The Mayor called on Pastor Richard Smith, Seventh Day Adventist Church, to give the Invocation. The Deputy City Clerk reported that the Agenda had been posted on February 16, 1989 at 8:42 a.m. Present: Councilmembers: Donald F. Gage, Leonard A. Hale, Paul V. Kloecker, Daniel D. Palmerlee, Pete Valdez, Jr. and Roberta H. Hughan; Absent: Councilmember: Larry Mussallem. The Mayor presented the Employee of the Month Award for January to Ray Hansell, Police Officer. [ r ! Bids re: Influ.Pump Res.89-9 5721 Motion was made by Councilman Gage seconded by Councilman Kloecker that the following items under the Consent Calendar be approved by the following Roll Call Vote, excluding Item D: Ayes: Councilmembers: Gage, Hale, Kloecker, Palmerlee, Valdez and Hughan; Absent: Councilmember Mussallem: Approved the Minutes of the Regular Council Meeting of February 6, 1989; Adopted Ordinance No. 89-4 amending City Code Section 13.29 pertaining to penalties for late payment of business licenses; ORDINANCE NO. 89 - 4 AN ORDINANCE OF THE CITY OF GILROY AMENDING SECTION 13.29 OF THE GILROY CITY CODE PERTAINING TO PENALTIES FOR LATE PAYMENT OF BUSINESS LICENSES. PASSED AND ADOPTED this 21st day of February, 1989, by the following vote: AYES: COUNCILMEMBERS: GAGE, HALE, KLOECKER, PALMERLEE, VALDEZ and HUGHAN NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBER: MUSSALLEM; Approved Budget Amendments and Adjustments; Set a Public Hearing date of March 20, 1989 per City Code Section 26A.2 for Proposed Underground Utility District No.4; Accepted Improvements for J. Stephen Mitchell, 7243 Dowdy Street; Heard from Rex Indra, Victoria Drive, regarding claim. City Administrator Baksa explained the process for claims. Motion was made by Councilman Kloecker seconded by Council- man Palmerlee and carried to deny the damage claim of W. E. Mason Inc. The Mayor explained to the students in the audience about the sewer treatment facility, and that this is a pump that is needed. The City Administrator reviewed the request. Motion was made by Councilman Gage seconded by Councilman Valdez and carried to approve the contract with James M. Mont- gomery Consulting Engineers Inc. for the Preliminary Design of Third Influent Pump for the Gilroy-Morgan Hill Wastewater Facility. The City Administrator distributed revisions to the Public Safety Funds. Motion was made by Councilman Gage seconded by Councilman Kloecker and carried to Adopt Resolution No. 89-9 Formalizing Public Safety Funds with Loan Interest and State Subvention Funds; RESOLUTION NO. 89 - 9 RESOLUTION OF THE COUNCIL OF THE CITY OF GILROY AUTHORIZING LOANS FROM THE STATE SUBVENTIONS AND BANK INTEREST FUNDS TO THE PUBLIC SAFETY FUND TO FUND THE 1987 REMODELING OF THE POLICE AND FIRE STATIONS. Motion was made by Councilman Gage seconded by Councilman Kloecker and carried to approve appointing Suellen Rowlison to the Library and Culture Commission. Motion was made by Councilman Gage seconded by Councilman Kloecker and carried to approve appointing Susan Jacobsen to the Personnel Commission. Motion was made by Councilman Kloecker seconded by Council- man Palmerlee and carried approving sending a letter of support to Assemblyman Bill Richard E. Floyd on AB 8, Mandatory Motor- cycle Helmet Bill. Noted the following informational items with no separate discussion on same: J M. G. Walser, President, Wheeler Hospital re: Status of Wheeler Hospital's Future Use; Proclamations Issued by Mayor Hughan: Women's History Month - March 1989; Science Fair Week - April 9th through 15, 1989; HCD Grant Allocation Distribution; Gilroy Downtown Development Corporation Meetings of January 6th and 20, 1989; The National Arbor Day Foundation designating the City of Gilroy as a Tree City USA - 1988; P. A. Jones re: User's Fees; Report of Investments with Maturities Exceeding One Year. Motion was made by Councilman Palmer lee seconded by Coun- cilman Gage and carried to approve a job description for Cultural Center Assistant. ., I ~ City Administrator Baksa reviewed the Five Year Interim Report and noted JMM will make a presentation on March 13, 1989 at 7:00 p.m. in the Employees' Lounge. City Administrator Baksa noted a Closed Session on February 27, 1989, in the Employees' Lounge re: Meet and Confer. City Administrator Baksa noted MSI meetings have been changed to the Senior Center, and Council agreed to cancel the session previously scheduled for February 28, 1989. The Mayor noted there has been no interest expressed by anyone for the HCD Citizen's Advisory Committee and that she is releasing a notice to the newspaper. Motion was made by Councilman Gage seconded by Councilman Valdez and carried to approve appointments to the MSI Task Force to include: Marcia Arnold, Gilbert N. Chaput, Louis Fiori, Beau Goldie, Pamela Jones, Sue Kruse, Vince Maloney, Betty McKenzie, Vinod Patel, Herb Peckham, Mary Ellen Rocha, Ralph Zertuche, and two members to be named from the Chamber of Commerce, with Larry Stowbunenko, alternate.
