of Gilroy, Applicant;

The Mayor stated that it was the time and place scheduled
for a Continued Public Hearing on Appeal of Matthew W. & Mary
Gold Drummond on the decision of the Planning Commission
regarding approval of a Conditional Use Permit to allow operation
of a Counseling Center in an R2 Zone (Two Family Residential)
District, located at 267 Martin Street, at the northwest corner
of Forest and Martin Streets, South County Alternatives, Inc.,
applicant. (Continued from 7-6-87 Regular Council Meeting.)

Noted an excerpt from the Planning Commission Minutes of
June 4, 1987 pertaining to the Conditional Use Permit.
It was noted that Councilmembers Albert, Gage and Palmer-
lee, absent at the July 6, 1987 regular meeting had listened to
the tape recordings of said meeting and were prepared to partici-
pate in Council action at this meeting.
The Mayor asked if there was anyone in the audience wishing
to speak for or against the proposal. There was no comment from
anyone in the audience. It was noted that Mr. Albert Valencia,
Executive Director of South County Alternatives, was not present
in the audience.

The Mayor closed the Public Hearing. Discussion was had by
Council on the matter.

Mr. Albert Valencia's presence was noted and Council had no
objection to hearing from him.
Mr. Albert Valencia, Executive Director of South County
Alternatives, addressed the Council noting that their proposal is
good for any neighborhood.

Mr. Dan Ayala, Chestnut Street, addressed the Council re-
questing that the Conditional Use Permit be allowed for a needed
Counseling Center at the requested location.
Motion was made by Councilman Gage seconded by Councilman
Mussallem that the reading of Resolution No. 87-55 be waived and
that it be adopted disapproving the recommendation of the
Planning Commission and denying the Conditional Use Permit.

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY DISAPPROVING ON
APPEAL RESOLUTION NO. 87-16 OF THE PLANNING COMMISSION GRANTING A
CONDITIONAL USE PERMIT FOR A COUNSELING CENTER IN AN R2 DISTRICT.

Noted Priorities for Planning Department Projects for 1987.
Discussion was had by Councilon the matter. Motion was
made by Councilman Gage seconded by Councilwoman Albert and
carried that the Priorities for Planning Department Projects for
1987 be approved with the following revisions: General Plan Land
Uses Study: North Monterey Road - #1; South County Planning Study
- #6; Commercial Design Guidelines - #10; noting all the Downtown
Priorities precede #10 and some of the top priorities can be
removed since they are completed or in the process of being
completed.
Pit Bull Dogs City Administrator Baksa recommended tabling action
regarding regulations pertaining to Pit Bull dogs to allow action
by the County on its ordinance and recommendation to cities. The
matter was tabled to a later date that will be announced.

Noted Memoranda of Understanding 1987-1989 for General,
Supervisor and Police Units. It was noted that the Fire Unit
will be reagendized for approval at a later date.
Motion was made by Councilman Gage seconded by Councilman
Valdez and carried that the Memoranda of Understanding 1987-1989
for General, Supervisor and Police Units be approved as submitted
and that the current budget be amended accordingly.
The Mayor asked if there was anyone present in the audience
wishing to speak on any matter not on the agenda. There was no
comment from anyone in the audience.
Noted a Petition requesting Reorganization of Uninhabited
Territory to be known as "Sunrise Drive Reorganization 86-3"
located west of Santa Teresa Boulevard, containing 53.053 acres,
David Tang, et ai/City of Gilroy, Applicants.
Senior Planner Myer explained the proposal.
Motion was made by Councilman Mussallem seconded by
Councilman Kloecker that the reading of Resolution No. 87-56 be
waived and that it be adopted setting a Public Hearing date of
August 17, 1987 for the proposed reorganization.

Noted a recommendation on an annexation request of Ai
Fortino. Councilman Mussallem noted that he would not take part
in the discussion nor vote on the matter, due to a conflict of
interest.

Senior Planner Myer explained the proposal.

Mr. Gene Wells, 5465 Mesa Road, representing the applicant,
addressed the Council noting that Mr. Fortino wants to be able to
compete with other developers under the Residential Development
Ordinance and upon annexation agrees to widen Mesa Road from
Gavilan College to Santa Teresa Boulevard, excepting in front of
one small parcel not owned by the applicant and requested that
the City pay for the paving at this location and charge the
property owner at the time of development.
Motion was made by Councilman Gage seconded by Councilman
Palmerlee and carried that the City supports the annexation
request of Mr. Fortino. Councilman Kloecker voted "no" on the
motion. Councilman Mussallem did not vote on the motion.
City Administrator Baksadistributed information regarding
Budget Review and Priority Setting, requesting that Council-
members return their priorities by July 23 a.m. Council set July
27, 1987 at 7:00 p.m. in the Employees' Lounge for a Study
Session to review the budget and establish priorities in the
General and Gas Tax Funds as recommended.
City Administrator Baksa distributed the Quarterly Reports
to Councilmembers.

City Administrator Baksa noted that all developers under
the July 15 sewer allocation deadline had met same.
City Administrator Baksa requested Councilmembers desiring
reservations at the 89th Annual League of California Cities
Conference in San Francisco, October 4th-7, 1987. Five Council-
members (Kloecker, Mussallem, Palmerlee, Valdez and Hughan)
requested reservations.

Councilman Mussallem reminded Council of the Garlic Train
Cer~monies, Saturday, July 25 at 10:30 a.m. at the Depot and
noted that transportation will be available for Councilmembers
working at the Garlic Festival.
