The Mayor led the Pledge of Allegiance to the Flag.
Pastor Robert Achilles, Trinity Bible Church gave the
Invocation.
The City Clerk noted that the Agenda had been posted on
June 24, 1993 at 9:55 a.m.
Present: Councilmembers: Mike Gilroy, Leonard A. Hale, Paul
V. Kloecker, Sara C. Nelson, Suellen C. Rowlison, Pete Valdez,
Jr. and Donald F. Gage.
Motion was made by Councilwoman Kloecker, seconded by
Councilman Hale that the following items under the Consent
Calendar be approved, by the following Roll Call Vote: Ayes:
Councilmembers: Mike Gilroy, Leonard A. Hale, Paul V. Kloecker,
Sara C. Nelson, Suellen C. Rowlison, Pete Valdez, Jr. and Donald
F. Gage:
Approved Budget Amendments/Transfers as recommended;
Accepted Improvements at 250 Old Gilroy Street, Project 92-
02, (IFDES) as recommended;
Minutes of the Regular Adjourned Council Meeting of June
16, 1993; and
Approved Write-Off of Uncollectable Utility Accounts as
recommended.
The Mayor deviated from the regular order of the agenda in
order to accommodate interested persons in the audience.
The Mayor stated that it was the time and place scheduled
to consider the annual Benefit Assessment for Maintenance
District No.1, City of Gilroy (Country Estates), 1993-1994
Fiscal Year.

The Preliminary Annual Levy Report was noted and further
explained by City Administrator Baksa and Director of Public
Works Allen.
The Mayor asked if there was anyone in the audience wishing
to speak on the matter. There was no response from anyone in the
audience.
Motion was made by Councilman Kloecker seconded by
Councilwoman Nelson and carried that the Public Hearing be
continued to July 26, 1993 regular Council Meeting as
recommended.
The Mayor continued with the regular order of the Agenda.
The Fire Departmental Report was given in regard to the
"Station and Staffing Study" of the Department further explained
by the Consultants.
Councilman Hale requested that the number of actual fire
calls be separated from the EMS calls for future Council review.
At 8:06 p.m. the Mayor continued with the agenda.
Motion was made by Councilwoman Nelson seconded by Council-
man Gilroy that the reading of Resolution No. 93-37 be waived and
that it be adopted rescinding Resolution No. 93-35 Calling for
Special Election November 2, 1993, to allow for rebuttals re:
Open Space Authority Measure. It was noted that all measures in
all future municipal election will be subject to rebuttals unless
later repealed by the legislative body.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY CALLING A
SPECIAL MUNICIPAL ELECTION FOR AN ADVISORY MEASURE TO BE HELD IN
THE CITY OF GILROY ON NOVEMBER 2, 1993; REQUESTING SERVICES OF
REGISTRAR OF VOTERS; REQUESTING CONSOLIDATION OF ELECTIONS AND
SPECIFYING CERTAIN PROCEDURES FOR THE CONSOLIDATED ELECTION;
ADOPTING THE PROVISIONS OF ELECTIONS CODE SECTION 5014.5
REGARDING REBUTTAL ARGUMENTS; AND RESCINDING RESOLUTION NO. 93-
3,5.
PASSED AND ADOPTED this 28th day of June, 1993, by the following
vote:

Motion was made by Councilwoman Nelson seconded by Council-
woman Rowlison and not carried by the following roll Call Vote
that the Candidate Statements be set at 200 maximum words and
costs for same be paid by the candidates: Ayes: Councilmembers:
Nelson and Rowlison; Noes: Councilmembers: Gilroy, Hale,
Kloecker, Valdez and Gage.
Motion was made by Councilman Kloecker seconded by
Councilman Valdez and carried by the following Roll Call Vote
that candidate's statements be set at 200 maximum words and cost
for same be paid by the City of Gilroy: Ayes: Councilmembers:
Gilroy, Hale, Kloecker, Valdez and Gage; Noes: councilmembers:
Nelson and Rowlison.
It was noted by the City Clerk that any registered voter
requesting the Spanish translation of the sample ballot would
receive same at the expense of the City and that if a candidate
wished the Spanish translation of the sample ballot sent to all
registered voters in the City the additional cost would be paid
by the candidate.
The applications received for the Planning Commission

the Council Chambers as a Study Session to conduct interviews on
the new applicants.
Motion was made by Councilman Kloecker seconded by Council-
man Valdez and carried that applicants of the prior Planning
Commission appointment and still interested in an appointment on
the Commission shall be invited to the interviews and considered
without prejudice if they do not choose to participate in a
second interview.
A contract for lease of a building for a Youth Center,
owned by Pacific Gas & Electric Company was noted and further
explained by the City Attorney.
Motion was made by Councilman Kloecker seconded by
Councilman Valdez and carried that the contract for lease of a
Pacific Gas & Electric Company building be approved subject to
finalization of same by the City Attorney.
Council and no objection to continue action on the
consideration of a Loan Subordination for Wheeler Housing
Corporation to the July 6, 1993 Council Agenda as recommended by
the City Attorney.
Noted a request of the City of Menlo Park to support AB2396
to provide funding to the City of East Palo Alto to combat
violent crime, reduce gang violence and stop drug trafficking.
Motion was made by Councilwoman Rowlison seconded by
Councilman Gilroy and carried that the City support AB 2396
requested by the City of Menlo Park.
The following informational items were noted with no
separate discussion on same except as indicated:
Correspondence re: Regional Government/Governance:
Assembly Bill 398 by Valerie Brown, dated June 10, 1993.
Councilman Kloecker noted that this is an updated document and
reflects changes approved by the Assembly. He further noted that
the change proposes to represent some kind of cost savings plan;
Correspondence re: 1993 State Budget: State Office of
Planning & Research, June 17, 1993; and
Proclamation Issued by Mayor Gage: School's Open - Drive
Carefully Month - September 1993.
The Minutes of the South County Regional Wastewater
Authority Meeting of May 26, 1993 were noted.
An update on the Water Conservation Program was noted.
City Administrator Baksa noted that Customer Service
Training Sessions would begin for new employees in July.
At 9:02 p.m. the Mayor declared a brief recess to change
the video tape.
The City Attorney further explained a Public Record Act
request by the Gilroy Dispatch Newspaper to the City of Gilroy
for information on Police Officers, noting information that the
City provided.
Police Officer Bozzo, President of the Police Officers'
Association, addressed the Council noting that the Police
Officers' Association is in opposition to the release of
individual names, salaries and fringe benefits other than the
MOUs and believes it is unwarranted and an invasion of privacy,
requesting that the City follow the Penal Code Section 832.8
regarding confidentiality of peace officers in providing this
type of records to the public.

The City Attorney advised the Council to discuss the matter
at a Closed Session since litigation had been threatened in this
matter.
A Closed Session of July 6, 1993 to immediately follow the
regular meeting of that date was set to discuss confidentiality
of peace officers. Councilmembers: Nelson and Rowlison voted
"no" on the matter of setting a Closed Session on July 6, 1993,
noting that they wished to have the Closed Session following this
regular meeting.
Councilman Gilroy requested that the matter of City rental
properties be agendized for discussion at the July 6, 1993
regular meeting.
The Mayor noted the following meetings:
Gilroy City Council Study Session, July 12, 1993 - 7:00
p.m., re: Strategic Planning;
Leadership Forum, July 15, 1993 - 7:30 a.m. to 9:00 a.m.
re: Bicycle Safety Regulations/Traffic Enforcement Issue; and
Joint Gilroy City Council/Gilroy Unified School Board of
Education Meeting, July 21, 1993 - 5:30 p.m.
At 8:38 p.m. the Mayor adjourned the Meeting to Tuesday,
July 6, 1993. (July 5, 1993 Legal Holiday.)
