Ltd. Emmanuel Henry John, salvation Army gave the
Invocation.
The city Clerk noted that the Agenda had been posted on
November 10, 1993 at 10:52 a.m.
Present: councilmembers: K. A. Mike Gilroy, Leonard A.
Hale, Paul v. Kloecker, Sara c. Nelson, suellen c. Rowlison, Pete
valdez, Jr. and Donald F. Gage.
The Mayor presented the Employee Award for the Month of
october 1993 to Charles B. Myer, senior Planner.
Motion was made by councilwoman Kloecker, seconded by
Councilman Valdez that the following items under the Consent
calendar be approved, by the following Roll call Vote: Ayes:

city Administrator Baksa presented a recommendation to
award the bid of Melo Concrete Inc. in the amount of $11,467.00
for the Sidewalk Repair Program contract, project No. 94-PW-307,
further explained by Director of Public works Allen.
councilman Kloecker requested information at a later date
as to the locations of the proposed sidewalk repair projects.
Motion was made by councilman Gilroy seconded by Council-
woman Nelson that the bid of Melo concrete Inc. in the amount of
$11,467.00 be awarded for the Sidewalk Repair Program contract,
project No. 94-PW-307 as recommended.
city Administrator Baksa presented a recommendation to
award bids for a utility truck and body to carl Chevrolet in the
amount of $20,091.20 for the truck and to Daily Body in the
amount of $12,220.00 for the body.
Motion was made by councilman Kloecker seconded by council-
man Valdez and carried that the bid of carl Chevrolet in the
amount of $20,091.20 be awarded for a utility truck and the bid
of Daily Body in the amount of $12,220.00 be awarded for a
utility body as recommended.
The Mayor noted it was the time and place scheduled for a
continued Public Hearing to consider a General plan Map Amendment
on approximately 12.75 aces from Medium Density Residential to
General Services and Amend Section v, policies 12, 17 and 22 of
the General plan, (GPA 91-01) and to consider a rezoning from Al
(Agriculture) to C3 (Shopping Center commercial) District located
at the southwest corner of Highway 152 and Santa Teresa Boulevard
(Z 91-07), DBO Development Co., applicant, noting that the appli-
cant has requested continuance to December 20, 1993.

Motion was made by councilwoman Rowlison seconded by
councilman Kloecker and carried that the continued Public Hearing
for GPA 91-01 and Z 91-07 be further continued to December 20,
1993 as requested by the applicant, DBO Development Co.
The Mayor stated that it was the time and place scheduled
for the continued public Hearing on the Resolution of Intention
and the Engineer's Report re: North Forest street Assessment
District (contd. from 10-25-93).
A letter from Hope Rehabilitation services regarding the
proposed district was noted.
updated information to property owners was noted.
An updated staff Report was noted and further explained by
Director of Public works Allen recommending that council take
action on the proposed District at this meeting.
The Mayor opened the Public Hearing and heard from the
following property owners:
Jean Blake, 8665 Murray Avenue, noted that they have
changed their position to be in favor of the proposed assessment
district.
Tom westoby, 567 Paradise Road, salinas, confirmed his
opposition to the proposed district; that he would be forced to
sell his property if the district were formed at this time. He
further requested a deferred payment agreement if and when he
decided to develop his property if an assessment district is
formed.
Egon Vollrath, 8525 Forest street agreed with the previous
speaker further noting that the majority agreeing on the
assessment district should be based upon the number of people and
not parcel ownership. He further noted that he would be forced
to increase the rent charged the counseling center and they have
indicated that they could not afford an increase.
shelby French, 5440 Nicole Way, Manager of Hope Rehabilita-
tion, presented and read a letter from James purcell, President
of Hope Rehabilitation, reaffirming their previous opposition to
the proposed district.
virginia Fanelli, representing Gilroy Associates Ltd.,
noting that their group met with the applicants of the proposed
district and discussed alternatives of deferred development
agreements if the district is formed, noting that the proponents
of the district did not agree with this proposal; that the right-
of-way costs to be paid by the proponents is not significant;
that the opponents want the improvements but are not able to pay
for same.
Bill Reimal, 7551 Kentwood court, representing Fortino &
Kishimura, gave an update on the procedures taken, requested
council make a decision on the proposed district at this meeting.
After further discussion by council, Mr. Reimal noted that
he would accept continuing the matter an additional 30 days.
Director of Public works Allen noted that a delay in excess
of the 120 day from award of the bids (9-23-93) would require re-
bidding the project.
councilman Hale noted commercial vehicles on Leavesley Road
turning onto Forest street in an illegal fashion due to the
present width of the street. Director of Public works Allen
noted that this would be an illegal turn. It was further noted
by staff that a deferred payment agreement unless agreed upon
between the property owners and paid by the developers would not
be possible. Discussion was had regarding the bond sale
procedure and further explained by a Bond underwriter.

Mr. Reimal agreed to continuing the matter to the December
6, 1993 regular meeting.
Mr. Philip D. Assaf, Bond Attorney, noted that if any of
the assessments in the proposed district increase, that the
property owners would have to be re-noticed.
Domenic Fanelli addressed the Council noting that their
original proposed assessment went from $40,000.00 to $240,000.00
and doubted whether any progress could be reached in thirty
days. He further noted that a signal light at Forest street
should be considered.
Motion was made by councilman Kloecker seconded by Council-
man Valdez that the reading of Resolution No. 93-64 be waived and
that it be adopted continuing the Public Hearing on North Forest
street Assessment District to December 6, 1993.

It was noted that A/S 93-10 planned Unit Development (PUD)
approval was continued from october 25, 1993 on property zoned
C3-PUD (Shopping Center commercial) planned unit Development for
the development of a Commercial shopping Center to be located at
the southeast corner of Wren Avenue and First Street, Smith's
Food & Drug center, Inc. and the Glen Loma Group, Applicants.
Councilman Hale and city Administrator Baksa left the Coun-
cil table due to a possible conflict of interest re: A/S 93-10.
Planning Director and city Administrator Protempore Dorn
gave an update on the staff Report and noted that the issues of
this application are for the design and parking of the proposed
project.
A letter from International Brotherhood Electrical Workers
(AFL-CIO) was noted.
A letter from Helen F. Flanagan was noted.
An updated staff Report and city Attorney's staff Report
and recommendation were noted.
The Mayor asked if there was anyone in the audience wishing
to speak on the matter. The following addressed the council:
Glenn Skogen, 837 Ramona way, presented petitions (in
addition to petitions signed by sixty-two local businesses
received November 15, 1993) from local businesses in opposition
of Smith's locating in Gilroy.
corin Kahn, Attorney, representing Glenn skogen, noted
disagreement with issues presented by planning Director Dorn,
noting that there is no economical analysis in the Initial study
and in his opinion the General plan requires same, due to the
size of the proposed project. He further noted that there are
use limitations in the General plan and two significant in the
proposed project, specifically Wren Avenue being a collector
street south of First street, not a major thoroughfare and under
commercial section of the General Plan, policy 13, page V. 2. no
buffering or screening proposed on the east side to protect high
density residential uses; and policy #24, Wren Avenue as a
collector street, neighborhood commercial uses not a large
project such as proposed. He noted these are three significant
use policies not consistent with the General Plan. He further
noted with respect to severe limitations on ingress and egress
policy #44 - Transportation Element, there are three driveways on
First street and the ingress and egress on Wren Avenue is not
just serving neighborhood traffic. He further disagreed with
smith's Attorney, specifically that a planned unit development
goes a step further than zoning and will create traffic con-
gestion; findings a. through i. (noted in the Planning Director's
memorandum) required and not evidence to support the findings.
councilman valdez requested that Mr. Kahn submit a letter
covering his objections to the project.
The city Attorney explained the legal questions. Planning
Director Dorn explained the proposed project's conformities to
the General plan. Discussion was had on requiring an economical
(or fiscal) analysis of the project.
(At 8:59 p.m. the Mayor declared a recess to change the
video tape and called the meeting to order at 9:08 p.m.)
Discussion was had regarding the need for an economical
study for the project.
Ron Henry, Realtor for smith's, addressed the Council and
explained competitive situations in their other stores and
adjacent trade areas. He further stated that this architectural
and site review is not a zoning matter and the project is not a
different type of use for this planned unit development district
and questioned a requirement of an economic impact study for
architectural and site review and that they would be singled out
unfairly.
Deborah strunk, 7425 Wren Avenue, addressed the Council and
noted that the smith's stores in Torrance and Fullerton referred
to by Mr. Henry are in cities much larger than Gilroy. she
further noted that there is a school three blocks from this
proposed development and the project would create an unsafe place
for 800 to 1,000 students.
Discussion was had by council on the matter.
Motion was made by councilman Kloecker seconded by council-
woman Rowlison and carried that the applicant fund an economic
study to assist the city to determine conclusion of the findings,
(consultant to be selected by the city) and requested council
review the scope of the study. councilmembers: Nelson and Gage
voted "no" on the motion. councilman Hale: Absent.
(Councilman Hale returned and took his seat at the council
table. )
Election
The official Canvass of the Registrar of voters for the
November 2, 1993 General and consolidated special Municipal
Election was noted.

councilman Hale that the reading of Resolution No. 93-65 be
waived and that it be adopted Declaring the Total vote and

THE CITY OF GILROY ON NOVEMBER 2, 1993.
RESOLVED, by the city council of the city of Gilroy, California
that;

WHEREAS, by order of this council a general municipal election and
a consolidated special municipal elections were held and conducted in the city
of Gilroy and consolidated with the special state-wide election on Tuesday, the
2nd day of November, 1993 as required by law and the Charter of said city as
amended; and
WHEREAS, it appears that notice of said general municipal election
and consolidated special election was duly and legally given; voting precincts
were properly established; election officers were appointed and election
supplies furnished; and in all respects the election was held and conducted and
the votes cast thereat received and canvassed, and the returns thereof made,
determined and declared in time, form and manner as required by the Charter of
said city as amended and the general laws of the state providing for and
regulating municipal elections in said city; and
WHEREAS, the Registrar of voters did conduct the canvass of the
returns of said municipal elections and did count the absentee ballots cast
thereat, pursuant to direction and order of the city council of said city; and
WHEREAS, said canvass was duly completed and the results thereof
were certified by the Registrar of Voters and submitted to this council.
NOW, THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, as follows:
1. Said municipal elections were held and conducted in the city of
Gilroy, county of Santa clara, state of california and consolidated with the
special state-wide election held throughout Santa Clara County on Tuesday,
November 2, 1993 in the time and in the form and manner as required by law.
2. That there were established twelve (12) voting precincts for
the purpose of holding said municipal elections consisting of either regular
election precincts established for holding state or county elections, or a
consolidation of some or all of such precincts, as follows:

has executed a certificate certifying to the results of such canvass, which
certificate is hereto attached, marked Exhibit "A" and by this reference is made
a part hereof. Said certificate has been examined and is hereby approved and
adopted by this council as the official canvass of said municipal election.

municipal election was 5,689 (including 593 absentee votes).

office for a term of four years, from and after Monday, November 15, 1993, and
continuing until her respective successor shall qualify.
PETE VALDEZ, JR. was elected a member of the city council to hold
office for a term of four years, from and after Monday, November 15,1993, and
continuing until his respective successor shall qualify.
8. At said special municipal election the following measure was

The Mayor requested councilman Kloecker attend the next
Santa clara County cities Association to represent him as
Alternate representative.
Motion made by councilman Valdez seconded by councilman
Kloecker to extend deadline of November 19, 1993 for all
commission and Board appointments expiring December 31, 1993.
councilmembers: Gilroy and Gage voted "no" on the motion.
councilman Gilroy requested the November 19, 1993 deadline for
receipt of commission and board applications not be changed as
this issue was not agendized.
councilman Valdez requested that this issue be agendized

regulation issue on the November 22, 1993 agenda (previously set
for December 20, 1993). councilmembers: Gilroy and Gage voted
"no" on the motion.

noted that this issue is scheduled for the November 22, 1993
regular meeting and that he would attempt to have an Open Space
Authority representative to provide the information requested.
councilwoman Rogers requested a legal opinion from the city
Attorney if the city decided to not be included in the Open Space
Authority.
councilman Gilroy noted that he has application information
for Neighborhood Grants available that the Drug Abuse Prevention
council received for a prior grant approved.
The Mayor noted a Dance to be sponsored by the Hispanic
chamber of Commerce to benefit the Gang Task Force December 4,
1993, $10.00 per ticket.
