The City Clerk reported that the Agenda had been posted on November 15, 1990 at 8:51 a.m. Present: Councilmembers: Donald F. Gage, Leonard A. Hale, Paul V. Kloecker, Larry Mussallem, Sara C. Nelson, and Pete Valdez, Jr. and Roberta H. Hughan. The Mayor noted New Employees: Patricia Harrell, Public Safety Communicator I, not present for introduction. The Mayor presented Rick Bryde and Jose Avelar of the Parks & Recreation Department Employee Awards for the Month of October, 1990. Mr. Jack Pate, Chairman of the Gilroy 2000 Committee Task Force, addressed the Council and gave an update on the Committee's progress. Motion was made by Councilman Gage seconded by Councilman Hale that the following items under the Consent Calendar be approved by the following Roll Call Vote: Ayes: Councilmembers: Gage, Hale, Kloecker, Mussallem, Nelson, Valdez and Hughan: Approved the Minutes of the Regular Council Meeting of November 5, 1990; Adopted Ordinance No. 90-24 Repealing Section 19.74 and Amending Section 19.75 of the City Code Defining Multiple Family Dwelling Units; ORDINANCE NO. 90 - 24 AN ORDINANCE OF THE CITY OF GILROY REPEALING SECTION 19.74 AND AMENDING SECTION 19.75 OF THE GILROY CITY CODE DEFINING MULTIPLE FAMILY DWELLING UNITS. PASSED AND ADOPTED this 19th day of November, 1990, by the following vote: AYES: COUNCILMEMBERS: NOES: ABSENT: GAGE, HALE, KLOECKER, MUSSALLEM, NELSON, VALDEZ and HUGHAN. None None; and COUNCILMEMBERS: COUNCILMEMBERS: Approved Budget Amendments as recommended. Noted a recommendation to amend Section 12B.1(b) of the Gilroy City Code Defining Secondhand Dealers further explained by Public Safety Director Gillespie and Detective Morrow. The Mayor asked if there was anyone in the audience wishing to speak on the proposal. Mr. Robert Littlejohn, owner of Littlejohn's Jewelry Store, addressed the Council opposing the requirement of numerous licenses to operate his business. Mr. Wayne Lindsay, owner of an Antique Store on Monterey Street, addressed the Council opposed to the proposed new regulation noting that his renters are in the antique business for a hobby and that they do not purchase merchandise from people off the street. r9.4~ ~ I Solid Waste Landfills Officer Morrow noted that if they do not purchase merchandise from transient vendors that they would not be required to obtain a license under the proposed new ordinance. Ms. Joyce Duarte, owner of an Antique store, addressed the Council noting that she has nine dealers within her store and they would not be able to afford a separate license. City Administrator Baksa noted that one license for the antique store would be required if the required forms were completed for all purchases. Mr. Littlejohn addressed the Council noting that the required form is a problem and that it is illegal to require fingerprints. It was noted that the form is a State requirement and that the license is a one time fee to buy into the state's computer system. Councilman Mussallem suggested that the Cities of San Jose and Campbell be contacted to determine if the licensing regulations have been effective in their cities in recovering stolen property. Motion was made by Councilman Kloecker seconded by Councilman Valdez that the reading of the proposed ordinance be waived and that it be introduced and published by title and summary and carried by the following Roll Call Vote: Ayes: Councilmembers: Gage, Kloecker, Valdez and Hughan; Noes: Councilmembers: Hale, Mussallem and Nelson. Motion was made by Councilman Gage seconded by Councilman K10ecker and carried that letters be forwarded the League of California Cities urging the proposed ordinance be state-wide; Cities of Morgan Hill and Hollister requesting they consider adoption of the proposed ordinance; local legislators for state- wide conformance and that Officer Morrow be available for the Cities of Morgan Hill and Hollister to explain the proposed ordinance. Council requested a report in one year to determine if the ordinance is effective as to the recovery rate of stolen property. Motion was made by Councilman Kloecker seconded by Councilman Valdez and carried that the Santa Clara Valley Water District Resolution regarding Solid Waste Landfills be supported as requested. Took no action on a request of the Korean American Community Services, Inc. for support to include Asian and Pacific Islanders as a separate population group in the Census Bureau Enumeration Survey. Noted a request of the Wheeler Advisory Committee regarding adoption of the Gilroy Housing Element and noted Staff Report that the City would adopt same as expeditiously as possible. The following informational items were noted with no separate discussion on same: Appeal of Roark W. Cooper on decision of the Planning Commission re: Variance request, V 90-06. (Hearing before City Council scheduled for December 3, 1990 Regular Meeting); Gilroy2000 JPA Mayor Protempore 5943 Minutes of the Housing Task Force Meeting of October 19, 1990; Proclamation Issued by Mayor Hughan: Commendation to Susanne Wilson, Supervisor, upon her retirement; County Planning Department re: Tanner Plan Revisions and Resubmittal; Monthly Cash and Investment Report, October 30, 1990; Cupertino Chamber of Commerce Luncheon, November 30, 1990 re: Bay Vision 2020; City Attorney re: Tentative Maps; and State Office of Historic Preservation re: Wheeler Hospital. Noted the Minutes of the Gilroy 2000 Steering Committee Meeting of November 7, 1990; and November 14, 1990 minutes mailed. Noted a schedule of Law Suit Proceedings further explained by City Administrator Baksa, noting that all paper-work should be completed by January 17, 1991. Noted no update on the Water Conservation Program. City Administrator Baksa noted a City/School Liaison Meeting scheduled for January 10, 1991. City Administrator Baksa noted the City Auction scheduled for December 1, 1990. City Administrator Baksa noted an Invitation to a reception for the new Police Chief, December 3, 1990, 5:30 p.m. to 7:30 p.m., at the Museum. The Mayor noted a Bay Area Air Quality Management District News Release, dated November 5, 1990 for information. The Mayor announced Councilman Valdez to be Mayor Protempore for six months. (Through May 31, 1991.) The Mayor noted the deadline for submitting applications for Commission vacancies to be November 28, 1990 - 5:00 p.m. There was no objection from Councilmembers. The Mayor noted the Candlelight Walk for Life, November 30, 1990 at 6:00 p.m. at the Library sponsored by South Valley Counseling. Councilman Kloecker noted that the City Offices would be the leaders in recycling white paper with other commercial businesses to follow. Councilman Kloecker noted a recent article in the Dispatch regarding Gilroy landfill with a picture of some other landfill site, not Gilroy. Councilwoman Nelson distributed information on National Bible Week and requested the Mayor issue a proclamation for same. The Mayor requested specific information in order to proclaim same. Councilman Gage reported on the Bethel Series Bible Study at the Presbyterian Church for $18.00 per year. Councilman Kloecker reported on the December 14, 1990 meeting he and Councilmembers Hale and Mussallem had with Senator Henry J. Mello re: SB 2557 noting that the City should continue to support the League's efforts to repeal SB 2557 or portions thereof depending upon their recommendations. 5Y44 Adjrnmt. The following Meetings were noted: County Planning Public Information meeting re: Greenbelt Study, November 19, 1990, 7:30 p.m. to 9:30 p.m., San Martin Lion's Club; Joint Gilroy City Council/Planning Commission Study Session, November 26, 1990 - 7:00 p.m., Gilroy Senior Center re: Santa Clara County Consultant's Report on Greenbelt Proposal; Board of Supervisors' meeting re: Greenbelt Study, December 4, 1990, Board of Supervisor's Chambers, San Jose. At 9:03 p.m. the Mayor adjourned to a continued Study Session re: Cable Casting and Closed Session re: a Personnel Matter/Annual Administrator's evaluation. Nelson, and Pete Valdez, Jr. and Roberta H. Hughan. The Mayor noted New Employees: Patricia Harrell, Public Safety Communicator I and Isabel Eredia, Police Records Technician I were not present for introduction.
