The Mayor led the Pledge of Allegiance to the Flag.
The Mayor called on Father Andre, St. Mary's Church to give
the Invocation.
The City Clerk reported that the Agenda had been posted on
November 17, 1988 at 8:33 a.m.
Present: Councilmembers: Donald F. Gage, Leonard A. Hale,
Paul V. Kloecker, Larry Mussallem, Daniel D. Palmerlee, Pete
Valdez, Jr. and Roberta H. Hughan.
The Mayor noted that the Employee of the Month of October,
1988 was Pam Popovich, Community Services Specialist, and the
award would be presented at the next regular meeting.
Motion was made by Councilman Gage seconded by Councilman
Kloecker that the following items under the Consent Calendar be

Approved the Minutes of the Regular Council Meeting of
November 7, 1988;

Motion was made by Director Gage seconded by Director Hale
that the reading of Resolution No. 88-8 be waived and that it be
adopted.

The Chairperson adjourned the Redevelopment Agency.
The Mayor reconvened the regular Council Meeting. Roll
Call: All Councilmembers present.
City Administrtor Baksa reported that the bids on prefabri-
cated toilet building for Christmas Hill Park would be presented
at the December 5, 1988 regular meeting.
The Mayor stated that it was the time and place scheduled
for the continued Public Hearing to consider revision and adjust-
ments of charges for the collection of garbage, rubbish and
refuse in the City of Gilroy. (Continued from 9-19-88; 10-3-88
and 11-7-88 Regular Meetings.)
City Administrator Baksa explained that the request is for
a 23.6% increase.

Mr. Mike Sangiacomo, representing South Valley Refuse &
Disposal, addressed the Council further explaining the requested
increase and reasons for same.
Discussion was had by Council on the proposed increases.
The Mayor asked if there was anyone in the audience wishing
to speak for or against the proposal.
Mr. Charles Champion, 895 Susan Court, addressed the Coun-
cil inquiring of the recycling of garbage and citizens~ partici-
pation in such a program. City Administrator Baksa noted that
the proposed Recycling Program has been agendized for the
December 5, 1988 Regular Council Meeting.

The Mayor asked if there was anyone further in the audience
wishing to speak on the matter. There was no comment from anyone
in the audience. The Mayor closed the Public Hearing.

Motion was made by Councilman Kloecker seconded by Council-
man Valdez that the reading of Resolution No. 88-69 be waived and
that it be adopted.

RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY FIXING MAXIMUM
CHARGES FOR THE COLLECTION OF GARBAGE, RUBBISH AND REFUSE,
EFFECTIVE JANUARY 1, 1989.

The Mayor asked if there was anyone in the audience wishing
to speak on any matter not on the agenda. Mr. Eugene Brandt,
addressed the Council requesting the City's participation,in
repair of curb, sidewalk, etc, damages in the parkway in front of
his residence because he believes that the City is responsible
for planting the trees incorrectly.

The following residents addressed the Council objecting to
the property owner being responsible for maintenance of the
parking strip in front of residences: Eugene Ward, 1301-3rd
Street; Dennis Trimmer, 781 Lawrence Drive; Vern Potter, 1120
Ortega Circle and Lorraine Spence, Westwood Drive.
Mr. Ted Kubota, 787 Lawrence Drive, addressed the Council
concerned about the notices received for replacing the sidewalk,
etc.
Motion was made by Councilman Mussallem seconded by
Councilman Palmer lee and carried that a six months moratorium be
declared on enforcement of sidewalk, curb, gutters, etc. repair
notices to property owners.
Discussion was had by Council regarding items to be studied
by the Parks and Recretion Commission in an attempt to approach
the problem.
Motion was made by Councilman Gage seconded by Councilman
Hale and carried that the Parks and Recreation Commission be ~
directed to study the matter and advise the Council within six
months on their recommendation. Council also requested that -..

A report from the City of Sunnyvale on Toxics Policy Coun-
Council was noted, same to be discussed by all the cities in the
County and noting additional information will be presented to
Council when received.
City Administrator Baksa presented and explained a request
of the Gilroy Unified School District for a Sewer Allocation
Transfer.

Mr. Kenneth Noonan, Superintendent of Schools, addressed
the Council and further explained their request.
Discussion was had by Council on the matter.
Motion was made by Councilman Gage seconded by Councilman
Palmerlee and carried that the sewer allocation transfer be
allowed as outlined by City Administrator Baksa.
The following informational items were noted with no
separate discussion on same:
Gilroy Unified School Distrit re: Red Ribbon Week Walk;
Proclamations Issued by Mayor Hughan: Adoption Awareness
Week - November 20-16, 1988; and 1988 Family Week, November 21-
27, 1988;
Western City Magazine Article, November 1988 re: Tanner
Bill; and
Minutes of the Gilroy Downtown Development Corporation
Meetings of September 9, 30, October 14 and 28, 1988.
The Minutes of the Parks & Recreation Commission Meeting of
October 18, 1988 were noted.
Noted the Minutes of the Senior Advisory Board Meeting of
September 19, 1988.
Noted the Minutes of the Library and Culture Commission
Meeting of September 13, 1988.
Noted the Museum Report, September 1988.
City Administrator Baksa gave an update on County General
Plan for Garlic World (Tognetti) noting that same was continued
to January 1989 for more review of the traffic conditions.
City Administrator Baksa noted completion of the City
parking lots at the Municipal Court and Senior Center sites.
City Administrator Baksa noted completion of Supervisory
Training Sessions.
City Administrator Baksa noted Mr. Noble Shaw's acceptance
of appointment as Director of Finance effective December 19,
1988.
The Mayor requested Council attendance at the February 2,
1989 Intergovernmental Council Dinner Meeting. All Council-
members indicated that they would attend same.
Councilman Kloecker requested agendizing for review the
Housing Plan figures to include housing allocation and population
estimates vs. ABAG's figures. It was noted that same could be
reviewed at the December 19, 1988 Study Session prior to the
regular Council Meeting.
Councilman Gage requested a Study Session for alternate
optional plans for the City of Gilroy Wastewater Facilities
rather than wait six months for Morgan Hill to complete their EIR
for separate wastewater facilities. It was noted that same could
be scheduled for January 1989.
The Mayor noted Cecil Reinsch's Retirement Dinner of
January 14, 1988.
The Mayor noted the City's Turkey Trot November 23, 1988
from 4-5 p.m.
At 10:06 p.m. the Mayor adjourned to a Closed Session re:
Pending Litigation in accordance with Section 54956.9(c) of the
Government Code.
