted in the City
of Gilroy, County of Santa Clara, State of California, and consolidated
with the Biennial Governinq Board Member Election held throughout Santa
Clara County on Tuesday, November 3, 1981, in the time and in the form
and manner as required by law.

2. That there were established eight (8) voting precincts for
the purpose of holding said municipal election consisting of either
reqular election precincts established for holding state or county
elections, or a consolidation of some or all of such precincts, as
follows:

cincts designated Precinct Numbers 3957 and 3959 as established
by the Santa Clara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3958, comprising state and county pre-
cincts designated Precinct Numbers 3958, 3961, 3962 and 3963 as
established by the Santa Clara County Board of Supervisors.

cinct designated Precinct Number 3960 as established by the Santa
Clara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3964, comprising state and county pre-
cincts designated Precinct Numbers 3964 and 3967 as established
by the Santa Cl ara County Board of Supervisors.
CONSOLIDATED PRECINCT NO. 3966, comprising state and county pre-
cincts designated Precinct Numbers 3966 and 3969 as established
by the Santa Clara County Board of Supervisors.

3. The canvass of the returns of the votes cast and the counting
of absentee ballots cast in said City for the offices of City Council-
members and for Measure III" was duly held by the Registrar of Voters in
accordance with the order of the Council and in accordance with law and
said Registrar of Voters has executed a certificate certifying to the
results of such canvass, which certificate is hereto attached, marked
Exhibit "A" and by this reference, is made a part hereof. Said certifi-
cate has been examined and is hereby approved and adopted by this Council
as the official canvass of said municipal election.

4. The whole number of votes cast in said City of Gilroy at said
municipal election was 4,204 (including 71 absentee votes).
5. The names of the persons voted for, the offices for which they
were voted, the number of votes received by each of said persons in each
of said precincts and by absentee votes, together with the whole number
of votes which they received in the entire city, are shown on said Exhibit
"AII, hereto attached.
6. The Measure voted for, the number of votes received in favor
of and against said measure in each of said precincts and by absentee
votes, together with the whole number of votes which each measure received
in the enti re city, are shown on sai d Exhi bit II All, hereto attached.

7. At said general municipal election held in the City of Gilroy
and consolidated with the Biennial Governing Board Member Election held
throughout Santa Clara County on November 3, 1981, the followinq persons
were elected to the following offices:
DONALD F. GAGE, was elected a meMber of the City Council to hold
office for a term of four years, from and after Tuesday, November
10, 1981, and continuing until his respective successor shall
qualify.
ROBERTA HOWSON HUGHANwas el ected a member of the City Council to
hold office for a term of four years, from and after Tuesday,
November 10, 1981, and continuing until her respective successor
shall qualify.
PETE VALDEZ, JR. was elected a member of the City Council to hold
office for a term of four years, from and after Tuesday, November
10, 1981, and continuinq until his respective successor shall
qualify.

8. At said general municipal election held in the City of Gilroy
and consolidated with the Biennial Governing Board Members Election
held throughout Santa Clara County on tlovember 3, 1981, the following
measure was defeated:
Shall the Gilroy General Plan be amended, renumbered and indexed:
1) to add a policy that no industrial use shall be permitted
west or south of Uvas Creek, and
2) to delete the policy permitting compatible industrial parks
with high design standards elsewhere than in "Industrial Parkll
plan areas, and

Shall land when annexed or arlded to the Gilroy Urban Service
Area west or south of Uvas Creek be zoned Open Space until re-
zoned consistent with the General Plan as amenderl.
9. The City Clerk is hereby directed to make out and deliver
to each of the persons elected a certificate of election signed by her
and duly authenticated. She shall also impose the constitutional oath
of office and have them subscribe thereto.
10. That the City Clerk be, and she is hereby, instructed to
enter this resolution in full in the minutes of this Council as a
statement of the result of said general municipal election.
PASSED AND ADOPTED this 10th day of November, 1981, by the

County, do hereby certify .that pursuant to the provisions of the Cali-
fornia Elections Code I did canvass the returns of the General Munici-
pal Election held in the City of Gilroy, California and consolirlated
with the Santa Clara County Consolidated Elections on November 3, 1981,
and that the Statement of Votes Cast to which this Certificate is
attached is a full, true and correct statement of the number of votes
cast for each candidate and for and against Measure I at said General
Municipal Election.

The Mayor adjourned the meeting Sine Die.
The City Clerk administered the oath of office and issued certifi-
cates of election to Council Members Elect, Donald F. Gage, Roberta Howson
Hughan and Pete Valdez, Jr.
The Mayor welcomed the new Council Members. The Council Members
Elect each gave their acceptance speech.

Commissioner Donald F. Gage.

Mayor Protempore The Mayor recommended the aopointment of Councilman Link as Mayor
Protempore to repl ace reti ri ng ~1ayor Protempore Pate. Moti on was made by
Councilwoman Hughan seconded by Councilman Taylor and carried that Council-
man Link be appointed Mayor Protempore.
Advisory
Committees
The Mayor reported that he would make appointments of Active Council
Advisory Committees for retired Council Members replacements at the next
regular Council Meeting of November 16, 1981.

: The Mayor noted appointment of' a Personnel Commissioner to fill
the unexpired term of Commissioner Gaqe (1/1/85) would be made at the
next regular Council Meeting, and requested Council Members to present
names of interested candidates for this anpointment to him for a recom-
mendation on same.
The Mayor noted the Inter-City Council Meeting of November 12,
1981, at Higuera Adobe Park in Milpitas and informed Council Members
to notify the City Clerk if reservations are desired.
At 8:19 p.m., the Mayor adjourned the meeting.
