Mayor Hughan led the Pledge of Allegiance to the Flag.
The City Clerk reported that the Agenda had been posted on
January 29, 1987 at 9:04 a.m.
Present: Councilmembers: Sharon A. Albert, Donald F. Gage,
Paul V. Kloecker, Larry Mussallem, Daniel D. Palmerlee, Pete
Valdez, Jr. and Roberta H. Hughan. (8:02 p.m.).
The Mayor noted a Certificate of Service for Retired
Personnel Commissioner, Harry J. True, not present.
Motion was made by Councilman Gage seconded by Councilman
Kloecker that the following items under the Consent Calendar be
approved by the following Roll Call Vote: Ayes: Councilmembers:
Albert, Gage, Kloecker, Mussallem, Palmerlee, Valdez and Hughan
removing Item "c" Damage Claim of Agnes Law, requested ty Staff
and amended Item "A" regarding Minutes of the 1-19-87 Regular
Council Meeting pertaining to Thomas Road Uvas Creek Levee
Project, noting that Council supported and approved Staff's
recommendation for right-of-way for a six (6) lane bridge on
Thomas Road to include walkways:
Approved the Minutes of the Regular Council Meeting of
January 19, 1987 as amended above;
Adopted Ordinance No. 87-1 Amending Sections 19.96,
19.102(p)(3) and 19.106(h) of the Gilroy City Code pertaining to
Sewage Treatment;

19.102(p)(3) AND 19.106(h) OF THE GILROY CITY CODE PERTAINING TO
SEWAGE TREATMENT.

Noted the Staff Report pertaining to Mobile Homes further
explained by City Administrator Baksa.

Noted Pacific Mobile Estates Rent Stabililzation Review and
Park Upkeep Problems further explained by Mr. Marion T. Link,
spokesman for the tenants within the Mobilehome Park, requesting
permission to speak following presentation by the owners of the
park.
The Mayor asked if there was anyone present in the audience
wishing to speak on the matter.
Ms. Sandy Hennigan, resident of the Mobilehome Park,
addressed the Council and noted that she had taken minutes of the
meetings held at the Park with the owners and could produce them
if necessary.
Mr. Jim Daly, owner of Daly's Trailer Park, addressed the
Council concerned with any rent control that he may have to abide
by; that his business should not be defined as a mobilehome park.
Mr. Anthony Lupina, owner of the Wagon Wheel Mobile Village
on Murray Avenue, addressed the Council noting that fair rent
stabilization should be applied to only those parks that have
problems and that any fees required by the City should be paid
only by those mobilehome parks that are involved in disputes.

Ms. Jorj Tilson, Executive Director of Manufacturing
Housing Educational Trust, addressed the Council noting that the
draft model ordinance procedures need to be defined.
Mr. George Shawver, Space #69, addressed the Council noting
that mobile homes have increased in value; however, their
insurance and taxes have also increased.
Mr. Bill Brown, attorney representing the owners of Pacific
Mobile Homes Estates, addressed the Council noting that a Rent
Control Ordinance will not address the concerns of the tenants
which are regarding upkeep and maintenance; that the owners have
requested the tenants identify and prioritize the maintenance
items requested and that Council take no action at this meeting
in order to allow time to accomplish same and that a meeting with
the tenants and owners has been scheduled in two weeks.
Ms. Sandy Hennigan addressed the Council noting that she
disagrees with a guarantee of rent increases to landlords.
Mr. Marion T. Link addressed the Council requesting that
Staff be instructed to draft a Rent Control Ordinnace that mayor
may not be required following attempted negotiations between the
Pacific Mobile Home Estates owners and tenants.

The Mayor asked response from the audience in regard to Mr.
Link's presentation. Mr. Link received a standing ovation from
the majority of the audience.
Discussion was had by Council on the matter. Council
requested Staff to prepare a Preliminary Draft Rent Control
Ordinance for presentation at the March 2, 1987 regular Council
Meeting to include options and recommendations discussed.

The Mayor deviated from the regular agenda in order to
accommodate interested persons in the audience.
Mr. Dave Downing, Unit~d Way Regional Vice Chairman,
addressed the Council and explained the Program and thanked the
City for its parcicipation.
Noted a Report on a proposed Street Sweeping, Lighting!
Signals and Landscapi~g Assessment District further explained
by City Administrator Baksa.

Mr. John H. 'Heindel, Consulting EngJ.neer, addressed the
Council and further explained the proposed assessment district.
Motion was made by Councilman Gage, seconded by Councilman
Kloecker and carried that Staff be authorized to proceed with the
three projects (Street Lighting, Street Sweeping and Forestry) as
recommended for a proposed Assessment District.
Motion was ~e by Councilman Gage seconded by Councilman
Kloecker and carried that the title for the-district be "Street
Sweeping, Lighting/Signals and Landscaping" Assessment District
and the Tentative Assessment Formula as presented be accepted and
approved.
The Mayor asked Councilmembers for suggested names for
appointment of a City reprsentative on the H.C.D. Advisory
Committee.
A request of Gavilan College for a sewer connection was
noted. Motion was made by Councilman Kloecker seconded by
Councilman Gage and carried that a sewer connection for Gavilan
College be approved per an agreement with Gavilan College.
The Mayor continued with the regular agenda order.
Ms. Dawn Cameron, Planner with the Santa County Transporta-
tion Agency, substituting for Mr. Jim Lightbody, Project Manager,
addressed the Council and explained the Transportation 2000 Draft
Final Plan requesting City comment, opinions and endorsement of
the plan by the end of February 1987.
City Engineer Allen noted lack of emphasis of Santa Teresa
Expressway not included in the Plan and right-of-way for said
Expressway.
The Mayor noted that the City would respond to the County
following a recommendation from the City Engineer.
A Petition requesting Annexation of Uninhabited Territory
to be known as "Buena Vista-Las Animas Reorganization 86-2"
containing 107 acres, (South Valley Intercommunity Hospital,
Applicant), not 100% consent was noted.
Motion was made by Councilman Mussallem seconded by
Councilman Gage that the reading of Resolution No. 87-4
Initiating Reorganization of Territory and Setting March 2, 1987
as a Public Hearing date, be waived and that it be adopted.

Noted a request of ABAG for support for 1996 Olympic Summer
Games to be hosted by the City and County of San Francisco.
Motion was made by Councilman Kloecker seconded by
Councilman Gage that the reading of Resolution No. 87-6 be wavied
and that it be adopted supporting the 1996 Olympic Summer Games
to be hosted by the City and County of San Francisco.

Motion was made by Councilman Palmerlee seconded by Coun-
cilman Mussallem and carried that Staff's recommendation be
affirmed and that the Deferred Development Agreement be adhered
to.
The following informational items were noted:
Congressman Konnyu re: One-Year Moratorium on Testing of
Nuclear Weapons.
Assemblyman Areias re: One-Year Moratorium on Testing of
Nuclear Weapons.
Governor Deukmejian Soliciting Nominations for the 1986
Young American Medals for Bravery and Service. The Mayor
requested Councilmembers to submit nominations for said award.
Proclamations Issued by Mayor Hughan: Human Relations
Month - February, 1987.
The Minutes of the Joint Powers Sewer Advisory Committee
Meeting of December 16, 1986 were noted.

A recommendation to enact ordinances pertaining to Conceal-
able Firearms Dealers and Junk & Second-Hand Dealers was pre-
sented and further explained by Police Chief Cowart recommending
tabling action regarding the Concealable Firearms Dealers.

Motion was made by Councilman Gage seconded by Councilwoman
Albert that the reading of the proposed ordinance pertaining to
Junk and Second-Hand Dealers be waived and that it be introduced
and published by title and summary as recommended.
City Administrator Baksa gave an update on Gavilan/Santa
Clara Valley Water District proposed consolidation noting the
Study Session scheduled for February 4, 1987 at 7:00 p.m. for
Council and Staff input.

The Mayor noted the Gilroy Council Study Session, February
10, 1987 - 7:00 p.m., Employees' Lounge, City Hall, 7351 Rosanna
Street, Gilroy, California re: Discussion of the Comprehensive
Fee Schedule and Five Year General Fund Revenue Projections.
The Mayor noted the Inter-City Council Meeting, February
12, 1987 - 6:30 p.m., Brandon's, Milpitas; RSVP City Clerk by
February 6, 1987.
At 10:58 p.m. the Mayor adjourned the meeting to Tuesday,
February 17, 1987 - 8:00 p.m. due to the February 16, 1987 Legal
Holiday.
