The City Clerk noted that the Agenda had been posted on November 19, 1992 at 9:30 a.m. Present: Councilmembers: Mike Gilroy, Leonard A. Hale, Paul V. Kloecker, Sara C. Nelson, Suellen C. Rowlison, Pete Valdez Jr. and Donald F. Gage, 7:02 p.m. Pat Kolstead, Sergeant of the San Jose Police Department representing the California Crime Prevention Coalition presented the Governor's Crime Prevention Award to Pam Latronica, Gilroy Police Department. Motion was made by Councilwoman Rowlison seconded by Coun- cilman Hale that the following item under the Consent Calendar be approved by the following Roll Call Vote: Ayes: Councilmembers: Mike Gilroy, Leonard A. Gage; I" 1\1 ,'!; .< J -1," 'if,}-';""v'\,) Budget GDDC RDO Res.92-85 Approved Budget Amendments/Transfers as recommended. A report of Mark Ebner, Gilroy Downtown Development Corporation re: reassessment of Goals and Objectives/City's Commitment of the Funding for Downtown Main Street Program was noted; distributed to Council November 16, 1992. Mr. Mark Ebner addressed the Council further explaining said Financial Report. Council requested copies of the Gilroy Downtown Development Corporation's Financial Statement on a monthly basis if possible; quarterly at the very least. Mr. David Peoples addressed the Council further answering questions of Council regarding the Downtown Mainstreet Program. Ms. Cheryl Boomgarden, addressed the Council inquiring about the Downtown Assessment District and noted that she did not receive notification of the Assessment District and requested that the GDDC contact everyone to determine if a majority still want the Assessment District. Motion was made by Councilman Hale seconded by Councilwoman Rowlison and carried by the following Roll Call Vote to approve a $30,000.00 per year of funds to the GDDC for the Downtown Mainstreet Program as an independent city for a three year period with funds to be advanced quarterly and with the provision that the GDDC provide the City with copies of their monthly financial statements: Ayes: Councilmembers: Gilroy, Hale, Nelson, Rowlison, Valdez and Gage; Noes: Councilmember: Kloecker. Discussion was had regarding the Residential Development Ordinance further recommended by Staff to table action until the ordinance can be amended recommending suspension of the RDO Process at this time. Discussion was had by Council. The City Attorney further clarified the legal points of issue. At 9:01 p.m. the Mayor declared a recess and reconvened the meeting at 9:06 p.m. Motion was made by Councilman Valdez seconded by Councilman Kloecker and carried to suspend the RDO process indefinitely to be further discussed December 7, 19932 following receipt of a Staff analysis for ordinance amendments regarding schools and resolution revising the point system prior to amending the ordinance and resolution; RDO starting date; disposition of "Backlog Housing Units" and setting of the Annual Limits and Staff concept on large projects v. small projects. Councilmembers Hale and Nelson voted "no" on the motion. It was noted that these points would be discussed December 7, 1992 with the possibility of lifting suspension of the RDO. Noted a request of Supervisor Ron Gonzales re: County Hazardous Waste Management Plans. Motion was made by Councilman Kloecker seconded by Council- man Valdez that the reading of Resolution No. 92-85 be waived and that it be adopted requesting review and approval on currently submitted Hazardous Waste Management Plans for Bay Area Counties. Noted the Minutes of the Library & Culture commission Meeting of November 10, 1992. City Administrator Baksa noted the Customer Training had been completed. City Administrator Baksa gave an update on the Airport Site Selection Study previously distributed November 2, 1992; additional reports to be forwarded the City Administrator and Councilman Gilroy with a presentation proposed prior to Council taking action on the matter. City Administrator Baksa requested Council return the Monthly Report survey for suggested topics. City Administrator Baksa distributed information re: Channel 34 statistics on recent telephone responses at the last council meeting. City Administrator Baksa distributed copies of the proposed Seven Point Plan for the Financial Analysis of the Plan for funding Sidewalk/Curb-Gutter/Street Tree Issue for Council action December 7, 1992. Council requested additional criteria for the Match Program to eliminate sidewalk replacement that does not need repair. Councilman Gilroy reported on the Council Retreat January 22, 23 and 24, 1993 recommending 6 p.m. to 9/10 p.m. (22nd); 8 a.m. to 5/6 p.m. (23rd) and 8 a.m. to Noon (24th) noting the Council Subcommittee recommends that the Retreat be held at the Gilroy Senior Center and recommended contracting with Jim Bower, Gilroy resident for Facilitator at the Retreat to be agendized December 7, 1992 for Council action. Councilman Gilroy requested a legal opLnLon on Council control and limitations of a proposed Adult Book Store on Leavesley Road. At 9:30 p.m. the Mayor adjourned to a Special Meeting, November 30, 1992 to immediately follow the Closed Session of that date (6:30 p.m.) to consider approval of the Gilroy Police Officers' Association Memorandum of Understanding.
