The Mayor led the Pledge of Allegiance to the Flag.
Father Matthew stanley, St. Mary's Catholic Church, gave
the Invocation.
The City Clerk noted that the Agenda had been posted on
December 30, 1992 at 11:30 a.m.
Present: Councilmembers: Mike Gilroy, Leonard A. Hale, Paul
V. Kloecker, Sara C. Nelson, Suellen C. Rowlison, Pete Valdez Jr.
and Donald F. Gage, 7:02 p.m.
The Mayor introduced New Employee: Kurt Svardal, Police
Officer.
The Mayor presented a certificate of Service to Leo J.
Moser, Retired Library & Culture Commissioner.
Motion was made by Councilman Kloecker seconded by Council-
man Hale that the following items under the Consent Calendar be

Adopted Ordinance No. 93-1 approving Z 92-05 amending
Section 11.30 of the Zoning Ordinance regarding Height Limitation
in R2 Districts;

Approved Budget Amendments/Transfers as recommended;
The Mayor stated that it was the time and place scheduled
for the Public Hearing to Consider the Annual Destruction of
Removal of Weeds and/or Refuse Constituting a Public Nuisance in
the City of Gilroy. He asked if there was anyone in the audience
wishing to speak for or against the proposal. There was no
comment from anyone in the audience. The Mayor closed the Public
Hearing.
Motion was made by Councilman Gilroy seconded by Council-
woman Nelson that the reading of Resolution No. 93-1 be waived
and that it be adopted.
RESOLUTION NO. 93 - 1
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
INSTRUCTING THE CHIEF OF THE FIRE DEPARTMENT TO ABATE THE
NUISANCE ARISING OUT OF WEEDS GROWING AND REFUSE ACCUMULATION
UPON LOTS OR IN FRONT OF PROPERTY IN THE CITY OF GILROY, PURSUANT
TO SECTION 12.51 OF THE GILROY CITY CODE.
PASSED AND ADOPTED this 4th day of January, 1993, by the

The Mayor deviated from the regular order of the Agenda in
order to accommodate interested persons in the audience.
Supervisor Honda addressed the Council re: the Santa Clara
County Open Space Authority. Discussion was had by Council on
the matter.
Motion was made by Councilwoman Rowlison seconded by
Councilman Valdez that the reading of Resolution No. 93-2 be
waived and that it be adopted stating the City'S Intent to be
included within the Jurisdiction of the Santa Clara County Open-
Space Authority.
A substitute motion was made by Councilman Gilroy seconded
by Councilman Hale that the reading of Resolution No. 93-2 be
waived and that it be adopted subject to including an advisory
ballot measure on the November 1993 General Municipal Election
ballot. The substitute motion failed by the following Roll Call
Vote: Ayes: Councilmembers: Gilroy, Hale and Gage; Noes: Council-
members: Kloecker, Nelson, Rowlison and Valdez.
The Mayor noted correspondence received from citizens
requesting the City to join the Open-Space Authority.
The Mayor asked if there was anyone in the audience wishing
to speak for or against the matter.
Mr. Dave Bouchard, President of the Gilroy Chamber of
Commerce, addressed the council in opposition to the City
participating in the Open-Space Authority, noting that the
Chamber is not opposed to open space but believes that same can
be regulated solely by the City.
An additional substitute motion was made by Councilman
Gilroy seconded by Councilwoman Nelson and carried that the Open-
Space Authority issue be placed as an advisory measure on the
November 1993 General Municipal Election Ballot: Ayes: Council-
members: Gilroy, Hale, Kloecker, Nelson, Rowlison, Valdez and
Gage.
The original motion to adopt Resolution No. 93-2 was voted
upon stating the City'S intent to be included within the
jurisdiction of the Santa Clara County Open-Space Authority.
Ayes: Councilmembers: Gilroy, Hale, Kloecker, Rowlison, Valdez
and Gage; Noes: Councilmember: Nelson.

The Mayor continued with the regular order of the Agenda.
Associate Planner Myer gave an update on the Vintner's
Showcase/Rancho San Martin.
A Report on Low Income Housing Demand in Gilroy was noted
and further explained by Planning Director Dorn.
Ms. Marie Juncker, Executive Director of South County
Housing addressed the Council regarding the applications received
for housing.
Ms. Alice Dufresne Reyes, Gilroy Unified School District
Coordinator, addressed the Council in regard to Gilroy Healthy
Start Collaborative, re: SB 620.
A request of the City of Blythe regarding Desert Protection
Act was noted. Council took no action on the matter.
The following informational items were noted with no
separate discussion on same:
Customer Service:
American Cancer Society in Appreciation for Assistance at
Health Fair;
Supplement Request for Gilroy Old City Hall Project;
Certificates of Commendation, Police Department Employees
of the Month:
Officer John Marfia - September 1992;
Officer Steve Gaither - November 1992;
Proclamation Issued by Mayor Gage:
Afro-American History Month;
Ron Schiltz re: Moratorium on Adult Business Operations;
Letter from Albert Fortino re: RDO Rating Scale; and
Status of the City'S Long-Range Applications.
City Administrator Baksa noted Council Agenda and Minutes
from a City Council in England, and gave to Council to review
same.
City Administrator Baksa distributed an Agenda for the
Joint Council/personnel Commission Study Session of January 11,
1993. Council agreed to not televise same.
City Administrator Baksa distributed a draft Ordinance for
the Storm Drain Utility Fund. Council set January 14, 1993 at
7:00 p.m. as a Study Session on said ordinance and discussion on
alternatives to the Traffic Impact Fees. Council agreed to
televise this meeting.

Council set January 28, 1993 at 7:00 p.m. as a study
Session on General Fund Revenue Projections and Capital
Improvement Program 1993-1998.
City Administrator Baksa noted the following schedule for
the City Council/Manager Retreat: January 22, 6:00 p.m. to 10:00
p.m.; January 23, 9:00 a.m. to 5:00 p.m.; and January 24, 9:00
a.m. to 1:00 p.m.
The Mayor introduced Ms. Amy Collins, new Dispatch
Reporter.
Councilman Kloecker noted that he will be presenting a
Resolution for Council approval regarding weekend service for
Cal Train.
The Mayor noted the Santa Clara County Cities Association
General Membership Meeting, January 21, 1993 at the Santa Clara
Convention Center. Councilmembers: Gage, Hale, Rowlison and
Valdez requested reservations for same.
At 9:00 p.m. the Mayor adjourodd the meeting to January 19,
1993 (January 18, 1993 - L~gal Holiday).
