Mayor Hughan led the Pledge of Allegiance to the Flag.
The City Clerk reported that the Agenda had been posted on
May 4, 1987 at 2:35 p.m.
Present: Councilmembers: Sharon A. Albert, Donald F. Gage,
Paul V. Kloecker, Larry Mussallem, Daniel D. Palmerlee, Pete
Valdez, Jr. and Roberta H. Hughan. (7:05 p.m.).

The Mayor stated that it was the time ana place scheduled
f~r an Appeal Hearing on the Decision of the City Administrator
Revoking the El Cachanilla club's Regulatory Bar Permit.
The City Attorney explained the type of hearing that no
further evidence would be taken; that each side has a right to
submit argument and noted that no written argument was received
from Mr. Hernandez, owner and operator of the El Cachanilla Club.
City Administrator Baksa noted his recommendation to revoke
said Regulatory Bar Permit.
Police Chief Cowart reviewed the case and urged the Council
to support the City Administrator's decision and findings.
Mr. Fred Agredano, San Benito Professional Services
addressed the Council and introduced his associate, Susie Ortiz,
noting that he is in the process of obtaining a municipal license,
regulatory bar permit and Alcoholic Beverage Control license to
operate and manage the El Cachanilla Club at 7243 Monterey Street.
The Mayor noted that the revokation of Mr. Juan Hernandez's
regulatory bar permit is the issue at this meeting; that
application for a change of ownership license transfer and
regulatory bar permit would stand upon its own merits. The City
Attorney noted that proof of ownership transfer would be required.
Councilman Valdez directed questions (in Spanish) to Mr.
Juan Hernandez, owner of the El Cachanilla Club, in regard to his
understanding the proceedings at this meeting. Councilman Valdez
also interpreted the questions and answers in English. He noted
that Mr. Hernandez did understand the proposed action and the
proceedings.
Motion was made by Councilman Gage seconded by Councilman
Palmer lee and carried that the City Administrator's decision be
upheld to revoke the regulatory bar permit of the El Cachanilla
Club at 7243 Monterey Street, Gilroy, operated by Mr. Juan
Hernandez, effective May 11, 1987.
The City Attorney noted that no alcoholic beverages could be
served at this location from this day forward, under the ownership
of Mr. Juan Hernandez. Councilman Valdez asked Mr. Hernandez in
Spanish if he understood. Mr. Hernandez acknowledged that he did
understand the action taken.
At 7:45 p.m. the Mayor adjourned the meeting to a Study
Session of the Council regarding the 1987-1988 City Budget.
